VERY IMPORTANT TO ALL In assessing an application for temporary residence an officer may also consider factors such as: the length of time that the client will be spending in Canada; the means of support; obligations and ties in the home country; and compliance with requirements of the IRPA and Regulations applicable to temporary residents (visitors, students and workers). If an officer has concerns/doubts about the applicant’s bona fide, the applicant must be made aware of these concerns and given an opportunity to respond to them. If an application for temporary residence is not approved, the CIC visa officer will provide the client with a letter explaining why an application has been refused. Temporary residence status might be refused for several reasons, including: history of having contravened the conditions of admission on a previous stay in Canada; lack of or insufficient proof of adequate funds to support oneself while in Canada, and to affect one’s departure from Canada; medical inadmissibility; not satisfying the visa officer that the individual will leave Canada at the end of their period of authorized stay. Refusals Refusals do not stem from having two intents. They stem from having a single bona fide intent (i.e., to become a permanent resident) and misrepresenting the second intent (i.e., to become a temporary resident) in order to achieve the first intent. For example: an applicant for a work or study permit who indicates that they have no intention of leaving Canada has demonstrated only a single intent – permanent residence. This application would be refused, even if the applicant might qualify for the Canadian Experience Class (CEC) or the Provincial Nominee Program (PNP). This is because the applicant has shown that they do not respect the terms and conditions of temporary residence, should they not qualify for a Permanent Resident stream. Assessing an application where there are dual intent implications is no different from assessing any other temporary resident application. Each applicant receives the benefit of a procedurally fair, individual assessment. The applicant must, in turn, satisfy the officer that they meet all the requirements of IRPA’s Regulations relating to temporary residence, before any visa is issued. The existence of the CEC or the issuance of a Provincial Nominee Certificate does not change this. The possibility that an applicant for temporary residence may, at some point in the future, be approved under a Permanent Resident Program does not absolve the individual from meeting the requirements of a temporary resident, specifically, to leave Canada at the end of the period authorized for their stay, R179. The inherent rigidity of R179 is balanced by the flexibility of A22(2), which allows the visa officer to consider an applicant’s intent in relation to the particular circumstances of the case. For example: an applicant for a study permit who may qualify for the CEC in three years has a different set of circumstances from that of a PN whose application is near completion and who applies for a work permit, with the support of the province, due to an urgent need for his or her services. Officers are reminded to use their own judgment and the flexibility afforded to them by A22(2) when making decisions in cases with a dual intent aspect. CAIPS/FOSS/GCMS notes should clearly demonstrate the officer’s reasoning when assessing a case. 4 Likes |

Hello I am preparing my documents for Canadian student visa via paper route. I intend to attach the following document. Please if their is any document to attach or remove to the list below ? How do I arrange it before submission at the Vfs office? My home ties 1. my uncle who is my sponsor has stated it in his sponsorship letter that l would be coming back to work for his company after my program 2. Salut! I started reading this thread vigorously, albeit silently after my application on June 3rd, 2017. Though, I read www.cic.gc.ca deeply before applying, I figure this forum is great for extra help. I must say that certain approval profile descriptions here gave me some hope during the wait and my hope is that my profile can do the same to some other person(s). Here goes,... Applied online: June 3rd Biometrics call: June 5th Approval message/Passport request: August 2nd Passport submitted: August 3rd Passport collection: Awaiting..... Documents submitted and arrangement format: -Study Permit Application (filled as accurately as possible and multiply-checked) -CAQ (for Quebec applicants) -Under Passport (Passport data page + Police Clearance certificate) -Under Letter of Acceptance (Offer of Admission Letter, C$250 acceptance fee, NYSC discharge certificate [2017], BSc Certificate [2016], Undergraduate Transcript, WAEC Certificate) -Under Proof of financial support (sponsors' six months bank statement, sponsors' proof of business, sponsors' proof of asset, accommodation support letter from relative residing in the area) Sponsor: Parent -Under Proof of medical exam (e-Medical printout obtained at Children's & Consultant Practice where I did my upfront medicals) -Under Digital Photo (Digital photo size as specified on “cic” website) -Family Information form (filled as accurately as possible and multiply-checked) -Under Proof of relationship (Dad's passport data page & my birth certificate) -Schedule 1 - Application for a Temporary Resident Visa Made Outside of Canada -Under Letter of Explanation (Study plan- With six short paragraphs, I answered relevant questions [purpose of visit, current activity, intentions after study etc.] - about 1 page) Course progression (BSc. DatechMan: Now is the best time to start supervisor search for fall 2018 because some may not reply soon, some not at all, and others may want to work out your proposal with you. Remember to send good and personalized email. Check this thread and others for numerous email format. Also, Keep an open mind I.e. Except the supervisor says specify your proposed research aka "add research proposal", don't, if you don't have a resounding research. My only worry is that those I thought are enjoying it in Nigeria and would sing the patriotic song are advising me to make use of my opportunity and NOT COME BACK TO NIGERIA. How will you feel if your bosses and respected family members who have spent over 15years in Your profession or over 50-60years in Nigeria tell you that "the only thing holding me down in this nation is my family (Wife and Kids). There is nothing here. Even laborers in Canada comfortably buy houses and cars in Nigeria while we here struggle to feed ourselves. Thank God you are single.
