The PDP in Lagos State is asking the leadership of the House of Representatives to exhibit non-partisanship by stating if Mr James Faleke is still a member of the lower chamber.
The chairman of the party, Mr Tunji Shelle, in a statement on Sunday, described Mr Faleke’s status in the House as that of a usurper.
The PDP said that this is because since Mr Faleke ran for election in Kogi State, he must have transferred his voting unit to Kogi State, which makes him ineligible to represent Ikeja of Lagos State in the House of Representatives.
The PDP argued that Hon. Faleke should not continue to represent Ikeja Constituency because he presently has his voting unit relocated to Kogi State.
The party then said that it was giving a 7-day ultimatum from Monday, December 21, to Honorable James Faleke to declare his present place of voter’s registration and for INEC to clear the air on the appropriateness of Faleke inter-changing polling units within a period of less than six months.
The PDP threatened,“If the demand is not met within the period of this ultimatum, we shall use all means permitted and effective to reclaim the seat for Lagos State.”
The PDP also asked the House leadership led by Mr Yakubu Dogara not to allow this situation it referred to as a contraption to stand.
The party said that the situation is politically immoral and illegal, and is an open assault on democracy..

they are not questioning his seating in the house as deputy governor elect, what they want is to clarify whether he is still representing them or kogi. ds issue is becoming a problem because of the letter he wrote to INEC that he is not the deputy governor elect. meaning he will be in dat seat until d issue is settled at d supreme court which is not fair to the Ikeja federal constituency because it will seen as he being the deputy governor elect and at d same time the Hon. representing ikeja. don't forget INEC is meant to conduct election 3 months within after the sworn in. but as it stands it will take until supreme court give judgment b4 election will be conducted because he won't agree to quit the seat even after the governor elect, bello has been sworn in.

I personally don't agree with this grey area in our electoral laws that allows for this kind of Faleke "double delight".,

No one should be able to "eat" from two plates at the same time... it's not an "appointment", it is a representation / mandate

Just the way football took care of this situation at the senior national level, our laws should be reworked to bar anyone from having such ease of switching at National level politics, state Council elections ok but not at the top echelon!! ...

State of origin vs state of residence.


You can contest elections in

1) The place where you are "ordinarily resident".

2) Your place of origin.

3) You must be a registered voter in the place where you intend to contest election.

If James Faleke is resident in Ikeja, then he is eligible to contest in elections in the Ikeja area.

If James Faleke is an indigene of Kogi, then he is eligible to contest elections in Kogi.

If James Faleke was registered as a voter in Ikeja, then he was eligible to contest elections in Ikeja.

If James Faleke had his voters registration transfered from Lagos to Kogi, then he is eligible to contest elections in Kogi.

He was eligible to contest elections in Ikeja at the time that the election took place, so he was validly elected. Nothing in the law says that he must step down now. The only thing is that he would not be eligible to contest in the next election in Ikeja if he is not registered as a voter in Ikeja.

The House of Rep can't declared Hon James Faleke's seat vacant.Only the Court of Law can't do that.The Lagos PDP can approach the court as stop giving ultimatum as if we are still in the Military era.
