Despite the growth of digital music sales in 2008, the music industry suffered as compact disc music sales continued a downward slide.

The Nielsen SoundScan year-end figures also revealed CDs are the most profitable and common medium for all recorded music, as it still snaps up 85 percent of overall album sales.

The recording industry even is trying to find ways to make up lost revenue when music listeners elect to download individual tracks rather than purchase entire albums. More than 1 billion digital songs were sold throughout 2008 -- a whooping 27 percent increase from 2007 -- while physical album sales fell 20 percent down to 362.6 million.


Purchasing an individual song for $0.99 per song is more appealing than spending between $10 and $15 for an album with two or three songs. During the most important time of the year for music sales -- the final three months -- record sales declined the most, according to sales numbers.

The Recording Industry Association of America (RIAA) originally tried to blame the decline of CD sales on peer-to-peer piracy, but analyst reports indicate piracy is not to blame.

Atlantic Records recently became the first major music publisher to announce digital music sales surpassed CD sales, with more than 50 percent of music sales now coming from music downloads. Warner Music Group also announced digital revenue also surpassed physical sales, with other record labels expected to announce similar trends.

Atlantic, a Warner Music Group unit, is the first major record label to have digital music sales surpass physical media sales.

"We're like a college basketball team on an 18-2 run," said Craig Kallman, Atlantic chairman and CEO.

In April, industry numbers indicated U.S. consumers still purchase more CDs as opposed to downloading digital music, but several record labels mentioned the gap was closing and digital sales would soon overtake CDs. The milestone is significant because this marks one of the first times a digital technology has helped surpass brick-and-mortar retail revenue for media delivery.

Since Napster helped revolutionize the way music listeners can acquire music, digital music has undergone a great revolution over the past nine years.

Even so, there are dozens of legal music download services available for consumers to choose from: Apple iTunes, Amazon, Napster, Rhapsody, Wal-Mart, etc. iTunes is now the No. 1 online music retailer, with Wal-Mart and Amazon attempting to catch up.

The Recording Industry Association of America (RIAA) has long struggled to adapt to the digital age, and still continues to battle music copyright infringement by launching lawsuits against thousands of file sharers across the U.S.

As digital music continues to steal market share away from physical CDs, the industry will face a sobering reality because the overall market for music continues to shrink.
Information gathered by Forrester Research indicates U.S. music sales in 2013 will be valued at just $9.2 billion, with the number dropping from $10.1 billion in 2008. In 1999, music sales were worth $14.6 billion, the RIAA said.

Record labels will again be forced to branch out and try to find revenue streams from new locations it never had to work with.

Dell will work with Universal to offer music bundles on new Dell PCs, while Nokia will work with several music labels to have preloaded tracks and music downloading built into new mobile phones.

Later this month, small independent label Farenheit Entertainment will release the first copy-protected CD, which it hopes will make it easier for artists to control who listens to, and pays for, their music.

The system used on the CD is only the latest of many attempts by record makers and publishers to stop people pirating pop.

But it remains to be seen if consumers will accept restrictions on what they can do with music they have already paid for.

Country copy
On 15 May, legendary country singer Charley Pride is releasing his latest CD, a tribute album to Jim Reeves. Sitting alongside the music is a cloaking technology that Pride's label hopes will stop the CD being pirated.

Willie Nelson could soon be cloaked tooThe CD plays like any other in a hi-fi, car stereo or portable player, but resists the attempts of software "rippers" to convert the music into an MP3 file.

The MP3 format turns bulky CD-quality music files into smaller versions that sound almost as good. Many people have created illegal MP3 versions of the music on CDs they own and then shared them on the net via websites or services such as Napster.

But anyone trying to turn the tracks on the Charley Pride CD into MP3s will find themselves redirected to a website that will authenticate the CD, and then let them download legitimate Windows Media versions of the tracks they want.

Artist protection
Later this year, SunnComm, the company that created the music protection system, is planning to release software tools that let people put together authenticated compilations of music tracks.
Peter Trimarco, the head of country/jazz label Farenheit Entertainment releasing the CD, said the technology gave fans of Charley Pride a fuller experience and helped protect the music from piracy. "We think this will be big," he said.

