I want to ask this guys. If you are working for someone in an organisation, informal organisation at that.

If the boss decides to sell the company, is it legal, morally or and constitutionally right to inform the staffs of the potential sales?

Should the boss just sell the company and care less about any decision the potential buyer decides to do with the staff who were unprepared for this?

don't Tell them until the deal is sealed, don't create problem for the potential buyer

The boss is not obligated to tell same way a landlord is not obligated to tell his tenants before selling his property.
This is inaccurate. You can't sell a property when your tenant occupies it and his rent subsist within telling him. The new owner can throw him out and he would sue you and win. You must tell him and tell the user to allow him exhaust his current term and they can decide new term on fresh conditions after that if they wish.

Yes of course!

It will enable all staff to brace up for the new owners. Some may wish to stay and others may want to move on.

I think he should inform thge staff after the sales and introduce the new buyer to his staff and introduce the staff to the new buyers

Then it's left fir the new buyer to have a meeting with the staff on how he intend to operate his new company

It is morally wrong to sell a company that workers have invested so much time and passion to build without informing the workers. It is an act of betrayal and potend grave danger to the carrier of such entrepreneur as future staffs/workers will always feel they will be treated as he is known.

It depends on articles in the rental agreement though. If the agreement includes a clause that allows the landlord to assign his rights and obligations to another entity unconditionally, without let or hindrance, there’s nothing the tenant can do about it legally.

Morally, yes he should.

Legally, if the change in ownership will affect the terms of their existing employment, yes he should e.g if they have to take up a new contract with the new owners (by implication they have to wind down the offer with the current owner. The current owner is obligated to give them a notice except their contract specifically does not require it

So it is not normal for a boss to call a staff meeting or just head of the dept and inform them abt the sale so that they can pass the message to their subordinates.

So the fate of the staffs should be left like that?

Is this how it works in corporate organisations too?

Just imagine how that guy you quoted would manage his family.

I pity poor woman that will end up in his life, ditto children, yet such type of people will be the very first to condemn leaders

It is good practice to at least inform your staff 5hat you intend selling the company but you are not mandated by law to do so undecided
Re: Should The Boss Inform His Staff Of A Potential Sale? by PHIPEX(m): 12:51pm On Dec 30, 2022
The staff is a stakeholder in the business, you should morally inform them. In structured organisations, the staff are even paid off or receive certain financial package from the sale.

the owner can't just wakeup and disappear from the business. It's also not the new owner that should inform the staff that the business has been bought and sold, no one will take the new owner serious.

During the negotiation phase between buyer and seller of the said business, probably not a good idea to release any information about the potential sale. This is a common global practice. Once the deal is sealed, then the seller can adapt a structured technique of letting the cat out of the bag. This is really important where the business involved provides services as opposed to the manufacturing or sale of goods.

Staff members are human... When going concern and take over is involved, the Staff members have the right to know;
<<if the new employer will take over all the old employer's employees and
<<whether the new employer will have to recognise and preserve all the benefits, remuneration, working conditions, years of service and other rights of the employees.
<< Take overs usually involve job losses, sometimes the new employer always bring their own staffs.. making the old ones redundant.. so all staff members should know..
<<Finally instead of quoting off handedly, we need to know what the Nigerian labour law say about it?

Whilst he is not obligated, it is not out of place, from a moral point of view, to let his staff know.

As a show of Appreciation to them, He should inform them,

There are situations that made it necessary for such sales, And again, A staff, can stop such sales, and profer tangible solutions

The owner is not under any obligation to inform his/her staff of this. In one way or the other, the news will surely filter to the knowledge of the staff and they're free to decide their own fate which is either

- Leave before the new owner take over or

- Stay for the new owner to downsize them ( absorb some while asking the rest to leave) due to policy change.
