WHERE CAN I GO TO CHECK TO ENSURE THAT THE PROPERTY I AM BUYING HAS NO FUTURE WAHALA (TROUBLE)?

Before purchasing a property, it is essential for you to conduct your due diligence. There are five places where you may need to conduct a search on a property before purchase depending on the title the property has and facts surrounding the sale.

1. LANDS REGISTRY: If the property has a registered title like a Certificate of Occupancy, Governor’s Consent, Registered Conveyance, Registered Court Judgement, Crown Grant or Land Certificate; the place to search is the Lands Registry where you are to obtain the Certified True Copy of the registered title. This is because the Lands Registry keeps record of transactions to land which have been brought to the knowledge of the state through the process of registration.

2. SURVEYOR GENERAL'S OFFICE: If the property does not have a registered title and you desire to know the status of the land, the Surveyor General’s Office is the place to go to where you are to obtain a Land Information Certificate (LIC). The LIC will inform you about the status of the land – free, excised, acquired or committed as well as the zoning of the land – Residential, commercial, industrial or agricultural. This will also assist the buyer to know what title will be processed on the property – Certificate of Occupancy, Ratification or if no title can be gotten on the property.

3. PROBATE REGISTRY: The Probate Section of the Court is the segment saddled with the responsibility of dealing with matters relating to the estate of a deceased person. If the holder of the registered title has gone to the great beyond, there will be the need for a Probate search to determine the authenticity of the Probate Grant or Letters of Administration. If the title holder makes a Will before his death, the Will will be entered into Probate and a Probate Grant will be obtained before an Assent will be made by the Executors of the Will to the named beneficiaries. If the property holder dies without a Will, the survivors will apply for a Letter of Administration to administer the Estate of the deceased. The Administrators of the Estate shall be legally entitled to transfer the property to the would-be buyer.

4. COURT REGISTRY: If there is a suspicion of a legal dispute relating to the property, a search in the Court Registry should be conducted. When there is a legal dispute in relation to a property, such property is said to be Lis Pendens. Lagos State has the Lagos State Judiciary Information System accessible online at https://lagosjudiciary.gov.ng/search.aspx which shows parties that have pending litigation at any of the divisions of the Lagos State High Court (including the land division). A search on the platform can give preliminary information regarding the existence of a legal dispute in relation to the property.

5. SOCIAL SEARCH: If after you have done the other searches above, you still feel the need to probe further, a social search is recommended. Trust your instincts,if it tells you something is wrong with a transaction; check again, something is likely to be wrong somewhere.” One of the most revealing searches to conduct is what I term “Social Search.” This involves going to the property in question and asking neighbors, shop owners and transporters (like Okada men) in the area about the property in question. Facts about the property not revealed in documents are often revealed via Social Search.

A good number of tenants believe that once the landlord has served them a Quit Notice, they are no longer meant to pay rent or give any money to the landlord until they vacate the property. That is not the position of the law. The law in Nigeria is that a tenant must pay for each day he spends on any property.

If a tenant leaves a property without paying rent, the landlord can sue the tenant for what is called "arrears of rent." If the tenant spends a few extra days (or months) after the expiration (or ending) of the tenancy before leaving the property, the landlord can sue the tenant and collect what is called "mesne profits".

The Nigerian Supreme Court through Honorable Justice Niki Tobi JSC in Odutola v. Papersack Nigeria Ltd (2006) 18 NWLR (Pt. 1012) 470 defined mesne profit thus: “The expression “mesne profit” is used to describe the sum due to a landlord from the time his tenant ceases to hold the premises as a tenant to the time such tenant gives up possession. In other words, it means intermediate profits, that is, profits accruing between two points of time, that is, between the date when the tenant ceases to hold the premises as a tenant and the date he gives up possession".

A succinct distinction between arrears of rent and mesne profit was done by the Court in Capital Oil and Gas Industries Limited v Oteri Holdings Limited [2021] 1 NWLR 483, where the court said that Mesne Profits is "the profits of an estate received by a tenant in wrongful possession between two dates. It is the sum due to a landlord from the time his tenant ceases to hold the premises as a tenant to the time such tenant gives up possession. While rent is payable by a tenant for the use of occupancy of a property, mesne profits are payable by one whose tenancy has come to an end and he holds over. "

In simple words, if the tenant owes rent and leaves the property without paying, the landlord can claim arrears of rent. If the tenant stays for a period of time after the tenancy has ended, the landlord can claim mesne profits. There is no law permitting tenants to stay in a property without paying rent.

