Mobil's tons of lies: A story of worlds' most fraudulent patent theft
Last week, the inventor of the world's only anti-corrosive special paint (QIT) that preserves oil pipelines from corrosion, Professor Uwemedimoh and his army of patentees went on what is perceived as the final leg of the legal tussle to get justice by approaching the Supreme court of Nigeria, the highest court in the land, to enforce the judgment it had entered against Mobil Producing Nigeria Unlimited in December 2010.

Precisely, the team of comandclem counsels will be telling the supreme court that Mobil Producing Nigeria Unlimited has willfully refused to comply with the apex court's judgment decision ordering Mobil to pay the sum of N404, 888,600,000, being the value of unauthorized use of Professor Uwemedimoh's patent for off-shore and on shore drilling in the Niger Delta, and for mass producing an exclusive patent and selling same in the international markets without the permission and approval of the patent right owner.

Perhaps, the suit has been filed and within the next twenty-one days, according to civil Procedure rules in litigation, Mobil is expected to receive a formal final order from the apex court to pay the sum within seven working days, failure which everything Mobil becomes the exclusive property of Professor Uwemedimoh and his patentees, the patent owners. In plain language, it is called Liquidation.

But how did Mobil come into this sorry predicament? It is as a result of over confidence and same old imperial mentality with which the western world has always related to the third world countries and their interests. And specifically for Mobil, it is perhaps because she felt that the Federal Government of Nigeria, her Joint Venture Partner in the oil sector is always there to protect her interests, even when it is against the grains of the laws of the land.

But times have changed since Nigeria came to Nigeria some close to or more than thirty years ago, and government's behavior since 1980 when Mobil had the anti-corrosive paint dealing with Professor Uwemedimoh. Today, Nigeria is no longer a by-stander in global politics and ec onomics. Rather she is now conducting her affairs within best international practices standards, as often advocated by the developed western nations of which the USA, Mobil's home country is the chief advocate. This informed much of the institutional and industry regulatory reforms she has done over the years, especially in the energy and financial services sector,  Mobil is a global energy conglomerate abreast with industry and commercial laws and rules which her home country, the U S is the forebear. This baffles the public which keep asking Why?.

MOBIL'S FLOP.
There are more than a few legal reasons why the supreme court of Nigeria upheld the judgment of the court of Appeal Calabar in December 2009.
One, Mobil Producing Nigeria admitted vide a memo dated 2July 1980 addressed to C.J.A Uwemedimoh that there was a “verbal discussion of 30/6/80 on Mobil Blue Oil Enamel Paint”, stating “we herewith send you an order for the purchase of 75 gallons of the paint”, further asking the king to send his quotations.

The justices of the court of appeal Calabar by this letter concluded that actually Professor Uwemedimoh actually invented the product because Mobil needed any such product capable of solving its pipeline corrosion problems. Therefore, since any such product existed at the disposal of Mobil prior to the invention of the Blue Oil Enamel, white QIT paint, the patent rights resides with the inventor. Thus the appeal court jury stated clearly through the lead judgment thus:-“I wish to state straight away that having applied for the patent and the patent certificate No RP 13522 was issued (ex. 2),comandclem Nigeria Limited (which the inventor is its patron)became the registered patentee in the invention called anti-corrosive Special Paint for QIT (Tran steel Blue, white, Enamel QAD) with effect from 5/8/99. The right to the patent in the invention will be vested in the respondents if there is a contract to that effect. Since the appellants alleged there was a verbal contract, but this was denied by the respondents (Mobil), the right to the patent in the invention will still reside in the appellants who are the statutory inventor. Any infringement by the respondents or any other person will be actionable at the instance of the appellants starting from 5/8/99. The evidence adduced by the appellant's dates back to 1980 when the right to sue on the patent had not accrued”. This final decision was endorsed by the Supreme Court.

A specimen of the patent certificate obtained by Liberation Newspaper showed it was dated 5/8/99 and sealed on 6/10/99 issued by the Federal Republic of Nigeria under the patents And designs decree of 1970. It was personally issued by then President Olusegun Obasanjo, Head of state when took over the reins of power at the return of democratic governance in 1999.

Part of the patent certificate explicitly stated-: “And to the end that the patentee may have and enjoy the sole use and exercise and the full benefit of the said invention, I do by this instrument strictly command all citizens of the Federal Republic of Nigeria that they do not at any time during the continuance of the said term either directly or indirectly make use of or put in practice the said invention, nor in any wise imitate the same, without the written consent, license or agreement of the patentee, on pain of incurring such penalties as may be justly inflicted on such offenders, and of being answerable to the patentee according to the law for damages thereby occasioned”.

