The supreme court had ruled on that issue. The state of emergency declared by OBJ by removing elected governors, the supreme court said it was wrong.
Some people if they made mention of state of emergency, their mind always goes to removal of state governor or elected office holders. Just as you said, Mr. President can't try that.

Do you think we are still in the era of OBJ where elected authorities were removed? The only conditions that can remove an elected governors are impeachment, resignation and death. Any other way is anti-constitution.