There are many reasons while some landlords forgo the arrears of rent and mesne profits. Some do it "for peace to reign." Also, many tenants move to a location the landlord does not know. Some landlords are more interested in recovering their property than the arrears of rent or mesne profits. Some tenants may have no capacity to pay that no court action will make them the landlord recover anything. These are some of the reasons why many landlords do not institute such action. However, the law exists, and a landlord is free to go after the tenant for arrears of rent or mesne profits.

Lagos State Government has announced that no fewer than 800 buildings will be affected following the proposed 4th Mainland Bridge.

Special Adviser to the Governor on Works and Infrastructure, Engr. Aramide Adeyoye, speaking at a joint news conference on Friday (Dec. 30, 2022), said the proposed Fourth Mainland Bridge is expected to be completed in 54 months, adding that 16 alignments were being considered.

She disclosed that structures to be affected and demolished to pave the way for the project had been pruned down from 2,000 to 800, with adequate compensation to be made.

Adeyoye also disclosed that the project, a Public-Private Partnership (PPP) arrangement, would see the consortium tolling the bridge for 40 years before handing it over to the government.

The special adviser added that work on the bridge would begin in the first quarter of 2023.

Gbenga Omotoso, Commissioner for Information and Strategy, said those whose structures would be demolished would be duly compensated and that affected property owners should have no fear.

The Special Adviser to the Governor on PPP, Ope George, said CCECC-CRCCIG Consortium won the preferred bidder and would undertake the proposed construction of the Fourth Mainland Bridge.

A tenancy is a relationship in which a party (the tenant) is given exclusive possession of a property (the demised premises) by another party (the owner or landlord) for a specific period of time in exchange for a fee (rent) or for free. The rights of a tenant include:

1. RIGHT TO A PAYMENT RECEIPT AND WRITTEN AGREEMENT: The landlord is required by law to give the tenant a written evidence acknowledging the collection of rent from the tenant. Also, the landlord and tenant are to state in clear terms the conditions upon which the tenancy relationship shall exist as well as when and how the relationship will be terminated. A tenant is expected to request and obtain a tenancy agreement as well as read same carefully before the commencement of the tenancy.

2. RIGHT TO PEACEFUL ENJOYMENT AND EXCLUSIVE POSSESSION: This is the hallmark of a tenancy and distinguishes it from other types of possession of property. The landlord must give the tenant the right to use the demised premises to the exclusion of all others including the landlord except for the landlord’s right of entry for periodic checks on the property. There must however be adequate notice before the landlord’s right of entry is exercised. The modalities of the same shall be stipulated in the tenancy agreement.

3. RIGHT TO A HABITABLE PREMISES: The demised premises must be one that is befitting for humans to live in. The landlord is to ensure that the building is structurally sound. Structural defects or external damages are to be promptly repaired. It is unlawful for the landlord to do things that will make the building inhabitable for the tenant like removing the roofing sheets or blocking the septic tank.

4. FREEDOM FROM UNLAWFUL EVICTION FROM THE PROPERTY: A tenant is protected by law from being arbitrarily evicted by the landlord. If the tenancy is to be brought to an end, the landlord is required by law to give the tenant a valid “Notice to Quit”. If the tenant fails to leave the demised premises after the stipulated time in the Notice to Quit, the tenant will be given a “7-days notice of owners intention to recover possession”. After the expiration of this notice and the tenant still fails to deliver up possession, the landlord has the right to take the tenant to court and the court will evict the tenant. The tenant will however be liable to pay for the period of time he stays over in the premises after being told to leave.

5. FREEDOM FROM UNREASONABLE INCREASE IN RENT: The law protects the tenant from unreasonable increase of rent by the landlord. The rent of the demised premises must be at par with that of similar premises in the same locality. However, the law recognises special circumstances where such increases are justified but there must be evidence showing such special circumstances.
