my dad passed on some years back and ever since then, my self, my mum and my siblings have continued to recieve his pension from overseas. The major problem is my family lawyer, they take half of the payments every month but still maintain that they don't even benefit in any way. They travelled over there to set things up in thier favour, they have a bank account in which our payment are being deposited. Please I need advise on how to correct this situation, these people are well connected and I fear that any action we take might complicate things. I need your opinions, thanks.

If you don't trust your lawyer not to lie and steal from you, you probably should not have that lawyer.
If you believe the lawyer has stolen your money, contact the local bar association and file a grievance. lawyers get disbarred for stealing clients money.
Note, however, the lawyer is entitled to be paid for his services. What was your agreement with the lawyer?

What is the initial agreement between the family and the lawyer concerning payment for their services?

This does not sound like a real story. A man's pension should end when he dies. Not so? If your situation is unique then only his next of kin is entitled to such a pension. Simply gather money for your mother and travel abroad or wherever your father worked. Take his death certificate, your parents marriage certificate and other ID to present at the company. Simply verify the amount to be collected in pensions and what has been paid so far to the lawyers, and then order them to redirect the payments to your mothers account. The company can also help you all recoup the money stolen by the lawyers if they have a branch in the country, less the legal fees of course. Chikena. Lawyers are not supposed to have access to pensions except that is also included in a trust. I doubt this story though undecided

thanks for your response, but don't think I would lie about something like this. About the pension, lets just say that not every country is like Nigeria and when someone recieves his pension or living allowance from abroad, and passes on leaving a family behind, they are entitled to some percentage of the deceased income.

Oh, this is a retirement plan not so? Obviously it will run its course. With a retirement plan, there is most likely also a life insurance with a heavy amount paid at his death if he did not retire before he died. Any way, you have access to the company and you know where and who they are. Contact them and let your mother find out who the next of kin is. If she is the one, then she has to discuss the use of going there physically. I think she will have to go in person to present herself and the necessary identification. Goodluck.
