No winning president have ever failed to get 25% in Abuja since 1999. It would take serious disapproval for any candidate to lose ordinary 25% in Abuja. A metropolitan federal capital like Abuja. And such candidate does not deserve to be president. 1 Like |

299. The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation; and accordingly -
(a) all the legislative powers, the executive powers and the judicial powers vested in the House of Assembly, the Governor of a State and in the courts of a State shall, respectively, vest in the National Assembly, the President of the Federation and in the courts which by virtue of the foregoing provisions are courts established for the Federal Capital Territory, Abuja;
(b) all the powers referred to in paragraph (a) of this section shall be exercised in accordance with the provisions of this Constitution; and
(c) the provisions of this Constitution pertaining to the matters aforesaid shall be read with such modifications and adaptations as may be reasonably necessary to bring them into conformity with the provisions of this section. Read this in this context. If the President would administer all these powers on FCT, shouldn't that same President at least have the buying in of at least 25% of the Vote Cast? Otherwise, will he not be better for Abuja to choose his own governor and make him accountable as other state? The drafters of the Constitution know exactly what they are avoiding when they made that law. Otherwise you have a situation of Shagari and Jakande of 1979.... |

It wasnt an error. Check anywhere in the constitution. It is exactly that way. .. 'And' is used between states and FCT.
Even in section 299 i think. The constitution declares FCT as a state.
FCT is not a state! There is no state legislature or judiciary in FCT as we have it in other states. The FCT Minister is an appointment-based (not elective-based) position, meaning FCT residents do not vote their governors/ministers. To force a governor/minister on Abuja people, ensure you secure 25% of their votes. It is not compulsory for a president to secure 25% in Lagos because Lagos people will choose who would govern them in their state. This is not the situation in Abuja. What we have is "36 states" and "the FCT", not "37 states including the FCT." This is a VERY clear matter. However, the position of the judges would be based on how best they interpret the word "AND." As far as the FCT's state status is concerned, Abuja is NOT and will never be a state until residents begin to produce their governors through the ballot. Tinubu's victory will CERTAINLY be withdrawn unless the judges allowed themselves to be bribed. 1 Like |
