Well a lot of people doubt when I say this. Also like I said before, let just pray that a stupid ECO does not handle ones case. I included the original. I had called Naric while I'm the uk and they told me o didn't need to further access my certificate.it was a very painful one. The Eco just did rubbish.

Am really sorry for the denial something similar happened to me.1st application was a mess hubby was too busy with his exams so didn’t really put everything required so we appealed 2months after we got an email with my court date after all the overtight bundle we sent we actually included everything they wanted and this was with the help of a solicitor .till date I can’t really say what they did with my bundle because my hubby was with his solicitor when he sent it off.i actually mounted pressure on hubby he resubmitted the bundle to them with a cover letter saying that we have addressed all their concerns .within 10days decision was overturned visa issued within 7 days.the only thing we lost was appeal fee.this people are human beings and am sure they would have overturned the decision if you appealed it they had no reason to deny you in the ist place.wish you all the best

Hello, please can anyone explain this.
1. my sponsor earn £16,231 per annum without extra shift but with extra shift money all she receive over 7 month now is about £1650 per month. How can we explain this that we meet the financial requirement because on her contract it show that she earn £16,231 and she has additional top up money on extra shift.
Just that the extra shift is not shown on the contract but it was mention. But her pay Gross pay shown on her pay slip £18,585.00 so we are down with £15.

" What can we do all she earn now is £18,585,80 per annum with extra shift shown on her gross pay slip, so we are £15 down" i need advice please because am done with my application just to make the payment now.

2. How much is the Immigration health surcharge? because i can see here is 450.00 (USD)

3. Please can anyone explain how i can print out my Facebook chat because i can only printed 3 month backward and we started our Facebook chat over a year now.
Hi dear the rule says you must have made 18600 in the last year so if spouse makes less than that ,but can still meet up the financial requirement through other means like overtime .then what you need is 12 months slip all must be stamped or on company letterhead also introduction letter from company or contract and you need p60 to show that as well you will qualify under category B of full time employment

Thanks 9jabiggirl, when you got your visa from UK while you were preggy what reason did you give the VO for wanting to give birth in US

Actually I had same thought of what to tell vo if they ask reason for wanting to birth in usa.so I decided to get my visa even before I got pregnant. The best option for your wife is to apply from uk it's straight forward no stress at all except for the queue outside the embassy my interview lasted for just 2 mins I was asked the reason for travelling which is for vacation, state, where I work ,who am travelling with and whether hubby is British. No document was asked for. Even with her pregnancy it's easier from uk than naija oooo

My dear just take it easy all hope is not lost yet.wen I got my own decision cudnt even eat for 2days but it gets better wt time. I took to girlfio's advise of not reapplying because if we can give all evidence we have and dey still refuse to overturn wat do u tink will happen if u reapply .I feel since so many ple are goin tru the appeal route dey are now forcing so many cases to court now.dat date dey quoted for u is not d court date its d deadline tribunal gave dem .u shd be getting a court hearing in 2wks.its even beta its happening earlier u mite get an earlier court hearing.u can imagine my own hearing is in may after waiting 13wks for dem to make der decision.its well wt u.wish u all d best

Relationship: what you need to prove here is that you were in regular contact over the period stipulated before you got married. Apart from the phone conversations and Skype, did you submit any emails? Were there any money transfers between the two of you that you can evidence. Did you submit photos of the both of you together before u got married, preferably with family and friends? Did you exchange birthday, Christmas cards? These are all forms of communication and will indicate that you have had relationship before marriage. Do you have family/close friends that can vouch for you and have been aware of your relationship throughout, u could include statements from them

@girlfio we didn't give emails because we don't communicate tru dat ,den no cards but we gave dem plenty pics from university days wt friends, even when I visited uk.he doesn't rily send money cos me I earn good salary and my bank statement was included wt d application . We also gave d money transfer (teller)d few he had for d appeal.den we got a letter from my mum too
Travel / Re: UK Spouse Visa/Appeal Process-part2 by darlene10: 8:52pm On Nov 16, 2013
@ girlfio we were refused on r/ship requirement and financial requirement
For rship
I wrote in my application form dat we communicate through skype, watsapp and phone. But provided dem wt just 2months of watsapp chat den I thought dey just needed to see evidence of contact and not evtin, didn't give dem evidence of fone calls or skype calls
For appeal
I submitted wats app chat from 2011 till date
Skype calls from 2010 till date(though not too frequent)
Our calls was mostly done wt call cards wc didn't show my nos except the ones he did from feb 2013 when he started using lycamobile.we also gave dem a sample of the cards he used and explained to dem dat he cudnt call from his fone directly because it was too expensive and had to stop using d call cards wen he got a nice offer from lycamobile for der unlimited calls. Wc explained y my no started showin from feb 2013
For financial requirement
In d application I filled 13a instead of 13b part of d form cos he's in salaried employment earning more dan 18600 but his salary varied monthly and also didn't provide complete bank statement for 12months and some bank slips I submitted didn't show salary and some payslips were not on company leta head and wasn't up to 12months.I was actually working wt 13a were I need to provide 6months bank statement and payslip wt p60 but just decided to submit evtin he gave me both for my application and his sister visiting visa dats why some of the payslips n statement wasn't complete but d eco mentioned dat he met d financial requirement in category 13bActually I wasn't well informed
For appeal
12months payssllip(company leta head)
12 months bank statement all stamped showing salary
P60
A letter from employer confirming employment, salary, lenght of employment, period he's been paid d salary, type of employment
Anoda letter from employer confirming payslips are authentic