It is on the strength of these unambiguous contents of the certificate that both the Appeal and Supreme Courts found Mobil guilty of patent infringement, theft, illegal replication and circulation.

GRAVITY OF MOBIL'S GUILT:
Every nation has a constitutional obligation to preserve priced intellectual property of her nationals. Bill Gates, for example was not the inventor of computers. He was neither the discoverer of the principles of computer numerology. But he discovered a systems solution that is not yet in existence. The patent of that discovery is what made Bill Gate the richest man in the world today.

Likewise, the Australian-born Television mogul, Ted Turner, the pioneer of cable television in 1970, through the launch of CNN (Cable News Network) was not the first ever television entrepreneur ever. But his launch of satellite round-the clock television news channel, and the protection CNN enjoyed initially in broadcast rights contributed to the growth of CNN and the fame of Ted Turner who recently donated a whooping $1 billion to United Nations as charity. Mobil's abuse and wastage of comandclem's patent heritage is a global opprobrium that no reputable entity is willing to sympathize with her.

WAY OUT.
The stakes against Mobil are daunting indeed. Most legal scholars are of the view that Mobil is already remorseful, but only needing assistance, probably from her joint venture partners, like the Nigerian NNPC and her foreign office to help it offset the judicial penalty which the apex court in the land has slammed on her. Or Mobil risks losing all it has in Nigeria and elsewhere, including all her lucrative oil fields myriad filling stations, property. Debts owed her by her numerous clients in Nigeria and elsewhere, indeed all that makes the number oil giant in the world to Comandclem.


A Senior advocate of Nigeria (SAN) who is now a retired judge who spoke to Liberation Newspaper on the issue without wanting his name in print because according to him (“I am a retired Bencher and I learnt mediation on the matter is still on, so I won't want to be seen as partisan). But everyone knows that Mobil has no case. If they try to approach the international courts, there they would worsen their case because there are conventions and protocols governing intellectual property and patents. It was a big mistake on their part. But they are capable of paying the fines and go on with their normal business. It is a global conglomerate.”

Comandclem drags Mobil to Supreme Court to enforce payment
Mobil shuns out of court settlement


Comandclem Nigeria Limited has headed for the Supreme Court asking the apex court to compel Mobil Oil to adhere to the appellate court ruling in which King Clement Uwemedimoh was granted the sole patent right owner of the anti corrosive special paint consequent upon which the oil company should pay all royalty due to the inventor, his company Comandclem and the patentees.

In a protracted legal battle that has lasted close to ten years, King Uwemedimoh had dragged Mobil Oil Unlimited to court for the illegal use of his world acclaimed product, the special anti corrosion paint without due regard to his patent right among other rights. The court of Appeal sitting in Calabar, in a landmark judgement ruled in favour of the inventor and ordered that he be paid his dues amounting to $237billion

The legal team of Comandclem Nigeria Limited, led by Barrister Tony Ukam, OON, JP said it has become necessary for Comandclem to seek the intervention of the apex court as to force the oil company to obey court orders and enforce payment. Several court rulings in favour of Clement Uwemedimoh, the inventor of the paint, have not been heeded by the company. Both parties are currently in and out of mediation talks. Only recently, after several denials, the company accepted that it knew Uwemedimo, following a 1980 transaction in which C.J.A. Uwmedimoh's company, Comandclem Nigeria Limited, supplied Mobil Producing Nigeria Unlimited, MPN, with a small quantity of commercially available paint.

The scientist in a statement recently said that he has directed his team of lawyers to pursue the enforcement of the court's order and ensure that Mobil pay his patent rights and comply with the court ruling in his favour. This was sequel to an out of court settlement involving notable Nigerians, including a former president, Obas and Chiefs to make the company see reason why it should honour a valid Nigerian court order. But Mobil characteristically wrote the mediation team and denied that it has any court judgment against it.

