Good day all, kindly come to my rescue.

My CO contacted me today, she advised me to withdraw my dependent (Niece) visa application, otherwise her visa may be refused.

I submitted form 1229 and declaration of guardianship by the parents for her.

Can't my neice be a migrating dependent?

Is refund of Visa application guaranteed if I withdraw her application?

Kindly guide me on the best way out. Thank you.

You cannot add your niece as a dependent. Dependents are close family members like wife, children, adopted children and step children. See this excerpt below from the DHA webpage:


Including family members in your application
This information is for people who can include a family member in their application for a visa, other than a refugee, humanitarian or protection visa.

Not all visas are the same. Read the requirements for the visa you are applying for to confirm who can be included in your application.

A member of your family unit can be your:

partner – married or de facto (same or opposite sex)
or

If your child is born after you lodge your application (but before it is decided), the child will automatically be included in your application(s). It does not matter if the child is born in or outside Australia. You will need to tell us about the birth as soon as possible.

Partner

your partner is at least 18 years of age when the application is lodged (there are some exceptions)
you are not related by family (if you are in a de facto relationship)
you and your partner have a mutual commitment to a shared life to the exclusion of all others, and
you live together, or do not live separately on a permanent basis.
For a married partner, the marriage must be legal under Australian law. For a de facto partner, the relationship needs to have existed for 6 or 12 months before you lodge the application. The length of the de facto relationship depends on the visa you are applying for.

Eligible child
To include a child as migrating with you in your visa application, the child must:

be your child or a stepchild from a current or a previous relationship (in certain circumstances);
not be married, engaged to be married, or have a de facto partner; and must be:
under 18 years of age
or
over 18 years of age but not yet turned 23, and be dependent on you or your partner
or
over 23 years of age and be unable to earn a living to support themselves due to physical or cognitive limitations and be dependent on you or your partner (Note: The child will still need to meet Australia’s health requirement)
or
a dependent child of a child who is eligible under 1, 2 or 3 above.
Your child or stepchild is considered to be dependent if they continue to be wholly or substantially reliant on you for their basic needs (food, clothing and shelter). Acceptable documents that can show a parent-child relationship include:

a certified copy of each child’s birth certificate
or
a certified copy of adoption papers.
Some visas require that the child has never been married or in a de facto relationship.

2) For the refund of visa payment, I don't have information about that.

You can submit adoption papers and her birth certificate. I included my younger sister in our application, cos she has been living with us. CO requested for evidence of adoption. I also have a friend that included his adopted help and they already have their grant.

I have received Canadian ITA, so progressing my application gradually.

Your Sister's profile is unique.

Her HND is not equivalent to Australian Bachelor Degree which is the expected qualification for Accountants.

I however do not know about the acceptability of her ANAN certification (which is even discriminated against here in Naija). She can however send a mail to the assessing bodies - CPA Australia or ICAA on the ANAN certification.

Her years of experience is cool if only she can cross over the barrier of minimum qualification.

Peradventure her ANAN is acceptable, she should bear in mind that she needs to write IELTS Academics or PTE-A and score a minimum of 7 across band for IELTS and 65 for PTE in order for her to be assessed by the assessing bodies.

Giving her age, she definitely needs to score 8 (IELTS) or 79+(PTE-A) to have any chance in the accounting occupation as it is easier for a camel to pass through the eye of the needle than for a Naija based accountant to presently scale through DHA hurdles.

Hope is free and we all have the right to hope. So never say never as the hurdles could be removed sooner than later.

Details of my resume below:

AAT (2007)
BSc. Appied Accounting(2014)-Oxford Brookes University, UK. Is this equivalent to Australia Bachelor?
ACCA(2016)

I started working immediately in finance role since 2008, Someone can help me if this would be relevant.

Senior in the house, ehat do you think about my chances, especially with the current trend in Accountants` score. Do you think it would still come down someday?

When you've applied for your visa..She will be included in your visa application..If you don't front load her documents, your CO will get in touch with you to tell you what document(s) you are to provide..

CO Contact: 16th November 2017(CO asked for payslips, bank statement and tax clearance)
