I will be following this thread henceforth. I have a fiancé, she is a Nigerian- American with green card and she will be coming over here Early next year. We planning on doing a court wedding here before she goes back and file CR1/IR visa for me.

There are questions I would like to ask: Do you think the CO Will doubt the genuiness of the relationship.
For the follwing reasons:
1. She has up to 3 kids
2. She is few years older, 6 yrs.

And what is the best way to prove that the relationship is genuine.

I am just trying to get prepared ahead. I hope I get a honest answers here.

@molybdenum0012, the CO won't doubt the genuineness of your relationship as long as you answer his questions truthfully.

The documents needed to prove genuineness of relationship include, but are not limited to, the following:

Pictures of you too and family, printout of chats (email, WhatsApp, etc), boarding pass of travels, CBP/immigration stamps, account statements showing transfers, life insurance, etc.

Okay. It usually takes close to a year to get NOA2 although I hear it takes shorter time nowadays. So just keep your ears to the ground.

If you live in Lagos, go to the NPC office in surulere. If you live in other states, go to the nearest local government office. You'll go with your passport photo and photocopies of your international passport. You'll also have to go there with money (N10,000 or thereabout) to pay them. Yes You can get it in Lagos. Just go to NPC main office in Surulere.

Let me start by saying the much I know about Spousal (CR1, IR1) Visa.

CR1/IR1 Visa is issued to the spouse of a US Citizen or US permanent resident. The major requirement for the issuance of the CR1/IR1 Visa is marriage. If the marriage is two years or more the visa issued is IR1 Visa but if less than 2 years then CR1 Visa is issued.

The process starts with the US Citizen or Permanent Resident filing a petition for his/her spouse using the form i130. The filled form along with the required documents is submitted to USCIS. It takes quite a while to get approved (I hear it could take up to a year). Once its approved, the case file is sent to NVC for further processing. The NVC then transfers the casefile to the embassy and schedules an interview for the beneficiary.

If the interview is successful, the visa is then issued. The beneficiary gets the greencard the very moment he/she enters the State (unlike fiancee visa where he/she has to file for green card which could take up to 6 months or more).

I guess thats the summary.

Spousal Visa is cheaper than Fiancee Visa. Both US Citizen and US Permanent Resident can apply for Spousal Visa unlike Fiancee Visa that can only be filed for by a US Citizen.

However Spousal Visa Petition takes a longer time to be approved compared to Fiancee Visa (1 year vs 6 months). This means the petitioner won't be with his/her beneficiary for quite a while if going through the Spousal Visa route but the advantage of the Spousal Visa is that the beneficiary gets the green card immediately he/she steps into the States unlike the beneficiary of the Fiancee Visa who woild have to apply for green card (that takes up to 6 months minimum or even over one year).

There's no need to change her name in Nigeria as she's not resident in Nigeria. She only needs to change it in the States. However it is not a must that she must change her name after marriage. She can chose to retain her maiden name and still file for you. No big deal.

I'm very glad about this tread.
And I hope to learn and contribute my own share as time goes by. My fiance visited me from New york U.S 4 months ago she spent 2weeks and we planning on getting married soon the apply for spousal visa. I will share my experience as time goes by

NOA1 = first notice you will receive telling you your submitted petition has been received and will begin the review process. The date you get this notice becomes your priority date.
NOA2 = 2nd notice you'll receive after your petition has been reviewed telling you whether it was approved or denied.

Why does it matter how he knew? He figured it out obviously. Anyone who has been or going through the process would know or should be able to figure it out easily.
