DEFINITION OF RAPE The definition of rape goes beyond just forced sexual intercourse. It also includes unlawful sexual intercourse or sexual penetration of the anus or mouth, as well as the vagina, of a person, by a sex organ, foreign object, or other body part, with or without force, if the victim does not give their consent or is incapable of giving their consent. RAPE CULTURE HYSTERIA Rape culture is a set of the feminist rhetoric, of the feminist worldview summarized succinctly in a very aptly: ¶ Women are victims , and that collectively, as only they can be raped ¶ Men are perpetrators , and that collectively, as only they can rape and who has raped a woman. «Men are always treated as potential rapists, and women as their helpless victims.» «Men accused of sexual assault are deemed guilty until proven innocent.» Rape culture perpetually cast men as aggressive perpetrators and women as passive victims. This led to a distorted view of masculinity, but it has already led to policies that have proved devastating to those who have been falsely accused. From this ideological worldview a man can be convicted as a rapist, because from a feminist perspective, no female commits false accusation (all women are victims), and that men are always guilty who are protected from punishment by a supposed rape culture. GRAY AREAS OF RAPE ALLEGATIONS Where rape allegations are concerned, there is a gray area in some cases. These gray areas include what could be considered mixed signals, memories deluded by alcohol, and the misunderstanding of what actually constitutes a sexual assault. Sometimes rape accusations are actually cries for attention or an attempt to cover up what might be considered an embarrassing moment. A case occurring in 2009 at Hofstra University is an example. A female student at the University claimed a group of men raped her. Later, when cell phone video surfaced, the accusation fell apart. The cell phone video showed she had consented to the sexual encounter. EVIDENTIAL CAUSES OF FALSE ACCUSATION Causes of false accusations of rape may fall into two categories: non-deliberate deception (such as false memories or mental illness ), and lies. FALSE MEMORIES There are several ways in which an alleged victim can accidentally come to believe that they have been raped by the person(s) they accuse. These include, but are not limited to: Missapropriation: The victim's confusion of the memory of the real rapist with the memory of someone else. A disturbed mental state(Very rare) : this may include false memories ("sexual hallucinations" or pathologic lying. LIES An accuser may have several motivations to falsely claim they have been raped. This can be categorized into: ¶ Material gain: to receive money, professional promotion or other material benefits. ¶ Cover up : a false allegation is used to cover up other behaviour, such as a lady caught having an orgy or other sexual acts. ¶ Revenge: to retaliate against a disliked person by damaging the reputation, freedom or finances esp to an ex. ¶ Regret: after having had consensual sex, a complainant experiences negative feelings such as disgust, shame, and sorrow; when others notice this and ask about the source of these negative feelings, they are prone to view the encounter as rape and put the complainant under pressure to file an allegation. ¶ Sympathy: a special kind of attention-seeking whereby the complainant tries to improve a personal relationship with a specific individual. A lady once lied about being raped by 2 men so has her college crush will not to see her as promiscuous. ¶ Relabeling: consensual sex is relabeled 'rape' to the police, because of its 'disappointing or shameful character'. There is distinction between some acts during a consensual sexual encounter that a participant had no desire to engage in but nonetheless gave consent to please their partner( e.g Mouth Gig) ; and rape (nonconsensual sex). SELECTED CASES Case1 In January 2010, University of North Dakota student Caleb Warner was accused of sexually assaulting a fellow student. A UND tribunal determined that Warner was guilty of misconduct, and he was swiftly suspended from school and banned from setting foot on campus for three years. Yet the police - presented with the same evidence - were so unconvinced of Warner's guilt that they refused to bring criminal charges against him. Instead, they charged his accuser with filing a false report and issued a warrant for her arrest. Warner's accuser fled town and failed to appear to answer the charges. Despite these developments, the university repeatedly rejected Warner's requests for a rehearing. Case2 Then there was the more recent case at the Athens campus of Ohio University. During Homecoming Week , a video was taken of two drunk students engaged in public sex acts near the campus. The woman charged the young man with rape the following day. Many outraged students spurned the police chief's admonition against a rush to judgment, insisting that if the young woman had reported what happened as rape, it was rape. But the online video suggests the MouthAction depicted in the video was entirely consensual. In the video, the woman, who appeared to egg her partner on when a gathering audience inhibited him, was seen smiling, flipping her hair back, showing signs of sexual enjoyment, and even grinning for the camera. Eventually, the two walked off together hand in hand. Case3 Last December a woman going by the pseudonym of “Joanie Faircloth” wrote in a website comments section saying the singer-songwriter Conor Oberst had raped her when she was a teenager. Although Conor Oberst denied the rape allegations , word spread fast and he brought a libel suit against her because she refused to retract the comments she had posted. Later, she admitted the rape allegation was false. She had lied in order to get attention. Instead of taking his side, some people attacked Oberst because he took legal action against her in order to defend himself against the false rape allegations, which could have damaged or even ended his career. In the Oberst case, the Daily Dot’s Chris Ostendorf argued that Conor Oberst’s actions after being accused could intimidate real actual rape victims preventing them from coming forward. NEGATIVE CONSEQUENCES OF FALSE RAPE ACCUSATIONS Although rape allegations are never something that should be taken lightly, neither are unfounded rape accusations. Even being falsely accused of rape, the results can have tragic consequences. This can lead to jail terms, suicide etc There was a case of a Nigerian man that committed suicide after he was falsely accused and no one believed him. For example, California football star Brian Banks spent five years behind bars after classmate Wanetta Gibson accused him of rape. When Gibson later contacted him and apologized, admitting she had fabricated the whole rape attack, he was later exonerated. A similar case involved William McCafrey in New York. After he served four years of a 20 year life sentence, his accuser, Biurny Peguero, confessed that injuries she had received was not due to McCafrey raping her but rather the result of a fight she had with several woman. I was with my elder brother's baby girl, she is 2 years old now. We were both playing together, immediately the mother came in and saw me with her. She stared at me suspiciously before taking her daughter away. I felt shamed angry at the same time. I was judged before doing anything. TACKLING FALSE RAPE ACCUSATIONS If you feel you have been wrongly accused of committing rape, you must take the rape allegations seriously. Even if you feel the allegations appear ridiculous, the consequences from them can be long-lasting. In addition to being sent to prison, you could face fines as well as loss of your job. If somebody accuses you of rape, the first thing you need to do as soon as you get informed is to gather evidence or a witness or a lawyer to back you up. If she broadcast the false allegations on social media, use the same social media to respond with your counter evidence. 1. Control Your Emotions It’s both an angering and frustrating thing to be accused of rape. However, you need to learn how to keep your emotions in check, which means taking responsibility about what your next steps are and learning how you can protect yourself. 2. Stay Away From the Accuser Until you can legally and evidentially defend yourself, stay away from your accuser to prevent them from making any further accusations against you. 3. Assess Any Possible Motives Try to discover what your accuser’s motive is for falsely accusing you of the rape allegations. Many times an ex who is jealous will attempt to get back at their partner for assumed slights. If you know, or believe, it was consensual sex, what other circumstances were involved? Did you made her angry afterwards? Did you broke her heart? Knowing their motive can help you. Like in the case of a Doctor that was accused of rape, he was able to clarify that it was because he didn't pay her after sex after doing a fake transfer resulted in the accusations. 4. Detailed Account of Events and Possible Witnesses Provide detailed account revolving around the events that led up to the rape accusations. Tell everything including any details that you may not feel is pertinent. You never know what details could be helpful to you winning your case. If you have any chat evidence or video evidence that shows it is consensual it will save you. An important aspect to remember is whether there were any witnesses to the interaction between you and your accuser, especially if they can be used as an alibi. The less dangerous road of questioning each person who comes forward with rape allegations will prevent damage of innocent lives as been labelled a rapist and nobody believing you are innocent can be very depressing. 2. I'm glad to have been able to read to this point, I had to open an account so as to be able to comment. Thanks a lot psychologist for the eye opener, a lot of things I read in this whole thread just describe what I experienced in my last relationship, Thank God I was smart enough to walk away early enough. But I have a simple question, I'm not sex freaked and based on my personal decision I don't engage myself in any sexual relationship with ladies so even if I ask a girl to date me, it's never because I want to get her laid. So now, reading this I feel I really do not need to keep friendship with all these ladies. What advice will you give someone in my shoes? ArchiPelsx: Friendship between men and women always favours the women. The reason is you give them attention, time and sometimes help which I believe is of the same value as Money or power to men. For men the only thing they can benefit from women is sex and procreation. Since you don't subscribe sex with women, I will say you are getting a bad deal. You can still get a healthy relationship with them by controlling your