The most important thing in the law is the spirit of the law and not the letters of the law. That's why the Supreme court explicitly stated that the state governors has abused the privilege accorded to them.
The supreme court ruling has effectively established an autonomous third tiers of government and this is very important for the development of the country and Nigerian democracy.
The fear of political meddling in local government affair by the Federal government is secondary and should not becloud our resolve to give more opportunities for development to local level.
Imagine some towns and local government being at the mercy of their Governor. Some Governors will seize the allocation of local government and use it to develop another place. The Supreme court ruling is valid
The spirit of the law is only important when there is ambiguity and/or ambivalence in the letter of the law but this is not the case.

The constitution is clear and any interpretation that contradicts the clear letter of the law is an usurpation of power from the legislature by the supreme court.

The judiciary should interpret the law and not make laws. If we are dissatisfied with the current laws, then the constitution and/or laws should be amended by the legislature.

In the presidential system of government, there are 3 arms of government with distinct non-overlapping roles, but in the Nigerian version, there is only one arm with two fingers undecided

Kudos to the Supreme Court for this landmark judgement. Only rogue governors and former governors will be against the judgement. Local Government should not to tied to the apron spring of the governors. We've seen how rogue governors like Peter Obi ruled for 8 years without conducting local government election. They collect every single kobo belonging to the LGAs and then set up a useless transition committee that are un-elected and then give them peanut to operate. Any one that is against this judgement is an enemy of Nigeria.

Kudos to the AGF and Mr. President for this.

...even those that conducted LG elections were just mocking democracy. The party of the sitting governor wins ALL available positions

Whenever Tinubu and his government do something good I applaud them. This is a commendable job by Tinubu's government, I applaud him.


Please they should mandate INEC to fix a date to conduct LGA elections in all the 36 states to elect LGA Chairmen and Counselors asap.

Do we have to wait till when the constitution is amended before we do the right thing. The constitution did not expect the governors to be pilfering with the allocation of the local government, are we now to be looking at the evil deeds of the governors without making a correction.

In the coming days, we will begin to fully understand the implications of the Supreme Court decision. An assault on the constitution is not the answer to fiddling with the Joint LG Acount. If the ruling is saying Governors cannot temper, touch, fiddle with the Joint Accounts, that’s fine because they shouldn’t be doing that in the first place. But asking the Federal Government to pay Local Governments allocations to the account of the Local Government directly is utter madness:

They're not meant to be figure heads. LG is supposed to be self-governed, independent from the state.
Next step is to have INEC conduct their elections and mandate their terms in office to be 4 years.
LGs are not indepedent from the states. The constitution puts them under the administration of the states. Go and read section 7 very well.
That does not mean you can't hold them accountable BUT they are under the administration of the state.

It is not up to the Supreme Court to form a third tier of government, that obligation is up to the people to decide through a referendum.

You don't get it, almost all the states in Nigeria don't elect LG chairmen, they appoint and oversee everything, now if they refuse to elect, the percentage that should go to LG will remain with federal and because federal owns the account federal will control who gets elected.

It's not that the Governors in Nigeria are not aware that they are illegally doing the Wrong things,with the Local Govt Funds being highjacked but like so many Other -Illegalities, Unfair and Injustice,they think,it's going to continue for ever.
•The Supreme Court - should take a defiance Position on any Governor in Nigeria that violated this Law, should be removed from Office.
That is the ONLY measure to set a blunt messages to the Governors.
•The Local Governments too, should be Transparent and Accountable to the Grassroots at all times- by rendering the Accounts of Money and Resources at their disposal,promptly and reduce tensions between it and the State governments.

This is actually the part that gets me laughing. Folks like you make it sound like LG chairmen have been itching to develop their areas and it is the govs that has been inhibiting them. What grand delusions!

Most of the LG chairs are former and active political thugs of their godfathers. The few who are not are simply appendages and bootlickers.
Secondly, how many LG chair are actually resident in their LGs as we speak?

Lastly, Tinubu is an hypocrite. When he was gov, he wouldn't let anyone touch his LG funds. He sanctimoniously preached true federalism and devolution of powers. He comes in and he starts taking steps to decimate and whittle down govs and states simply because he wants to control everything even to the smallest. This singular act has repudiated all the talk of federalism from him over the years. Shame on Ariwoola who allowed his court to be used to carry out a coup on the constitution.
You must have missed your history class, Tinubu gave local government full autonomy both financially and otherwise during his tenure. Your hatred for Mr. President has beclouded your sense of critical reasoning.

Now just imagine if LG were to act as just conduit pipe to steal is 774 not beta stealing than just 34 and that is the worse case scenario, so whether Tinubu is doing this for ulterior motive or not this is the right way to go for Nigerians.

Two wrongs do not make a right. The SC clearly committed an abomination by summarily taking over the responsibility of the legislature
The fact still remains that the LGs by our law are supposed to be funded from the state account and not directly from the federal account. The full ramifications of this misnomer will be seen soon. It is now too obvious that our judiciary is dancing to some peculiar tunes. This has never happened in the history of our country that the judiciary will be amending the constitution

The fact that a convicted thief is closer to Tifnubu is even more apauling, you cannot separate Ibori from anything politics and him being a convicted crook, he was jailed because of his looted funds in politics.

You are one of the few smart persons here. The Judiciary has been bought off for peanuts by the Tinubu admin, the plan is to put a financial stranglehold on the state governors starting with Rivers state, but this will fail.
The constitution on this matter is as clear as day light. This also goes further to show that most of the rulings by the apex court were already decided behind closed doors.
