Tareq1105: Logically, did you first ask yourself why the clause is in the constitution? Is it just there for the fun of it? Now to further teach you logical reasoning, 25% is not equal to winning Abuja but just a benchmark which any lawful candidate should have. In as much as the FCT does not have a governor, house of assembly and the likes, it is expected that its people must have some form of representation in the person presiding over it. The framers of the constitution did not insert the clause for it to be discarded at any point in time. It is written in plain english so that educated people can understand it clearly. |

GoodofNaija: Still a flawed argument. Look...I no want tinubu to win.. Okay...the FCT is a territory..meaning it isn't a state for the purposes of the constitution. So, in order to prevent FCT votes from not counting, that is why the 'and' clause was brought in. (A similar example, is Washington DC. Washington DC in the US is a special territory. It has a mayor, and it has a Senator, but no governor. So for legal purposes it is designated as having the similar status as a normal US state. Though right now, some are pushing for Washington to become a State, but that's another story.) If they had ruled in favour of your definition, it would have in essence made FCT votes superior to everyone else, and would have led to a sutuation where someone can win all the states, get 5% IN THE FCT, and then be told he is not President. (And don't bring in the story about FCT being 'representative'. By that argument, Lagos could be 'representative'). So, under the constutution, FCT is a special territory, not a state, so the and clause was introduced not to allow FCT votes to not count....because if the law read Majority of votes in the states, someone can come and argue that FCT is not a state, therefore FCT votes do not count. The other issues were fightable. FCT was not. The last time the court ruled on the matter, it stated that the law treated FCT as a state for purposes of election, not that you MUST win in FCT to win the election. |
