KingsCity: First there needs to be a legislation that will clarify who owns the mandate, the candidate or the party. PDP need not speak about this issue because in the past they’ve courted, aided and abetted defections to their party without the said parties relinquishing their mandate(s). 2 Likes |

agabusta:These are things ordinary citizens don't know but keep on commenting ignorantly about our constitution. You will hear people saying the constitution is our problems forgetting the fact that the constitution does not operate itself, rather the people and especially the politicians and privileged ones direct it operation. The politicians will always find lacuna in the constitution to manipulate their way out no matter what type constitution we have. If we are to go by the spirit of the law, we will realize that there is no portion in our constitution that support defection, however, because every law is subject to interpretation, there is nothing anyone can do when judgement are passed base on fact on ground. Just look at issue of local government joint account that the state governors have used to cripple local governments system in the country. We all know that whereas the constitution suggests a joint account for the local governments in a state, it does not say the state governor shall take control of the account. What is the practical reality today? Everyone of the state governors have successfully manipulated the process by ''legally'' taking control of local governments' federal statutory allocation to the various local governments within their jurisdiction. Even in developed democracies, issues like these abound. That's why we must be cautious not to throw the baby out with the bathwater 1 Like |
