I had a super rich maternal uncle. He was a trader and an importer.
Some of his siblings would asked him to sell some of his goods to them.
Sometimes a truck load of cement etc sent to his sibling, the sibling may decided not to give him any money back. Not even a kobo.
When he asked why? The answer would be begging and begging, but you are very rich.
Their mother would come in and interceded and begged him to forget the money.

Very soon the sibling would be begging for another truck of goods and promised to pay this time around.
Not sure it would be paid or not.
But he was very very rich person, and very nice mallam.

Please mention just 2 people you known that have been sentenced to prison terms for issuing dud cheques in Nigeria! grin
People are sentenced daily but we dont hear about it. Anyway most try to settle before it gets to case. Usually at police or efcc. Most, when you threaten them will wish to settle sharp sharp. One of my paddies, ordered medical equipment from mushin, on the day of payment omo igbo called him that his check bounced. If you see the panic this guy went through looking for money to put in that account. Another of my friends, police arrested him to the then IG intelligence unit, gra. Infact his creditors said they did not want the money, rather they wanted him charged to court, that he must go to jail. When his family saw this guy would likely smell jail, they looked for the money with begging for the case to end.
The fear that one could loose his freedom for just eg 1 month,, imagine if there is no option of fine. Wount you pay?

I'll simply ask him, "what part of my lifestyle made you feel I have 20k?"

Na for Sharp intelligent borrower to simply just add promissory note to pay back in 4months time along with postdated cheque carrying 4months time date from date of cheque issuance . or even 5months time date or 6 grin. Postdated cheque in the mud.
Truth of the matter is that people will always try to find a loophole. But don't for get the person trying to borrow money from you will not be thinking of all this. He ask you, as you are giving him, you demand for cheque. Anyway, nothing is 100% guaranteed, it is just an additional protection.

I reminded him in 2021 when I was sick and in need of money to buy drugs but this is what I get back for being kind.

He didn't pay and blocked me last year.

The other person I lend paid half of the money and the other half is history πŸ˜‚πŸ˜‚πŸ˜‚πŸ˜‚.

I also learned to add the following

nedekid:
β–  Ahhh, they do. That is why those days you want to take loans from microfinance banks, regular banks too, you want to finance eg a car, they will ask for post dated cheques for all the monthly payments even if it is for 4 years. Me cannot loan someone money without collecting a cheque. Unless it is money I can afford to loose. If you have the time, read the law below and the cbn response at the bottom.
β–  The issuance of a dud cheque is a criminal offence pursuant to Section 1 of the Dishonored Cheques (Offences) Act CAP D11 LFN 2004 and punishable under Section 1 (1) (b) (i) of the same Act.
The crux and relevant provisions of the Act are as follows:
(1) Any person who –
(a) obtains or induces the delivery of anything capable of being stolen either to himself or to any other person; or (b) obtains credit for himself or any other person, by means of a cheque that, when presented for payment not later than three months after the date of the cheque, is dishonored on the ground that no funds or insufficient funds were standing to the credit of the drawer of the cheque in the bank on which the cheque was drawn, shall be guilty of an offence and on conviction shall- (i) in the case of an individual be sentenced to imprisonment for two years, without the option of a fine; and (ii) in the case of a body corporate, be sentenced to a fine of not less than N5,000.

Measures taken by CBN
Prosecution of the offenders directly; Handing the offenders over to the Economic and Financial Crimes Commission (EFCC) and other security agencies for prosecution; Banning the offender from accessing credit facility for a period of 5 years; Cancellation of all unused Cheque books issued to serial issuers of dud cheques upon the compilation and dissemination of information by CBN; Sanctioning any bank that fails to report serial issuer of dud cheques.
Request postdated check for each payment to be made by the one borrowing from you as additional insurance against nonpayment. undecided

Story of my life. However, I make exceptions. There is one who I lent 5k in 2019 and he promised to pay. When it was time for repayment, he claimed he was robbed on his way to Shiloh.

in my heart I was like "Story don enter. Toh, no wahala" and mentally wrote off the debt. Fast-forward to April 2023, young nigga is now a ultra Peter Obi supporter and when I voiced out my unwavering admiration for Wole Soyinka despite his declaration that the 'Obidient movement' was toxic, he started throwing shades and insults at me on his FB page.

Since we want to be mad, let us all be mad together and scatter everything.

I went to our WhatsApp conversation, took a screenshot of his loan request from four years ago and sent to him with the message "pay up nigga. You cannot be insulting me online and still be owing gbese on top." I also dropped my account details.

Thank God the odofion has small shame because he transferred it to me in a flash. We now proceeded to block each other left, right and center. Na so friendship of almost 9 years end.

Hello there sis, people like you have good hearts and other fellas take advantage of it.
What these people do is,they run up to borrow money from you and when it's time for them to pay back, they stay off you and you will be the one running to them!

