Therefore on behalf of EFCC, the funds will not be released.

I suspect EFCC have embezzled the money. Mr Yakubu is simply saying the money should be transferred to an account in which will be in control of the court but EFCC is objecting. I don’t trust that Government agency.

The issue is the law; in the USA and UK, the law is clear the accused must prove that he earned $9.8 million or else he loses. Now if that law was introduced, all Nigerian politicians would be imprisoned.