It would be recalled that based on the court of appeal judgment granting Uwemedimoh the sole right owner of the paint the federal government gave him the patent certificate. The patent certificate issued to Comandclem Nig. Ltd., dated October 12th 1999 with patent number, RP 13522 granted Uwemedimo and his company, Comandclem Nig. Ltd reads in part… 'and any successor(s), executor(s), administrator(s) and assign(s), ( each and any of whom are hereinafter referred to as the patentee), my special license, full power, sole priviledge and authority, that the patentee or any agent or licensee of the patentee……………and that the patentee shall have and enjoy the whole profit and advantage from time to time accruing by reason of the said invention during the term of twenty years from the first date of this instrument.' (See the Patent certificate form no.4)

Mobil Producing Nigeria had in all earlier discussions and processes denied knowledge of the inventor, insisting that it had only verbal discussions with him and the talk did not amount to supply of paints. But in a document dated 2nd July, 1980, the oil company wrote to Uwemedimo and signed by Mr. H.F. Hawkins, Support Superintendent for Mobil producing Nigeria, reads in part, “reference to our verbal discussion of 30/6/80 on “Mobil Oil Enamel Paint”. We herein send you an order for the purchase of 75 gallons of the paint. For document purposes please send us your quotation on the paint”.

'It is an open fact that Nigerians who are aggrieved by the gross injustice of Mobil have decided to rise up to contribute to the defence of the invention, despite Mobil's intimidations and blackmail to discourage them,' wrote Comandclem lawyer and patent law expert, Barrister Tony Ukam, in a letter to the mediation team on the matter. Barrister Ukam went on, 'Now, what would have persuaded a party who won five out of six contested points of the Court of Appeal to abandon the pursuit on only one point left, (point of payment); if not for assurances of settlement, out of court by Mobil.'

The lawyer noted further, in the letter of defence that, 'it is obvious that just as they dribbled King Uwemedmo in 1980, they were never sincere when they promised him that, if he suspends the Supreme Court deal, they will freely negotiate terms with him. It is therefore unwholesome, malicious and fraudulent for Mobil to shamefacedly flag 'a purported Supreme Court case' as a shield or a cover to shy away from your intervention to redress the injustice. Besides the legal

action initiated by the King, patentees have concluded arrangement to go on a nationwide protest to attract government attention to the sufferings visited patentees by the failure of the oil company to comply by the court order.
The patentees in their thousands, plan to storm the Eket and Lagos offices of the oil company; 'because they cannot come here and ride us. A court of competent jurisdiction has ruled in our favour and Mobil should be made to pay. The government cannot just pretend not to be aware of the antics of this oil company, that has refused to pay us our rights,' said Hajia Habibat Ahmed in Kano.
According to Mr. John Umoekoyo from Oron, 'the question is simple, is Uwemedimoh entitled to any claims for his invention and the answer is yes. And the court had ruled in his favour, then why has Mobil refused or failed to pay him and why is the government not looking into the matter to address it appropriately?, he asked.

You see from the portions extracted from your posts, there is a contradiction in the amount of royalty to be paid by Mobil. We all know that the royalty is $237 billion, but in your first post it is written N404,888,600,000. Is this the equivalent of $237billion in Naira? Well, i dont think so, somebody should help to explain the observed variation in amount of royalty to be paid by Mobil. Or is that the agreed amount after the Mediation talks?

This guys will not stop their 419 and deceit of patentees. If ccnl has filed a case in court for an order for mobil to pay such whopping amount of N$237billion, how come only liberation newspaper carrying it? Every case in court is publich knowledge because there are judicial correspondents that will pick them up and publish in their media. Am talking about cases as ordinary as a worker dragging his empoyers to court, a company suing another company for breach of contract with not much financial implication for defendants. How come a case that has the potential to liquidate mobil is in the supreme court for that matter and only a guerilla newspaper like Liberation Newspaper is carrying it?  Lies and lies and lies and lies and fabrications! comandclem and should stop lying through their newspaper. Again, the said that within 21 days they will get judgement against mobil. Since they claim to have filed the suit at the supreme court before today, we start counting 21 days for them from Monday 27 June, 2011. This wont be different from the promises they have been giving before now that 'Mobil will soon pay'. We are watching and counting 21 days. Abi them thinks say 21 days no go come?

