He should have charged him to court instead of breaking into his apartment. A landlord has no right to break into a tenants apartment even if the tenant is owing 8 years.

Besides, the landlord can only sue to a civil court and not a criminal Court as owing is not a crime. Meanwhile the tenant can sue the landlord to a criminal Court, which involves bail money, surety and all. The landlord will pay through his nose if taken to court.


You should be pleading with him or be sleeping in cell by now man, that you have lived with him for 8years doesn't mean a shit.
Sleeping in cell for what offense exactly? Owing someone for service rendered?

You people behave like Fulani business. You want special privileges given to people who engage in rent business, just like Fulani people want special privileges given to cow business ( free land). When customers owe for services or goods supplied, you take them to civil court to recover your money and not resort to self help or violence.

What the landlord did is unlawful. Personal eviction is unknown to law.

But you sef, put yourself in your landlord's shoes. You leave your things in another man's house and disappear for months meanwhile you're owing him.

Is it fair? The man has tried jareh. Go and see him and reason things out with him naturedly and peacefully.

Even if he was given notice that doesn't mean ejection. It is only a judge that has the power to totally eject a tenant. Landlord can give quite notice but lack the power to forcefully ejecting. If a landlord try it in Lagos he would lose a big time. I'm owing my landlord and I'm willing to pay him his 5months rent but money never de hand, that doesn't mean my landlord can throw my stuffs out, I will get mad at him and Sue his ass claiming millions of naira damages

There is no law that can save the situation here bro,even if he had asked you to leave you are only entitle 6 months Quit notice,in this case you are owing him for 8 months,you should have run around and send him like 6 months salary before he acts.

That you're owing rent, do not warrant your home owner to break into your apartment at his free will. For him to do, it was likely a he must have gone to court obtain an order of the court for you to appear before same, which likely because of your absence, gave him the leeway to obtain a court order to break, enter, and vacate your items.
If upon investigation due process of the law was not followed, report to the police and charge him for break and entering. Do not go and start making false accusations of what you don't have as a property or personal effects, like I have $50000, I have a Rolex watch, I have this and I have that.
List all the unrecoverable items that was damaged and quantify their value, and claim it's comfort.
In summary, did he ever sent a text, called to remind you, or wrote a letter reminding you the debt you owed and the need to pay up.? Any of these actions can provoke a court proceedings against you.

The six months start counting from the day you acknowledge receipt of the quit notice and not from the day your rent expires. If the landlord had not giving him quit notice, then the six months has not started running.

Mr Man, anything you are doing to somebody, remember one day it will be your turn, you will be landlord someday. If you have cordial relationship with your landlord he won't go that extent. I don't understand how you can have the nerves to owe rent of 8 months and feel comfortable with it.

They are ways of doing things we call it due process......If the landlord follow the due process by going to the court and the court gave him the go ahead, Then by brother u have no case.... Just look for money and go and pay to reclaim Ur properties..... BUTTT,If he just did that on his own by taking the law into his hands....My brother u don hammer.....Just get any lawyer even a charge and bail lawyer can do the job for u......The landlord will b on his knee begging.....He doesn't have any right to enter Ur apartment even though u lock it for twenty years without involving the court whom will assign a police officer to go with him to broke or open the door of Ur apartment in presence of the police officer.......Two wrongs cannot make a right.....U are holding him rent but he cannot just break into Ur apartment just like that.

Did you keep your landlord updated about your way about? Because he may have waited for your return for too long and may have thought that you're dead. You can't just vanish to nowhere and expect him not to do something about recovery of his property. However, the question is whether he did that the right way. This is assuming it was indeed your landlord that broke into your house. I need to say that because emotions apart, I must be honest to tell you that you have no case unless you can prove in a competent court that it was your landlord that broke into your house.

Having said that, I can testify that some landlords or some people generally are evil. I lived in Cotonou in a house belonging to such evil men. This man went as far as using jazz on me but he didn't realize the type of person that I am. He even invited a jazz woman to the house but I killed the woman the same day he packed into the house. Then he invited credit card thieves and bank hackers to steal money from me. They'll sit around the gate when I want to enter the house and they'll station a card reader machine to intercept my card details from my pocket. There's nothing he didn't do to rob me. In his house!! His name is Latedjou and he had no idea I was studying him for 4 years. I never owed him for one day or even quarrelled with him. On the surface he appears to be a nice person but on the inside he's pure evil.

LEGAL ADVISE:
You should sue him to Court.
But if l were the Judge handling the case, I will send you to PRISON for at least Two Years.

It is Evil Tenants like you that make nice Landlord become brutal.
Imagine if that Flat was the Man's only source of income and you were brazen and comfortable enough to LOCK UP THE PLACE FOR 13MONTHS, without paying a Penny and not even communicating to the Man

Can you owe someone for 13Months, in any of those saner Climes like US, US or anywhere in Europe?
Can you lock up a Flat for 13Months in any of those places?


I can assure you that if you owe maximum of 2Months (for a generous Landlord), it will not take One week for the Tenancy Tribunal to give the Landlord to throw out your things.
Infact, in the "Saner Climes", once your Rent is due by One Week and they dont see Alert, hey would change the Keys to the Door, the next Week while they get Sheriff to come and Pack your Property for "Storage", which you will still pay for, but the Landlord would have replaced you with a Tenant ready to pay his Rent as at when due.

If you have never lived in such "saner Climes" or paid Rent there, please stop commenting on what happens there. undecided grin

Something of such happened in Lagos here 9 years ago, the tenant rented an half plot, I don't really know how much he pays then for the rent, but he wasn't paying very well. He was owing the landlord a year rent.

He built a restaurant and bar on the land.

One day, Landlord got angry and arranged boys to destroy the man's shop. They destroy the walls without going inside not touching anything. The man told me this himself because I was going to rent part of the the land for my viewing center business that I wanted to open at the area then.

He reported the case to the police and got himself a lawyer because he was educated and an Ebo man. He took pictures for evidence and told the Judge that he left 5 million naira in his bar, his lawyer asked him to say that.

They charged the man to court and he explained what led to his actions but the Judge punished him by asking him to pay 8 million for damages or he can forget the land, and it belongs to the tenant until otherwise.

The man begged his tenant but he refused and got stroke. So, his children went to the man to beg and he asked them to go and bring 3 million and he will drop the case. Till today, the tenant has been using the land as he likes and renting it to other tenants like he owns it. The owner is late now so and the children never see 3m.

This happens at Aguda Ogba Lagos.
