Peter532: Honestly, your father has no right to deny your uncle who is his elder access and right to their father's property. FULLSTOP. If you are from the East, the first son owns the residential property of the dad by right. The other properties are then shared amongst the kids. Even if that your uncle die, that property goes to his son and never to your dad. There is a proverb in igbo that is loosely translated to mean 'you do not plant flowers in a house that is not yours'. The uncle do not owe your dad for the renovations on the properties that would eventually be shared and allocated to him. He can choose to be good and reimburse your dad though. I am also sure that your dad might have been collecting rent from these properties and eating it alone. Has he ever even made an attempt to put some money away knowing that someone else is a joint beneficiary to those properties? Your uncle can in thesame vein he is claiming for the renovation costs also asked for an account for the rents collected on the properties. Life should be much more easier than this. Your family should be happy that your long lost uncle is returned and not this fight you are doing. It is never worth it to drag landed property with family members. It is too short sighted. Let them share the properties amongst them and every man can face his lane. Good thing you said your dad has his own properties. No need for any party to get greedy. |

Either way, they must have gotten value for whatever they spent on renovating the house. Besides, their efforts are simply honorarium to their parents. Klass99: Hmmm, but would you not be putting yourself in the bad books of the law by doing such? If you build a house on another man's land, by virtue of the law, the house becomes the other man's property I believe. And if you demolish that house, you would be liable to prison sentence for damages to someone else's property. OP's father by law would have to forfiet the house to the man along with the land except the family can reach some sort of resolution or except the man himself consents to remove the structure from his land. Hmmm, Klass captain, Abeg try dey take am easy with your conclusions and decision making o. The person who wrote this post is either one of these Lagos and Ibadan born and bred Igbo boys who don't know and have regards for customs and traditions. Oboy, your uncle is the rightful head of that family as far as he's the first son and his parents are late. It doesn't matter whether he looked after them or not, maybe as a result of his financial conditions, he remains the head and should decide what happens in the family in respect to his late parents properties. Tell your father to calm down and allow his elder brother to show him where to build his own house and any other thing. |

Klass99:Well, the grandparents had the option to write their will if they didn't want tradition to prevail. But they didn't. The first son may have suffered a lot of setback in SA but could not come back then. Hoping to make it one day. Like many in Lagos for years but still squatting or details. |

Your dad make a big mistakes with reasons. A. When their father is alive ,your dad should ask their father his own share of inheritance Incase his elder brother returned B. Your dad should know that he is not the first son and he should work on his own property not family property C. Finally, your dad want to take it all maybe wishes his elder brother may never returned back again. Tell your father to stop deceiving you his children because he knows Igbo tradition and norms. Immediately, I grown up as a man the first thing I ask my elder brother the first son in a quit environment in a delightful manner. I said to him senior I want a share of my own land now our dad is late, so I can start planning to have my own house because you the first son I can't live with you here forever and my unborn children too. He wake up and go straight to his room without a word to me. The next day early in the morning he wake me up took me to the remaining land and told me here is your own passion kindly develop it but don't sell it Any day you sell it I will send your packing from our general house then he leave me and work away from me. |

Bro, that man is the first son and elder brother to your father , if that man was dead in South Africa won’t your dad and your siblings contribute money to bury him ? He is entitled to everything his parents owned , what should be done is to remove the money for the burial of your grandfather and grandmother then share every other thing . And he has upper hand in the share and properties , that’s his right , as he decided to live in South Africa without nothing is not a reason to take away his rights. |

They just assumed he’s dead and they took over the property, if OP dad was a nice man, he’s supposed to be leaving something behind for his elder brother from whatever he’s getting from the property but since he didn’t pray for his return, he took everything for himself…. |