SunnComm's MediaCloQ system is only the latest attempt by the recording industry to protect the music put on CDs. So far, Farenheit is the only company signed up to use it. But companies such as InterTrust, Liquid Audio and many others have developed authentication systems that try to stop people pirating pop or any digital media.

In December 1998 the recording industry set up the Secure Digital Music Initiative to develop watermarking and protection systems for CDs and digital music tracks.

Subscription models
The efforts of the SDMI have been criticised by academics who say the technology it is developing does not work. So far, legal threats by the recording industry have prevented the academics from publishing their findings.

Copies of the paper produced by the researchers, however, are circulating widely on the net.
But many media commentators believe that consumers will not accept restrictions on what they can do with music they have already paid for.

Many expect that subscription models of paying for music will eventually win out over copy-protection systems that force people to work hard to listen to music.

A British woman has been ordered to pay £16,000 in costs and damages after she put a computer game on a peer-to-peer (P2P) file-sharing network.

The woman, who has not been named, was prosecuted for uploading Topware Interactive's Dream Pinball 3D to a P2P network and allowing other web users to illegally download the program without paying copyright fees to the owners.A UK court has ordered the woman to pay Topware Interactive £6,086.56 in damages and £10,000 in costs.

"This shows that taking direct steps against infringers is an important and effective weapon in the battle against online piracy," said David Gore, a partner at Davenport Lyons who acted for the software company.

Topware started its crusade against illegal file sharers in 2007. After forcing 18 ISPs to pass on details of suspected pirates it sent letters to those guilty of making the game available on P2P networks such as Gnutella and eMule, ordering them to pay a £300 settlement charge or face legal action.

Three other suspected file sharers are also being prosected.

How do you feel ?

Fairhaveninc..com encourages us to consider the significance of Musicians that do not have their music in a digital format. The one whose laws govern these digital format has provided valuable direction for us.

As I receive emails from many different musicians, I tend to get about 35%-45% that do not know, or do not have their music in a digital format. This is a major problem!

You might think having a CD and sending it out to the stations is the best way, but it really isn't. First off your wasting waaay to much money for postage, the CD, and any other costs involved in that process. If you have your music on your computer, you have many advantages.

Not only can you send your music faster, but you also keep it in great condition. Meaning a computer file will not get damaged or scratched, however your CD you can lose, scratch, or damage.

Now having CDs is a good thing to sell to people, or give them as promotional material, but you should also have them in digital format. The way to do this is to RIP the CD onto your computer. There are many different programs to use to do this, the easiest one for everyone to use is Windows Media Player.

This will probably be already installed onto your computer if you have Windows, which I figure 85%-90% of you do. If you don't have it download it. Its free so don't worry about it.

Once you have installed it, you want to insert your CD, and then go to the RIP tab, which will show your CDs information. Now it won't have your information, so change it right there before you RIP the CD. All you need to do is click once and it should go into EDIT Mode. The text will be highlighted and you just change the information.

TIP: Go to Tools, Options, and Rip Music tab. You should rip your music to at least 128kps bitrate (lower quality) or what I recommend is 320kps bitrate. The higher the bitrate the better the quality, so you might as well go to 320kps and use MP3 format, however burning WMA files wouldn't hurt as well.

After putting the correct information in you will click RIP MUSIC button, at the upper right hand corner, below the Music Tab. It will take about 10-20 minutes depending on how many tracks and what quality you want to RIP at.

TIP: Go to Tools, Options, and Rip Music tab. Above the bitrate and audio file format, you'll see RIP Music Folder. This is where once the CD Ripping is complete will go, so make note so you can find your music.

That is pretty much it! Just rename your music files to Artists Name - Song title.(mp3, wma, or wav), doing so will result in a better and more professional looking song file!

CHANCES are that even if you have taken the plunge and started building a digital music collection, you have never had to tangle with the word “bitrate.” That may be about to change.

The Apple iTunes store, the largest seller of music downloads, began selling tracks from EMI Music without any restrictions on copying, for a slightly higher price than usual, $1.29 instead of 99 cents. To sweeten the deal, those tracks have better sound, with a bitrate of 256 kilobits per second (kbps), up from the standard 128 kbps. Apple has gone so far as to say that this results “in audio quality indistinguishable from the original recording.”


So what exactly is a bitrate?