time and attention you give them, and also be careful not to fall for their manipulations. Learn to set boundaries also. Just know at the end of the day you will still be getting a bad deal from that friendship. Except they add something better to your life which is rare in Nigeria, but never say never. TheUndercover: Even though this advice is good, it is kind of bad. Why? because most guys are going to be naive in relationship and marry hoes. There is a reason why we do notice a common trend - good guys marrying hoes/damaged women while bad guys marrying good girls - EXPERIENCE is what happened. Over the year of dating, a womanizer has gathered a lot of experiences and had his fair share of heartbreaks, so when he sees a reserved good girl, he can smell, fell and notice such girls but an unexposed/inexperienced love starved man will quickly fall for a lady with wide experiences in past relationships. The care, foods, mind blowing sex, knowing what to do at the right time, buying gifts and showering fake loves just to secure marriage. That is why it is common for such men to marry over 30 years ladies, ladies with baggages(kids), washed-up / worn out ladies and these men will say - This ladies are different, they show them love unlike younger ladies, makes him happy and gives him rest of mind. 3. MALE SEXUAL ABUSE Where there is no law, there is no freedom –John Locke Historically, rape was thought to be, and defined as, a crime committed solely against women. This belief is still held in most parts of the world. Research about male-victim rape had only just begun to appear by 1980, focusing mostly on male children. Most of the literature regarding rape and sexual assault focuses on female victims based on the theory that women are always victims. In Nigeria, according to Section 357 of the Criminal Code, "rape occurs when a person has unlawful carnal knowledge of a woman without her consent, if with her consent, by means of threat or intimidation while." In Section 282 of the Penal Code, the crime occurs when "a man is said to commit rape when he has sexual intercourse with a woman, against her will, without consent, with consent obtained under duress etc." Nigeria does not recognise anything like male rape. Rape is mostly referred to females. If you report to the police that you were raped by a woman, you will give them a 5mins good laugh and if care is not taken they might accuse you of being the rapist who is trying to play victim. As such no data of male victims of rape. The research In the 2010–2012 National Intimate Partner and Sexual Violence Survey, the Centers for Disease Control (CDC) measured a category of sexual violence called "being made to penetrate" which captures instances in which victims were forced to or attempt to sexually penetrate someone (of either sex), either by physical force or coercion, or when the victim was intoxicated or otherwise unable to consent. The CDC found in the 2012 data that 1.715 million (up from 1.267 million in 2010) reported being "made to penetrate" another person in the preceding 12 months, similar to the 1.473 million(2010: 1.270 million) women who reported being raped in the same time period. The definitions of rape and "made to penetrate" in the CDC study were worded with extremely similar language. CDC also found that one in 17 men (5.9%) reported being made to penetrate at some point in their lives (up from 4.8% in 2010). MYTH BUSTERS Myth 1 : Males are not vulnerable By masculine gender socialization , it is thought that males, even younger males, cannot be victims of rape, nor even that they are vulnerable. In some societies, it is considered shameful and unmanly if a male child cries, because the male stereotype depicts males as being able to protect themselves, which may not always be the case. Young boys may be weaker and vulnerable to perpetrators, who are usually stronger. The perpetrators can use whatever they have to abuse the child , including money or other bribes. An adult male may also be helpless to fight back, or fearful of doing so because of the possibility of being arrested for assault and/or battery due to social double standards regarding the use of force in self-defense involving female. Myth 2 : Males always want sex A common societal belief is that a male must be aroused if he gets an erection or has an orgasm, therefore that means that they are willing and enjoying any sexual activity. Roy J. Levin and Willy Van Berlo wrote in an article in the Journal of Clinical Forensic Medicine that slight genital stimulation or stress can create erections "even though no specific sexual stimulation is present". An erection does not mean that the men consent to sex. Early Morning glory in which a man gets morning erection does not neccessarily mean he wants to have sex. The penis sometimes just get up for no reason. Males can get erections even in traumatic or painful sexual situations, and this does not indicate consent. Much like female erectile response, male erectile response is involuntary, meaning that a man need not be aroused for his penis to become erect; mechanical stimulation is all that is necessary. Confusion comes from conflating arousal with stimulation. Arousal and stimulation are distinct things. Stimulation is a physical response to a stimulus. Men can be physically stimulated without feeling aroused and thus causing an erection. Men can be scared and intimidated into an erection, especially if the person