Appeal Court hears suit to unseat Akpabio June 27

Hearing in the appeal filed by a Peoples Democratic Party (PDP) governorship aspirant in Akwa Ibom State, Frank Okon Daniel against the nomination of Governor Godswill Akpabio has been fixed for June 27, 2011 by the Court of Appeal.

Hearing was stalled on Monday as some pages in the appeal filed by the appellant were said to be ineligible.

The 3-man panel of judges made up of Justices Garba Mohammed, Regina Obiageli and Jimi Bada adjourned to enable the applicant do the correction before the new adjourned date.
Okon had gone to the trial court seeking the nullification of the alleged purported PDP re-run of January 15, 2011 by which Akpabio emerged as the PDP candidate for the April 16 governorship election.

Justice Abdu Kafarati dismissed Okon’s suit on the ground that the January 9 primary was cancelled by the PDP and another one was held on January 15 based on his petition. Justice Kafarati said the Okon’s suit had become an academic exercise by virtue of the re-run primary conducted by the PDP.

Okon, however, told the appellate court that the trial court erred in law by saying that his complaint against the governorship primary had been attended to by cancelling the said election and ordering a fresh primary.
Okon, through his lawyer, Mr. Taiwo Abe, also told the appellate court to hold that the trial court erred in law by dismissing his suit as academic and speculative.

The applicant asked the appellate court to allow his appeal because the alleged purported re-run primary in which Akpabio emerged as PDP candidate and contested Akwa-Ibom state governorship election on April 16 was a civil fraud carried out by the PDP against him.
The certificate of result of the primary held on January 15 was rendered illegal, invalid, null and void because it was signed by the former national chairman of PDP, Dr. Okwesilize Nwodo who was earlier removed by the party.
However, the PDP lawyer, Chief Olusola Oke and Governor Akpabio’s lawyer, Paul Usoro (SAN) did not oppose Abe’s application for adjournment.

Akwa Ibom State government has evacuated more than 83 National Youth Service Corps (NYSC) members from Akwa Ibom State serving in different locations in Bauchi State. The corps members were airlifted home in a chartered aircraft on Saturday through the Gombe Airport at the expense of the state government.

Governor. Godswill Akpabio who disclosed at the weekend during a press conference at the Government House, said the corps members had stayed for days at an undisclosed army barracks in Bauchi following last week’s post-election violence, which broke out in some northern states during many lives were lost and property worth millions of naira destroyed.

He said the state government responded to numerous distress calls from the corps members and their families to avert being caught in a cross fire. “We acceded to numerous requests and pleas of worried and agitated parents across the state whose sons and daughters were trapped in the troubled area of Bauchi following the post-election violence by acting promptly and hiring an aircraft to save them.

“Many of the youths corpers took refuge at an army barrack in Bauchi while some hid in the bush and could not even be located but through the assistance of the Director of the State Security Service (SSS), we were able to locate them and considering the hazard of transporting them home by road, I had to charter an aircraft to bring them home safely,” Akpabio stated.

The Governor who condemned the carnage that greeted the announcement of President Jonathan as winner of the presidential election in some states in the North argued that killing fellow human beings and destroying their property in the name of politics was a sin against humanity and the perpetrators should be brought to book.
He called on Nigerian politicians to eschew violence but not allow the quest for position and power to becloud their sense of reasoning adding that the nation was greater than any individual.

“The post-presidential election violence to me is un-called-for; barbaric and highly retrogressive but I dare assert that this sponsored carnage does not in any way reflect the inner feelings of the overwhelming majority of people in the northern part of this great country as many of them also voted the president,” the governor further stated.

He commended the citizens of the state for their sense of equanimity in ensuring that president Jonathan won the presidential election and urged them to also go out in the next Tuesday April 26, governorship and House of Assembly elections by not only voting for the Peoples Democratic Party (PDP) candidates but also protecting their votes.

THE governorship candidate of the Action Congress of Nigeria (ACN) in Akwa Ibom State, Sen. James Udoedehe, yesterday lamented that the Peoples Democratic Party’s government had held the people of the state in captivity, following the spate of politically motivated killings and kidnappings of innocent citizens in the state.


Udoedehe, who spoke during a programme on the Radio Nigeria Atlantic FM 104.5, known as People’s Link, said that he was in the governorship race as a result of bad governance in the state.

The former Minister of State for Federal Capital Territory advised the electorate to vote in the ACN during Tuesday’s governorship poll, saying that the party would bring harmony, employment and security to the state which the Peoples Democratic Party’s government had failed to do in the last four years.

He said: "My ambition is as a result of bad governance in the state. Akwa Ibom people have become slaves in their own land. My coming into the race is a divine call.

"In Akwa Ibom State, when you disagree, nobody wants to look at the contents of your disagreement. A few criminals cannot hold us to ransom. We are suffering from the trauma of civil war. The power of the people is more than the power of gun."


Udoedehe explained the PDP government had locked up the political environment against him, saying that he refused to take his campaign trains to Eket Senatorial District due to the security reports available to him that the PDP government was planning to burn down the government treasury and put it on the ACN governorship candidate.


His words: "If only INEC and security agents will do their jobs successfully, I will win Tuesday’s governorship election. Our young men and women are talented ,but they have been misguided by the PDP government into criminals and prostitutes."

The governorship hopeful added that he would focus on agriculture, address the issues of poverty and create wealth for the middle class people if elected into office.



Udoedehe said that his government’s approach to development would be holistic, by asking the people what they were good at and execute such action with the aid of a soft loan for them to be self-employed.

Words of war as started raining in as Governorship election is near. In Akwa Ibom State, Gov. Akpabio faces two strong parties in ACN and CPC. THE governorship candidate of the Congress for Progressive Change (CPC) in Akwa Ibom State, Mr. Larry Esin, yesterday said there was desperation in the camp of Governor Godswill Akpabio to win Tuesday’s election.

In a telephone interview, Esin said: "Governor Akpabio is too desperate. I am sorry to say that, but for a man that claims that he has done so much in Akwa Ibom, that alone should sell him to the electorate.

"I keep asking what about other things he has done in Akwa Ibom. He has introduced cultism as a way of life in Akwa Ibom, and he has insulted our traditional institutions .

But Commissioner for Information Mr. Aniekan Umanah denied the allegations.

On preparation for the governorship poll, Umanah said that PDP would repeat the magic of the National Assembly and Presidential elections during the governorship poll.