@girlfio still cant believe dis email.I know I really put in my best for dis appeal but I can't question God.I think d next step is to wait and see why they refused to overturn der decision
May be re apply don't think I can stand anoda 5-6months.its really frustrating

Thank you for your email.

I can confirm that the ECM who reviewed your appeal, has decided that the decision made by the ECO was correct. All further information submitted was considered. The Appeal was forwarded to the Courts & Tribunals Service as of yesterday (13/11/13) where it will be heard and considered by an Immigration Judge. You will be notified of the results of the hearing by the Courts & Tribunal Service, not our office.

girlfio:

Ok. First you need to confirm that the £140 appeal payment has been made. Once you have evidence of that call the Leicester office (Tribunal office) on (0044) 0300 123 1711. If they do not recognise your appeal reference they should be able to do a search on the applicants name/date of birth. Let them know that you have evidence of payment and want to confirm that your bundle has been forwarded to Sheffield. The Sheffield office do not have an advertised telephone number so I'm not sure which office you've been contacting. You should get an automatic reply confirming delivery of your email, the address is visasheffield@homeoffice.gsi.gov.uk. As long as you can prove at this stage that payment has been made they should then be able to track the whereabouts of your appeal.

@girfio d. Payment was made.hubby called tribunal office dey confirmed dat dey sent d appeal bundle on the 14th of august. I have a copy of the notice of pending appeal too.my problem is I can't reach dem tru email.wen I send dem email.I don't get dat auto reply.wat cud be d reason and dis just started dis week pls help.tanx

When you emailed Sheffield did u include your appeal reference? If so, I would advise that you reply with a copy of the notification that you received noting the 19 week deadline. Ask them to confirm that your appeal bundle has been received and will therefore be scheduled for ECM review.

girlfio: Got some great news today people, they've sent us the email notifying that my husbands refusal has been overturned!! smiley We've just got to arrange for his passport to be sent to Sheffield now for the visa. I'm so lost for words, this has been such a difficult process and even though there reasons for our refusal were flimsy, its still so easy to doubt that you'll get a positive result. We were refused because my bank statements were printed from my online account so I had to get them stamped by the bank. My payslips were not on headed paper so I also had to supply them with a letter on headed paper determining the validity of my payslips. Then finally I didn't supply them with enough information proving that the address where we were going to live was suitable. I just give thanks to God that He has fought this fight on our behalf. My greatest encouragement to everyone is that you find your faith in God, He will guide your footsteps and lead you to that place of victory. Thanks to everyone for your support, love you guys like family. smiley

Its so painful when they do this cause they should be able to get all this information from the NI number we supply in the original application! smiley

You can submit originals or copies of the payslips but just make sure if they are not printed on company headed paper that you accompany the payslips with a letter from your company stating that the payslips are authentic. Even if they are on headed paper still submit a letter from your HR dept stating your gross yearly income and how long you've worked there, If you have a P60, include that as well.

Tanx I appreciate

So sorry to hear about your refusal, this whole system is just so frustrating.

Now, I would have thought that it would be a lot quicker for the UK sponsor to submit the appeal in the UK since that's where all the documents are going to go anyway. I'm sure someone will speak up if I'm wrong about that.

I know its difficult right now to think about what you have to do next but the best place to start is in producing the documents that will satisfy each of the points raised by the ECO. Source the original marriage certificate. Provide the 6 month payslips [again!] but this time if you can arrange for them to be signed by a senior manager at the place of work and accompanied by a letter on headed paper from your HR department stating that they are authentic. I had to do the same for mine because my payslips were refused cause they didn't have the name of where I work on them [ridiculous!]. In terms of proving your relationship, this will be where you want to get as much evidence as you can showing consistent communications. I'm sure you can upload your whatsapp conversations on to your PC, it might even be worth printing these off.

I'm trusting God that He will make the way ahead clear for you.

Pls girlfio mine was refused for same reason not havin d payslips on company letter head.so if am submitting d appeal is it the original or copies dat I put in?

I felt the same way when I handed in the appeal form. Its frustrating cause once you're no longer caught up in getting everything together you then have to put your life back in to the hands of the very same people that refused your application in the first place! smiley The most important thing is to realise that you've now done all you can do, seek God to now step in on your behalf.