is older or an authority. Myth 3 : Atraumatization One notion is that males are not traumatized by the abuse experience than females are; this includes the belief that males are less negatively affected. Studies show that the long-term effects are damaging for either sex and males may especially be more damaged by social stigma and disbelief of their victimization. It is noted by Eogan and Richardson that male victims tend to feel more intense anger than female victims, while both go through similar feelings of distress after the rape. Frazier (1993) studied 74 male and 1,380 female rape victims. War rape: The rape of men by men has been documented as a weapon of terror in warfare. In the case of the Syrian Civil War (2011–present), the male detainees experienced sexual abuse such as being forced to sit on a broken glass bottle, getting their genitals tied to a heavy bag of water, or being forced to watch the rape of another detainee by the officials. In the Democratic Republic of Congo, Many male refugees who have escaped from the civil war in Congo to Uganda have been raped. In northern Uganda, in recent years there have been ongoing attacks by rebel groups against the government forces. During these conflicts, civilian men have often been attacked, kidnapped, raped and forced to fight for the rebel groups. FEMALE ON MALE RAPE Female-on-male rape is under-researched compared to other forms of sexual violence. Whenever rape is mentioned, what usually comes to mind is a man taking advantage of a woman. Men are expected to just remain calm and pretend as if they enjoy being abused. SELECTED CASES Case 1 "Few years ago an incident happened in Ilorin, Kwara State. Two young ladies approached an Okada man and asked him to take them to a remote part of town. It was already late, so the man initially refused to carry them through that bushy part. But he later agreed after the two promised to pay him N1,000. On their way, one of the ladies suddenly asked him to make a stop. As soon as he parked his Okada, one of the ladies slapped him from behind, and, before he knew what was going on they had overpowered him and tied him up with a rope. They then dragged him into the bush, tore his trousers and raped him repeatedly before they finally left him there and left." Case 2 A similar case includes James Landrith, who was made to penetrate a female acquaintance in a hotel room while incapacitated from drinking, while his rapist cited the fact that she was pregnant to advise him not to struggle, as this might hurt the baby. Case 3 There are several widely publicized cases of female-on-male statutory rape such as in the US which involved school teachers having illegal sex with their underage students (for Mary Kay Letourneau and Debra Lafave). Case 4 There are drivers, domestic male staff, junior staff and agile and handsome young men who are being sexually exploited by madam/female bosses at the top, but they suffer in silence. I have heard of male staff, who were victimised because they refused to sleep with their female bosses. A black once complained of having sexual advances by his female boss and when he rejected her he was fired and then he came to lament on SM. The funny thing is that most NLanders were blaming and criticizing him, some were saying he was lying. If roles were reversed it will be a different reaction. Even Joseph in the bible was sexually assaulted. These are clearly cases of sexual harassments. EFFECTS OF RAPE PHYSICAL EFFECTS Sexual abuse results in severe emotional and often physical trauma . Among sexual assault victims over 18 of age, 31.5% of females and 16.1% of males said that they incurred non-genital injuries from the assault. Male victims received more ancillary injuries and were more likely to be threatened with a weapon by the perpetrator. The symptoms and injuries most frequently noted are tension headaches, ulcers, nausea, colitis, abrasions to the throat, black eyes and broken bones. The study by Stermac and colleagues (2004) noted that 45% of male survivors who went to a hospital sexual assault centre had some type of physical injury (25% soft tissue injury , 20% lacerations ). The data from hospital emergency rooms show that male rape victims are more likely to have non-genital injuries than females, and that they are more likely to neglect seeking medical attention if the injuries are not significant. Hodge and Canter (1998) report that homosexual male victims are more likely to sustain serious injuries than heterosexual male victims. PSYCHOLOGICAL EFFECTS Rape victims, males and females, may find it difficult to report the sexual assault against them. There is a myth that a male sexual assault victim will become a perpetrator themselves. This myth is very damaging to victims, both to their mental states and to how people treat them. Elizabeth Donovan, a psychotherapist, stated that males have the added burden of facing a society that does not believe that rape can happen to them at all. The social stigmatization of male victims is also damaging and has been described as 'secondary victimization'. It has been linked to the under-reporting of rape and post-rape trauma; male victims are also susceptible to post-traumatic stress disorder . Some studies have found that some victims chose not to report their assaults as they fear being labelled as a ‘closet homosexual’, bi-sexual, or as promiscuous. Regarding the blaming of victims of rape, researchers, in 1993, conducted an experiment and found that a statistically significant proportion of males tend to blame the victim, even when the rape victim was a male. LONG-TERM EFFECTS Compared to men who have not been sexually assaulted, men who were sexually assaulted before age 18 have a greater risk of having mental health problems, including symptoms of post-traumatic stress disorder and depression; alcoholism and drug abuse; suicidal thoughts and suicide attempts; problems in intimate relationships; and underachievement at school and at work. Because of gender expectations, being a male child victim of sexual abuse can lead to: 1. Pressure to prove his masculinity physically and sexually (becoming stronger and engaging in dangerous or violent behavior; having multiple female sexual partners). 