Your brain is dysfunctional. According to Nigerian law there is no provision for the suspension of a CJN by any court in the land. He can only be removed by an impeachment initiated by NJC, Senate and Presidency. No court can effect the suspension of the CJN just like no court can effect the suspension of the president. He likewise can only be impeached regardless of the weight of any accusations against him.

Constitutions are founded as the backbone of any democracy, if you feel it is too slow then apply for it to be amended. That is how to begin the fight against corruption, not by going around the constitution. Donald Trump and many americans don't like the 14th amendment of the US which guarantees citizenship to all immigrant children born on visit to the US but they well understand that the constitution is a sacred document and can't simply be ignored.

Even when [b]your president went on 107 days holiday [/b]in UK, nobody declared his seat vacant when they had some constitutional backings to do so.

Now don't be daft, everything trump is doing is very much constitutional within the confines of US law less he would have been impeached so don't compare rubbish.

Disregarding the constitution of Nigeria is far worse an act of corruption than looting public funds because it is an invitation to anarchy and civil unrest.



Next time you begin a post or respond to someone, don't begin with insulting the person. It generally shows a lack of substance in defending your point. Besides, I don't appreciate it and definitely will not be kind to it.

I'll start with the president's holiday. When he went, he handed over power to his vice. He followed the constitution to the letter. So, there was no vacant seat and the country had a president. In acting capacity. I may add, no president in history since 1999 has ever given power to his vice before. Not even Yar'adua. Besides, he is your president. Any office you work, you have his picture on your wall.

Back to your post or response, there are matters of the law and its the court that can interpret it. Already, as you may have seen in nairaland post, the same CJN had about 5 or so years ruled that the CCT has the power to suspend any public official (he is a public officer) pending matters before it.

The CCT is a product of the constitution and constitutions are interpreted, it is interpreted in relation to other issues around it, not just verbatim of what is written in it (that is what is referred to as spirit of the constitution)



My point is, the constitution is the Supreme law of the land. But it is not set on stones and cannot foresee or cover every possible situations. That is why, the LAW WILL ALWAYS REMAIN AN ASS. If you can ride it, you can ride it.

Onnoghen implicated himself by claiming mistake in forgetting millions in his account, automatically tainting him and rendering all his previous, present and future actions as CJN questionable and subject to challenges in law courts.

Some actions are not legal but are ethical, because it beats my imagination that
Onnoghen wants to be tried in court by people he appointed to court, what nonsense.

Although am not in support of PMB's actions, but somethings require a different approach.

Remember, everything Hitler did was illegal.

What that means is that the charges brought against him is niw void.

He will be given the opportunity to correct his mistakes

If I may repeat, the Code of Conduct Tribunal has been established with the exclusive jurisdiction to deal with all violations contravening any of the provisions of the Code as per paragraph 15(1). This provision has expressly ousted the powers of ordinary regular courts in respect of such violations.

“The Tribunal to the exclusion of other courts is also empowered to impose any punishments as specified under sub-paragraphs (2) (a), (b) & (c) of paragraph 18 as provided in sub-paragraphs 3 and 4 of paragraph 18 while appeals shall lie as of right from such decisions to the Court of Appeal.

The real important question to ask at this stage is what is the consequences of the violation of the aforesaid paragraphs of the 5th Schedule to the 1999 Constitution?



“The answer to the above question is to be found in Paragraph 12 of the said Part 1 of the 5th Schedule which enacts as follows: -‘Any allegation that a public officer has committed a breach of provisions of this code shall be made to the Code of Conduct Bureau.’

“It is my considered view that the above provision is very clear and unambiguous. It provides a remedy in the event of any alleged breach of the provisions. The remedy lies with the Code of Conduct Bureau which has been clothed with the requisite jurisdiction to handle such matters.

The above is the judgment onnoghen passed giving the CCT full jurisdiction.

Baba was suspended on CCT'S ORDER and people dey shout breech of constitution.

Below is a judgment deliver by the CJN, affirming the power of the CCT to suspend any public official (he is a public official) pending the determination of his case. Of course, he may not have know that someday, the law he interpreted will be applied to him.

You guys must be really ugly in real life quoting this "opinion" up and down.

1st, what the opinion is talking about is totally different from what you guys are interpreting here. It never said any thing about judges. That has been prescribed very clearly by the constitution and the constitution never involved the CCT on the process.

2nd, this is only an opinion. I hope you know that an opinion, even a judgement, that goes against the constitution is ultra viles.

3rd, the CCT is on same level as a high court. They are far superior courts to it. An order by one of such courts has already been made. That order is subsisting on the CCT and every other entity in Nigeria until it is set aside by that same court or an even higher court. The Court of Appeal judgment is been referred to here.

Every thing is not politics.

Why do you think that every body in Nigeria- Newspaper, professional bodies, civil society is condemning this.

The only persons supporting this are some, not even all, of the most virulent supporters of Buhari. The only group in support is MURIC. And that says a lot