Can some one show me anywhere in above judgment where the court ordered mobil to pay comandclem. Forget about their dream sum of $237 billion. When did comandclem get their interpretation of court asking mobil to pay. The only thing the court did was to acknowledge her ownership of the patent and asked them to sue (action) anyone infrining on the patent. Mind you what was in contention in court was ownership of the patent. And having recognised ccnl as owner, the court asked ccnl/uwemedimo to action anyone seen infringing on her patent. They know that that is the beginning of the matter for them, not the end, as they have to go back to court to prove that mobil is actually infringing on their patent. Meaning they have to prove that the paint in question is being used by mobil and they know it will be difficult to prove. Mind you, ccnl did not even bring a sample of the paint throughtout the court proceedings. As we speak, uwemedimo or anyone in ccnl cannot produce the paint they claims ownership. So how will they prove that mobil is using the paint? Again suing any company seen infringing on their patent is not a matter for supreme court at this stage, they have to start from the High court and progress from there.

Saibuhari, arenaO7 and anexus more grease to your elbows. We must not abandon our mission here which is to ensure no one else gets sucked into this evil scam. The more i read the more convinced i become that these guys belong either in prison or psychiatric wards. If they really believe themselves they are mad and no the other hand if they are just laying traps then they will meet real punishment very very soon. I thought de old King went to school and is a bit polished so why did he recruit touts and illogical simple and hare brained folks to serve as his agents? @Missuzoma, happy sunday to you my dear sister. I read you clearly and agree totally with you there is no retreat, surrender. The mugus wish us dead. They just wish they wake up one day to hear we no longer post here opposing and spoiling their business. For them its a dream. For us we have to keep doing what we need to do - liberating the ignorant - so that more people dont fall prey.

I recommend Yaba left for your cure. I know that real patentees are really frustrated with the turn of events in comandclem. That inspite of ccnl promises of mobil paying, it has turned out to be a mirage. But for the locusts on rampage here, they are fake patentees, they are agents of comandclem posted here to conscript unsuspecting members of the public to register with ccnl, so that Uwemedimo may continue to have free flow of cash that he couldnt get from mobil. Honestly, I sidon dey laugh for Isoko.

    Onbehalf of all CCNL PATENTEES either in Nigeria or oversea countries , i congratulate the first African inventor dually recognised by the Nigerian Government and World Interllectual Property Organisation , PROFESSOR UWEMEDIMOH , who made an official announcement of his invention - anti corrosive special paint (mobil special blue paint, mobil special snow white paint) to its first user MPNU on 26-06-1980.

This official announcement of a successful research , invention and completion of anti-corrosive special paint was a sign of relief for MPNU. This is because MPNU was indeed in a desperate condition in 1980 and was not functioning due to corossion and other problems.

As a result of this official annoucement , MPNU placed an order of 75 gallons of this new invention for trial where CCNL acted in dual capacities - as a supplier of the goods for which CCNL has been paid and as the true & statutory inventor for which CCNL has not been paid.

@Omokemesi, thanks for the above piece of information. But i would like to also inform genuine patentees that the above report has not been vetted by CNN, its only a report written by a user/individual just like you and i. CNN have not published that report, so it's still awaiting approval. Please the next time you want to post such reports verify if the reports have been approved by the appropriate authorities to avoid suspicion.

Secondly, i wish to say straight away that King Clement Uwemedimo (Comandclem) deserves to be honoured by the Federal Government of Nigeria. But the honour is not the BONE OF CONTENTION here, i think his (comandclem) royalties should be tackled first. Once Comandclem receives her royalties, honours from every angle will begin to flow in like water.

Therefore, let us put our heads together and plan on how to get our royalties first before chasing shadows.

The report about Comandclem/MOBIL published by CNN's ireport,   made salient points and allegations relevant to Prof Uwemedimo's case.                                              Up till now, nobody has come out to deny these allegations since they were published by CNN's ireport, almost three years ago.  What is silence?                                                              Anybody is entitled to comment in support, or against the report.                                                           And that was why I asked if the allegations preferred against Mobil in the report were true.  It is not compulsory that CNN must vet it.               There is a column provided by CNN for readers of the report to pass their comments.                                                                 This Thread is not only for collection of royalties.                                                               Lack of a well deserved Recognition and Appreciation of  King Uwemedimo's   invention by the Federal Government, contributed to the ignominious way Mobil has been treating the Nigerian Inventor.                                                                     More

Prof Uwemedimoh deserves recognition for his Anti Corrosion Special paint being used by many oil companies, airlines and others since 1980. This will encourage our young scientists in Nigeria to develop interest in inventions like their counterpaits in advanced countries. It is disheartening that 50 years after independence, Nigeria remains a dumping ground for various products, including those invented or produced by secondary school students in China, Japan and other countries. Must this trend continue for ever in Nigeria? ~OMOKEMESI