It gets worse when they show you that you are irritating them for asking for your own money!

I have made up my mind never to lend or borrow any money to anybody cos you borrow them the dough or not, they will still annoy you,so it's better I don't borrow and let them say and do whatever they want.

Please be very careful and watch your steps, people are bad.

This is one of many things I hate to see and I wish I have super power to deal with ungrateful elements like these ones. Just like one idiot I gave money 65k since sept 27 last year to do my car documents only for this idiot up till this moment can't bring documents and can't pay up , he has been begging for more time to refund . Had to involve his mother she too joined in begging . I wanted to go street with but my mum begged for him . Okay now he has relocated somewhere cos he said his wife is misbehaving blah blah blah ...wo just give me my money. I have it in mind that anywhere I manage to see him hmmm wish I can do more but I have been told via dream to avoid anything fight or dragging not to regret . I understood the dream msg from my sis cos the said guy can't stand me if e sup . Bottom line many people are ungrateful and funny part of it again is that it's you that will be calling messaging for your own money. For such people in my mind has closed their own chapter when it comes to doing them favour in future even if they are at the point of death I won't. I so hate ungrateful people ehn

Legal action for bros lend me 30k first is not legally binding, cos there was no official Documents signed by both parties

β—Ύ 2ndly, For the fact that its not official loan, N.O named C.O.L.L.A.T.E.R.A.L /seizable assets was tendered or signed out for Repossesorship, in case of repayment defaultment. Certificates, land deed, house documents, Car papers, business assets, etc
On the strength of N2, its a dead end case and waste of time . Cos las las after lawyers don drag adjourn the case as much as possible,
Its left for borrower to say l nor get. Na 100 naira l fit dey pay back monthly. Thereby scattering legal repayment into several years.

Aftrall, no official business was transacted between you two, neither was any documents signed for loan given out.
Unless huge sums are involved, Sound legal advise would advise one to forget a 30k informal loan case, without official agreement documents signed by both parties.

You think all contracts must be formal to be binding abi πŸ˜€, dey play 😏😏

What were his reasons or rather excuses for not paying back? Do you guys even talk now? These stories make me grateful for the quality of people I know who repay personal loans they take. Sorry o.

-Lol at "Sorry o." It's not your fault na. cheesy

-Anyway, the person in question and myself haven't spoken in years. I have since deleted his contacts. When the issue was fresh, I told family members I would go for the money when he least expects, but over the years I seem to have mellowed down a tad with some intervention from one of my wives.

-He never gave any reason for not paying, only keep promising he will pay the loan back.

-Nevertheless, lessons learnt. Never to be that stupid ever again.

This is the reason why I can never ever blame Lapo and all these online apps when they go brutal.

Nigerians are not used to paying back loans or whatever and it's an entitlement mentality, an habit that has being ingrained from little.

It doesn't even start from lending money it starts from little things like

1. Expecting someone else to pay for your meal or tfare simply because you feel the person should have more money, no prior discussion about it nothing. They will now try to black mail you emotionally especially office people grin,
I will never expect my collegue to pay for my meal if we go on break together, I hold my money, you sef don't expect me to pay for yours coz you don't know how buoyant I am at the time. If I want to sponsor your meal na me go tell you.

2. Years back I needed 20naira change someone lent me and later in the day I returned it back, the person was like ahan why would you return 20naira and I said because I asked you to borrow me the change.

We think because an amount is small if borrowed it shouldn't be returned and then it graduates to big cash. People that don't think of returning 500naira will never be faithful with 50k that's the way I see it.

3. We believe that if someone is rich money lent from the person should not be returned after all ' he is rich'. Major reason why rich people do tend to separate from others for a while.

Point is Nigerians are bad debtors, friends oo family ooo, collegues ooo same nooni.

Thats how a collegue told me to help him collect Gtb loan with my own salary account grin and he will be paying me back, you nkor you no fit collect sebi Na the same Gtb all of us use as salary account, he said he is paying one. I say I no fit, no be fight.

But there are those who keep to their word, those ones will always refund no matter what and I can go all out for these people, because I know they will pay

Shout out to LAPO the kings of loan recovery in Naija, na dem fit our people.

1. You can equally help and support people while taking less risks yourself. There is nothing less helpful or less supporting, for example, about insisting the borrower signs a promissory note in addition to submitting post dated check as insurance. As a matter of fact, by ensuring risk on your end is reduced, you help keep the borrower responsible and discipline in his use and repayment of borrowed funds. undecided

When the lender is so relaxed about the risks of non payment, what incentive or reason exists for the borrower to put in the effort necessary to ensure payment of the loan? Na we dey feed all these bad culture by our own refusal to do better abeg! undecided