Simply put, it is a measure of the amount of data used to represent each second of music. A higher number means that more sonic information can be used to recreate the sound. To careful listeners, or those with good audio equipment, more data can make a big difference.

Last fall, Dr. Naresh Patel, a physician in Fort Wayne, Ind., moved into a home he designed with his wife, Valerie. It has a home theater, complete with projector, surround-sound speakers and a high-end amplification system. The sonic centerpiece is two Bowers & Wilkins loudspeakers that cost Dr. Patel $12,000 “with a discount.”

It was all working beautifully until Dr. Patel connected his iPod to the system. Sitting down in the theater’s sweet spot to enjoy his music, he was instead appalled.

“I couldn’t believe what I heard,” he said. “You don’t need a trained ear to hear the complete lack of so many things: imaging, the width and the depth of the sound stage. It almost sounded monaural, like listening to music in mono. The clarity, silkiness, the musicality of the music, if you will, was not there.”

The problem was compression — the process of removing audio data to fit the music into a smaller file. Compressed audio making audiophiles crinkle their noses is not surprising, nor is it new. It has its roots in the debate of the 1980s, pitting the digital CD against the beloved analog vinyl record. The degradation of CD quality into something even more limited is simply proof to many fervent music listeners that Armageddon is indeed at hand.

But several factors are making the debate over sound quality and bitrates more relevant now. Digital storage is cheaper than ever, download speeds are increasingly fast and digital music files have taken the place of CDs in many home theaters and cars. Many people are specifically asking for higher-quality downloads, and Apple and other online retailers are eager to deliver them — for a higher price, of course. (The price of complete albums from iTunes in the higher-quality format will remain the same.)

Barney Wragg, who oversees EMI’s global digital music efforts, said there had been a shift in the music marketplace. “What was an entirely PC, MP3-player experience has changed; now people are wiring music via iPods into their stereos in their home and their car,” he said. “That’s what is driving the demand for increased fidelity. When I connect an iPod directly into the hi-fi in my car, I really notice the difference.”

Apart from bitrate, the sound quality of digital music is also affected by its format, which is determined by the software used to compress it, known as a codec. MP3 is one of the older techniques for compressing audio and is not widely used by online stores. Apple has chosen a newer format called Advanced Audio Coding (AAC), which plays on iPods and some other devices. Most other online stores use the similarly modern Windows Media Audio, or WMA, which does not play on iPods.

All three of these formats are “lossy,” meaning the encoding software surgically trims out audio information that is not easy to hear, because it is covered up by other sound or is situated at the highest and lowest ranges of human hearing. The 9ice's track “Gongo Aso” is 33.4 megabytes when stored in an uncompressed format; the lossy compression methods bring that down to 6.1 megabytes at 256 kbps, or 3.1 megabytes at 128 kbps, regardless of the codec used. (When turning your CDs into song files on your PC, you can choose the bitrate you want in the settings of iTunes or Windows Media Player.)

For one thing, sharing music on your computer or your ipod, with unknown users on the street or on the Internet goes against many of the basic principles of securing your computer. You must have a firewall, either built into your router or using personal firewall software.

However, in order to share music on your computer and access music on other computers within a P2P network such as Download cafes and BitTorrent.com, you must open a specific TCP port through the firewall for the P2P software to communicate. In effect, once you open the port you are no longer protected from your firewall.

Another security concern is that when you download music from from Downloading cafe or other peers on the BitTorrent , eMule, or other P2P network, you don't know for sure that the file is what it says it is. You might think, on you own that hey, you are downloading D Banj's "No Long Thin", but when you double-click the file how can you be sure that you haven't also installed a Trojan or backdoor in your computer or your favourite Mp3 player allowing an attacker to access it at will?

The more important thing you have to know about sharing music is sharing unauthorized music files on the Street or on the Internet is illegal.

The Digital Millennium Copyright Act deems copying of copyrighted music (with the exception of making a copy for your own use) as illegal. The Code protects copyright owners from the unauthorized reproduction, adaptation or distribution of sound recordings, as well as certain digital performances to the public.

In more general terms, it is considered legal for you to purchase a music CD and record (rip) it to MP3 files for your own use. Uploading these files via peer-to-peer networks would constitute a breach of the law.

So, with all of that in mind, sharing music is dangerous. You need a safe and legitimate method to search and download the music you want.
