Doe that mean the NVC timeline is kind of "selective"? That is, it doesn't apply to all categories of applicants in some instances like this?

Because, the current timeline shows they are creating files for Petitions received from USCIS on 11.07.2024.

It seems this timeline does not work for applicants whose country quota has been exhausted. Am I correct?

A friend of mine also belong to this category. He was approved on 3rd June 2024 or so. I was thinking he should have received his welcome letter (from NVC) by now.

I was thinking this would only affect the non-immigrant visa category. If possible can you explain how this will benefit people waiting for invitations?

Good evening I am about starting this process however I know a family still waiting the invitation for visa for more than 1year now and this has me asking questions.
Is it best to apply for a b1/b2 visa first before applying for the eb1/eb2?
Can a person with a USA visiting visa apply for the eb1/eb2 in the USA during the visit?
If a person applies and is approved while in Nigeria, can the person go to the USA with the visiting visa and adjust status there?

Kindly help answer the above I still have more questions but let’s start from here

According to various sources, a bachelor's degree alone does not qualify for an EB-2 National Interest Waiver (NIW). To qualify, applicants with a bachelor's degree must have at least five years of relevant work experience after graduating or demonstrate exceptional ability. Exceptional ability means having a level of expertise that is significantly higher than what is typically found in the arts, sciences, or business.

Apply for your visit visa before u start because u MAY not get any visa to US again once you submit a petition. Now to your question, b1/b2 won’t work for adjustment of status since you won’t be given more than 6 months at entry but the adjustment process is currently more than a year, you risk running out of status which will jeopardize the process. Your best bet will be f1/f2 visa or wait gently for the embassy.

Thanks for sharing this. Are these E2 2023 DQ (Jan - Dec 2023) or 2022 DQ spill over?

Never mind, these ones aren’t embassy statistics. For the same month, only one E2 visa was issued in Lagos.

Since April 1, the $300 has become part of the EB2 NIW fees. Apparently, petitioners that are not employers are also considered to be under those who employ 0-25.

So you have to select NO to question 5 (the non profit question) and YES to question 6 (the question about being an employer that employs 0-25)

Until you do this, and add the $300 as a seperate fee, they'll keep returning the petition.

As wild as it sounds, it's what it is.

D. AVAILABILITY OF EMPLOYMENT-BASED VISAS DURING SEPTEMBER

There has been a steady increase in both USCIS and Department of State demand patterns for employment-based visas during the fiscal year. As a result, most employment-based preference category limits for FY 2024 are expected to be reached during September, if not sooner. If at any time an annual limit were reached, it would be necessary to immediately make the preference category “unavailable”, and no further requests for numbers would be honored.


E. RETROTRESSION IN THE EMPLOYMENT-BASED THIRD PREFERENCE (EB-3) AND “OTHER WORKERS” (EW) CATEGORIES

As readers were informed was possible in Item D of the July 2024 and August 2024 Visa Bulletin, it has become necessary to retrogress the EB-3 final action dates for Rest of World, Mexico, and the Philippines, as well as the EW final action dates for Rest of World and Mexico. The issuance totals in these categories are rapidly approaching the annual limit for FY-2024, necessitating this slowdown of issuance rates. It is anticipated that the final action dates will advance in October 2024; however, date movement will depend on worldwide demand for EB-3 and EW visas and the estimated FY-2025 category limit.

Hopefully the next IL will capture you.

What I don't really want to see is retrogression. Luckily we escaped that this FY (EB-2). We can only hope for a better 2025 FYI.

Which DQ and/or priority date received IL the last time? Does anyone know?

EB2 NIW DQ March 2023. There may be people whose DQ are earlier than March 2023.

@Unusoj1 T= time. In this context, refers to days.
I hope you take the expectation with Mudu of salt. Just going off trends seen across the board. Montreal (partner in slow Il like lagos grin) in the last week or so have seen IL sent for January through April / May DQ 2023. Will not be surprised to see Lagos IR/CR get IL resume again within 2 weeks after 3- 5 months haitus as student visa process for fall and summer tourist surge start to wind down.

Eb2 should be next in line for IL or next month. The question will be how many months of 2023 DQ will IL cover January through May (highly probable) vs June (possible if the number of candidates are not much) or the whole of 2023 DQ ( low probability but seeing how Eb3 keeps getting retrogressed, you never can tell ) ?? Fingers crossed. grin