2. Confusion over gender and sexual identity. 3. Sense of being an inadequate man. 4. Sense of lost power, control, and confidence to his manhood. 5. Problems with closeness and intimacy. 6. Sexual problems. 7. Fear of becoming 'homosexual' or 'gay'/Homophobia . SUICIDE POSSIBILITY The suicide rate for sexually abused males is 14 to 15 times higher than for other males. McDonald and Tijerino found in their research that some participants state that there were occasions on which they felt so bad that they engaged in self-harming behaviors, including suicide attempts, and/or had suicidal thoughts. There is also a study that shows that rape victims are 4.1 times more likely to contemplate suicide and 13 times more likely to attempt suicide than non-crime victims. Males have a much higher rate of completed suicide than females. Male gender roles tend to emphasize greater levels of strength, independence, and risk-taking behavior. THERAPY FOR VICTIMS Sexual assault victims need extensive emotional and psychological healing after the raping, but male survivors are not likely to speak out their cases. Elizabeth Donovan, a psychotherapist, said; "Males have the added burden of facing a society that doesn't believe rape can happen to them ... at all." CRIMINALIZE MALE RAPE These are just few of the numerous cases of male rape that are not usually taken seriously in Nigeria and in the world. I once heard that rape Law in Nigeria has been amended to be neutral but i don't think it has passed second reading. Just as women and girls should be protected against rape and abuse, men and boys should also be protected, in-line with gender justice and fairness. Dpsychologist:Similar to female rape victims, adult male rape victims rarely turn to the legal, medical, or mental health systems for assistance. Personal stories of male rape mirror female rape in terms of a sense of shame, humiliation, and self-blame, but males are even less likely than females to report an assault but No, we are not ready for that conversation. My personal ordeal with Rape is the most painful thing i've ever experienced, It happened when I was 15,I remember hating myself more, asking if I lost my inherent self will, my masculinity, it messes with your head and imprints a trauma too deep that it's scars will always be a reminder. I've never told anyone due to the stigma as most believe a guy can never be raped. The Rape did hurt but what hurt me the most was that it was my dad who planned the whole thing. Damn!!! Flamemignon1: Bro tnks 4 sharing your experience. I was almost a victim of rape, what helped me was that i was stronger that the lady. Up till today i still remember the incident n thank God i escaped. I wonder how comes some guys are praying to be raped. It Disgust me. While one may have a fantasy of being raped by your crush but in real life rape is not enjoyable, it person perpetrating it is not doing it to pleasure you. It is for selfish interest. Dpsychologist:Thanks man I guess that the false narrative "all men are hypersexuals and always sexually hungry" have stuck with society so therefore a man can never say NO, it hits hard to home because that's what my dad kept saying as it was going on "MEN ENJOYS RAPE" My dad was a narcissistic control freak and anyone who wasn't like him was less than a man. As a teenager growing up still figuring out myself, my sexuality actually, he just couldn't take otherwise, I wasn't quite sure yet but when I broke my virginity to a girl at 14,then I knew I was far from straight although I was still the masculine jock, was into sports, wrestling etc just wasn't straight sexually. My dad found out (I still think it was my playgirl porn stash under my bed that outed me). I can still remember how it happened, I just finished basketball practice, headed home, went to the freezer for my drink as always, all of a sudden I wasn't myself, I was dizzy, it was all a haze, all I remember was waking up without a full consciousness of what was happening, was tied up to the bed, hands and feet with a chick on top riding and speaking Benin with my dad while he watched.... There were three girls still lined up to do their job, I tried to move but I couldn't and after the first, the next until all four were finished. I don't remember what happened next but I found myself in the hospital the next day. Apparently, the ruphinol he injected in my drink was more than the normal dosage, I almost died. I really don't know what his endgame was but it had the opposite effect because women disgusted me for a very long time, thanks to psychotherapy, although I still feel disgusted but it's not as heightened as before 4 Likes 1 Share |
