Hi consular officer. I got a mail (DS 261) from NVC concerning my F2B application but surprisingly, my mother has been scheduled for citizenship interview next month being March, 2015. I understand the possibility of me or my petition (my mother) sending a reclassification letter to retain my F2B application. My question now is when should the revocation letter be sent? Is it after my mother's interview or her swearing in? If its after her swearing in, does it mean I'm still qualified under F2B? Again, to which address should the letter be sent? From my calculation, my case will become current in either April or May. So its an advantage to me that the process has already started. I live in Canada. Thanks.

When your mother knows the date of her naturalization, she should contact NVC, inform them that she's about to naturalize on such-and-such a date, and put in a request on your behalf to opt out of the F2B to F1 conversion. The problem is that you may be caught in a (hopefully brief) tangle if the opt out request isn't granted before you come to your interview. Technically, you'll have to be treated as an F1 until the opt out request is granted -- which means that if it isn't granted at the time of your interview, you'll be told your case isn't current yet. But if that happens, just let the Embassy or Consulate know right away when the request is granted, and they'll schedule a new appointment for you. Good luck!

No, no age limit. However, there's no guarantee that USCIS will approve your request to remain an F2B; and by the time your case becomes current, it's possible that the priority date for F1s may have shifted so that the F1 category is more advantageous after all. Here's the official response:

Under Section 6 of the Child Status Protection Act (CSPA), you can request the U.S. Citizenship and Immigration Services (USCIS) to reclassify you back to the F2B category. You may contact USCIS to inform them that you wish to “opt out” of the automatic conversion to F1 and remain in the F2B category.

Unfortunately, the application of this opt-out provision is not automatic. USCIS would have to approve your request so you may be reclassified back to your F2B category. If your visa petition is still with the National Visa Center (NVC), you will have to provide a copy of the approval to NVC to update your records.
Thanks so much for your quick response and also for your advice. My priority date is 22 Sept. 2008. I feel it will be quicker if my application is processed under F2B rather under than F1. From Visa bulletin, I will be better my about a year.

If your mother is petitioning for you, she should be residing in the United States. If she lives most of the year in Nigeria and just a week or so every year in the U.S., there's no reason to grant you an immigrant visa, because the whole purpose of the immigrant visa is to reunite families.

She has lived in the US for the past two years without visiting Nigeria. So she wants to visit Nigeria for about 4-6 months. We just want to be careful so as to avoid any obstacle that could prevent me from having the immigrant visa. From our calculation, my priority date under F2B could become current in May. If she travels in January and returns in April, will I be alright, please? I'm sorry for asking too much question. I just want to make sure that her few months outside US do not ruin my chance. Thanks.

Your mother should contact USCIS directly as soon as she naturalizes and let them know that you'll be opting out of the conversion. She can also ask them to transfer the case to Canada.

Your brother and sister can definitely act as co-sponsor. If they live with your mother, your mother will file the I-864 and your sibling will file the I-864a; if they live separately, they'll each file their own I-864. I know, it's very bureaucratic.

Thanks for your quick response. But once more, where must my mum be at the time of my interview because she wants to visit Nigeria once she is granted citizenship. She asked if she must come to Canada. If she travels to Nigeria, whats the maximum number of months she is supposed to stay outside US for my case to be still strong? Thanks

He told me that he did not have anything against me and that I could re-apply. But he advised me to allow my situation to change before doing so.
I know my mum had applied for my f2b visa. My brother and my sisters are living in US as citizens. But then, I have traveled to UK on three different occasions although it was even before I traveled to Canada for my education. Right now, I have extended my study permit by two years. Please, I don't know if my situation has changed. Thanks for your good work.

I just checked the status now and it still gives the following information

The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

You haven't proved that the sponsor is your brother. You can do that by including the birth certificates of both of you since they will show you share the same parents with him. You can as well include pictures that both of you have taken together in the past.

It is possible to use a distant family member as a sponsor, however you have to prove that there is a tie between you and the person. Tie can be inform of a statement of account showing where you have been assisted by the person in the past (I asterisked the transactions with short notes of explanation of transactions stapled to the documents), pictures you have taken with the person in the past. previously email conversations that show closeness between two of you etc. I did all these to establish that I had a reliable sponsor. The documents shouldn't be the recent ones.

Let me be sure I understand. Your mother, who was an LPR, filed a petition for you, but has passed away. Is that correct? If so, yes, one of your brothers will need to file a new petition on your behalf. The waiting time for petitions filed by siblings is currently around 12 or 13 years.

There are a very few exceptional circumstances in which USCIS will allow a family member to substitute for a deceased petitioner without filing a new petition, but it doesn't sound like your situation will meet their criteria. See http://www.uscis.gov/green-card/green-card-through-family/basic-eligibility-section-204l-relief-surviving-relatives for more information.
She was a citizen and the priority date is Feb 2008

Unfortunately, in most circumstances, when a petitioner dies, the underlying petition is rendered invalid. With luck there is another relative in the U.S. who can file a new petition for the beneficiary.
Thanks for your quick response. I have two brothers who are citizens and have good jobs. Does that change the situation of the beneficiary? Does the new petition mean that I have to have for another 7 or 8 years?

@ChriGo and other ogas in the house: I am new to this forum. I applied for ACCA in london school of business and finance- lsbf, Toronto campus and I have paid my full tuition since July 2013. I was told to submit my documents to their visa review officer before submitting to CIC in Nigeria which I did but along the line, I was informed that I should hold on with my processing that they are waiting for PCC status from their ministry. Since then, my application has been put on-hold. I mail them every now $ then but their reply is always the same that they are in the final stage of their application. Pls I want to know whether lsbf canada is genuine or I have been duped. Is their any info u guys can give me abt this school? Urgent plS. Thanks
I just checked the website and noticed its a private school. My guy your admission may not come soon. I went to a private school to make an inquiry about a program because I needed a 100% practical program but the Councillor explained to me that their MD refused to fulfill certain requirements from the government so that their students can qualify for PGWP. He told me that some private institutions are trying to meet the conditions so that they can attract international students. I think that is the situation your school has found itself. Without that permission from the government, you can't qualify for PGWP after the program. I have forgotten how the man explained that to me. But I think its a long process. I will never advice any person to seek for an admission in a private school. The school I visited only occupied a floor but have a powerful website that gives an impression that it is a big school. It is at Yong too but its not a business school. I don't think I saw a big school in that area. Unfortunately, my school has resumed and I can't go there now because its very far. I will advice you give them a call.

No sir, ofcourse I got an acknowledgement letter and when I track online its saying "undergoing processing" I wonder why its taking so long since I already have a canadian job offer and LMO. Even when I call their customer care they say the same thing, undergoing processing. Its very very valid. Though it was paper application
