The court has risen briefly to allow counsel to respondents reproduce their ‘missing’ counter affidavits and motions today. The Court was wise in only rising briefly to enable parties produce their processes rather than adjourning the matter to another day, as it had earlier granted a motion for accelerated hearing. At this time, we wait not for days, but just hours. The court will resume at 1:30pm Nigerian time and is determined to conclude this matter today. As the Court pleases. 4 Likes |

Honourable Justice Dagogo-Jack has COURT NULLIFIES AMENDMENT OF SECTION 3 OF RSHA SERVICE COMMISSION A State High Court, sitting in Port Harcourt and presided over by Justice Mrs Kariba Dagogo Jack, on Tuesday, nullified the amendment of Section 3 of the Rivers State House of Assembly Service Commission Law by the Martin Amaewhule-led Assembly, which sought to strip the Governor of the constitutional power to appoint the Chairman and Members of the Rivers State House of Assembly Service Commission. Delivering judgement on the matter which was brought before the court for consideration in a suit by an NGO, Association of Legal Legislative Drafting and Advocacy Practitioners, the presiding Judge said the amendment law no 3, 2024, was inconsistent with the provisions of the Constitution, and as such null and void. She said the Constitution unambiguously state that the Governor should constitute the board of the house of assembly service commission, and some other commissions, boards and Institutes, but based on the confirmation of the Assembly. She declared that the amendment which shifted the power to constitute the House of Assembly Service Commission to the Speaker, contravene the doctrine of separation of powers which guarantees the right of the various arms of government to operate independently of each other. The presiding Judge further stated that the Rivers State House of Assembly is not authorized by law to exercise executive powers which includes the constitution of the Rivers State House of Assembly Commission, which is among bodies described in part two of the third schedule of the Constitution whose membership are to be constituted by the Governor. Speaking with Journalists shortly after the judgement, lead counsel for the NGO, Association of Legal Legislative Drafting and Advocacy Practitioners, Barr. Boma Owunabo, the suit was instituted in public interest to challenge the usurpation of executive powers by the Amaewhule-led Rivers State Assembly through the amendment. Barr. Owunabo said the NGO was dedicated to ensuring that every legislation in the country is in tandem with the provisions of the Constitution. He commended the presiding Judge for her forthrightness, due assessment and evaluation of evidence before delivering the judgement, stating that the judgement was a victory for good governance and the rule of law 3 Likes |

Eteka1:You people will not kill person with laugh. Just because Ameachi told the governor that his popularity is because of the attack on Wike. He is an enemy to you people. This are the reason some of us keep saying that you people play emotional politics to much. Politician are really not enemy but fight for there interest and settle later. Ameachi and Wike are brothers from same tribe, so know that. I won't be surprise if you people start abusing Ameachi in the coming days. Hypocrisy is so high among you people. Fubara will lose the fight but may not be impeached. Up till now, I still don't like Wike but I don't care how the power tussle end because some of you supported Wike then, when he keep attacking Buhari and using Odili and wife to get favourable judgement and that led to Justice Odili denied CJN position which she merited. I have not seen the type of people in my life, like you and others who keep supporting wrong doings, just because he suit you and start crying when it becomes opposite. |

phantom:Please don't be deceived, the news going round is from a State High Court, not the Appeal Court. There's nowhere in the constitution that a State High Court judgment supercedes an Appeal Court. The Appeal Court is still in session. No judgment has been given yet. |

phantom:Rivers State House of Assembly Service Commission is not the same thing as LGA administration. The Constitution empowers State Houses of Assembly to make laws governing LGAs. |
