RIVERS HIGH COURT RESTRAINS PDP, DAMAGUN, OTHERS FROM CONDUCTING PARTY CONGRESS IN RIVERS

Justice Charles Wali of the Rivers State High Court has restrained the Peoples Democratic Party (PDP) from going ahead with its planned congresses in the state.

In a suit marked PHC/2400/CS/2024 filed by 21 members of the PDP in Rivers State, the Court ordered an interim injunction pending the determination of the motion on notice.

The court further halted the congresses planned by the party to hold in the Wards, 23 local government areas and the state on July 27th, August 10th and August 31st 2024 respectively.

Named as first, second and third sets of defendants in the matter were PDP; National Chairman, Amb. Iliya Damagun; party's National Secretary, Senator Samuel Anyanwu; National Organising Secretary, Umar Nature and the party's National Financial Secretary, Daniel Woyegikuro.

Others were Aaron Chukwuemeka, Dr. Benibo George, Solomon Ogbonna, Lenebari Inaania, Enia Harris, ThankGod Owhorji, Inspector-General of Police, Commissioner of Police, Rivers State, Director-General, State Security Service and the Nigeria Security and Civil Defence Corps (NSCDC).

Recall that on July 16, Justice Sobere Bimbo of the Rivers State High Court restrained the PDP National Chairman and others from conducting Congresses in the state.

However, a week later Justice Peter Lifu of the Federal High Court, Abuja, ordered the Congress to proceed and restrained the security agencies from stopping or truncating the Congress.

The Court processes is a follow-up to the internal battle between the Rivers State Governor, Sim Fubara and his predecessor, Ezenwo Wike over the control of the PDP in the state.

The order from the Federal High court in Abuja is sustained. PDP goes ahead with their congress next month.

This is what happens when you play with fire.

PDP is just a shadow of its former self in Rivers.

They should go and learn how to manage their house before they start looking for leadership elsewhere.

Waste of time. The Congress must go on. Fubara is too small. He will loose all Court Cases challenging the EXCOs that will emerge. Rubbish Rivers State High Court.

Sir, unless there is a counter Court process since the abuse has started already, the PDP will not hold a Congress in Rivers.

Answer the questions asked above since State High Courts do not have jurisdiction for Congresses.

Ask why the Supreme Court ruled that Rivers will not have a Candidate for all positions in 2019? It started like this.

A State High Court gave an order, yet APC proceeded with the Congresses, it went along to the SC. That's what will likely happen since the rumour is that the Gov is readying LP.

The apex court has stated clearly that the court has no business in the internal affairs of a party so this order is without jurisdiction

Since the judgement of the Federal High Court does not supersede that of the State High Court, Wike's team will have to go to the Court of Appeal to determine whether the State High Court or Federal High Court has jurisdiction or not.

If the Court of Appeal decides, the aggrieved party can appeal the decision at the Supreme Court.

Our politicians are useless, very selfish, and do not mean well. Would have thought PDP should show a good example as an opposition party alas, we all are clueless irrespective of party affiliation.
