[center]COURT STRIKES OUT NJEMANZE’S CASE AGAINST IMO GOVERNMENT[/center] A Federal High Court sitting in Owerri, Imo state, has struck out a suit brought before it by one Bob Kay Njemanze challenging the state government from obtaining Bond from the Capital Market for execution of projects in the state. In suit No. FHC/OW/CS/37/2010, presided over by Hon Justice L. Akanbi, on March, 30th 2011, the Court struck out the matter in view of the Plaintiff’s Counsel inability to “diligently prosecute his case”. The Plaintiff counsel had earlier pleaded that he be given time to retrieve the case file from the former counsel at Abuja, and therefore requested that the matter be adjourned to enable him retrieve the file. However, the counsel to the 1st and 2nd Defendants objected to the application for adjournment by the Plaintiff, and informed the court that the matter had been adjourned severally on the request of the Plaintiff’s counsel, and therefore pleaded that the case should continue. The court agreed with the submissions of the defendant counsel and overruled the application, averring that the Plaintiff cannot continue to hide under the pretence of trying to retrieve the case file and prolonging the matter and therefore the matter was struck out. By striking out the case, the court has put to rest the agitation of the plaintiff to have the court declare the Bond as unconstitutional.
