Foreign Affairs / Chevron 1995 - 1999 Retirees Cry Out by sibcid: 3:10pm On Nov 12, 2016
A group of Chevron/Texaco Overseas (Nigeria) Petroleum Company Unlimited staff who were forcibly retired two decades ago but have been fighting their cause relentlessly ever since have brought out the following publication to the attention of all Nigerian people of conscience:

RETIREMENT WITH TEARS

Chevron Nigeria Ltd/Texaco Overseas (Nigeria) Petroleum Co. Unltd forcefully retired 103 Nigerian Staff Employees between 1995 and 1999 before their normal retirement age of 60 years stated in the Company’s handbook which was the Binding Agreement between both parties when the Retirees were offered Employment.

1995 - 49 staff retired
1996 - 3 staff retired
1997 - 14 staff retired
1998 - Nil
1999 - 37 staff retired
103

Staff strength of the entire Company before the retirement exercise was 283.

Retired staff in 1995, 1996 and 1997 were handicapped because of the ban on unionism by the Military Government. PENGASSAN and affected employees were furious but could not react for fear of military harassment.

Our group later met with Management and demanded for payment covering the unserved period but this was rejected. Furthermore, the retired staff pressed for monthly pension salaries which also was refused. Up to date no retired employee of Chevron/Texaco Corporation between 1995 and 1999 is paid monthly pension salary.

Lump Sum For Life: The Retirees in boiling anger kicked in August 1995 and the Company came up with a plan titled “Retirement Entitlement and Settlement” which was issued to every retired staff. In item 5 of the said document captioned “Pension Entitlement (Non Contributory)” the Company unilaterally paid each retired staff a ridiculous sum, (so-called lump sum) not in line with any of the staff collective agreement and conditions of service, which lump sum was meant to serve as Pension for life. A situation where majority of Management staff were paid less than N3,000,000.00 (Three Million Naira) each as lump sum for life.

The said lump sum was imposed on every retired staff without recourse to our Employment Agreement and working conditions with the Company. The sum is grossly inadequate as Pension for life by Labour Standards. This is our stand.

In 1999 the contention against early retirement was again revived with PENGASSN threatening a Nation Wide Strike on behalf of the affected staff if the Company turned down their demand.

On account of the strike threat, an Ad-hoc Committee of the Senate headed by late Senator Melford Okilo was set up to meet with the representatives of PENGASSN on 6th July, 1999 on the proposed oil worker’s strike.

At last, the crisis was resolved by Texaco Overseas (Nig.) petroleum Company Unltd agreeing to pay the retired staff of 1999 the unserved period up to 60 years of their normal retirement age. The agreement between PENGASSAN and TOPCON for the payment was signed on 19th and 20th August, 1999.
Having conceded payment to 1999 group for the unserved period, we feel unjustly and unequitably left out or unjustly denied our rights by Chevron Nigeria Ltd.

We are also grossly worried over non payment of monthly pension which every staff of reputable Companies like Chevron, SPDC and other oil Companies in Nigeria enjoy. Why not our group?

Having exhausted all efforts, the Retirees petitioned the Federal House of Representatives on 31st January 2000. The Committee on Public Petitions invited the Petitioners and the Respondents to formally present their case and defence respectively. Several meetings were held between the Petitioners, the Respondents and the Committee members. In conclusion, the House of Representatives made the following recommendations.

(i) “This Honourable House do urge Texaco Overseas (Nig.) Petroleum Company Unlimited to honour and respect the terms of contract of employment between the Company and the Petitioners.

(ii) That the Petitioners be paid for the unserved period of five years a lump sum at the prevailing rate when they were retired.

(iii) That the Petitioners be refunded the 3% discounted from their final entitlements.

(iv) That some of the Petitioners entitled to the Home Ownership Grant be paid without further delay”.

The Resolution/Decision of the House of Representatives of the Federal Republic of Nigeria dated 13th June, 2002 was communicated to the Management of Chevron / Texaco Corporation by a letter dated 18th July, 2002 but the Company disregarded the Resolution/Decision and nothing was done.

Late Gani Fawehinmi (SAN) who was the Petitioners’ Lawyer wrote several letters to the Company and the House of Representatives urging Chevron/Texaco Corporation to honour and respect the Resolution/Decision taken by the House but all to no avail.

Finally, the matter was filed in Effurun High Court in November, 2004. It lasted for 10 years in the Court before it was taken to the National Industrial Court in Lagos on 24th February, 2014 where the retirees were frustrated on grounds of statute bar in May, 2016. 29 of the 103 have died; pushed to their untimely death by hardship/frustration.

The rest of us hereby cry to the Public to intervene and redeem us from this copious gross oppression by Chevron Nigeria Ltd.

If each time Buhari makes a mistake we have to hug a transformer or jump into the lagoon Nigeria go finish-o, because this man hasn't started-o. Even the blind followers will soon drop their eyes in shame.

You see, Nigeria is an extremely complex country. Nobody has ever successfully ruled Nigeria without blame. Stop dreaming of Buhari having an easy with everybody shouting 'SAI BUHARI' no matter what he does. This is the 21st century for goodness sake!

I just got in. After a series of letters, they have just let me in. When they had stopped replying I used another ID to restate my case and they answered like I was a fresh member, not a marked man. Immediately they reactivated my profile I used another Visa Card (Nigerian) rather than the Gift Visa Card (US) and sailed through. I am getting interests now mostly from other African countries who seem to see Nigeria as a place of interest.

bacco2000: Please does flash share needs network connection before it can share apps cos I don't think I understand it

It works exactly like bluetooth (but much faster), between wireless(ly) connected (code-permitted) devices. The two devices are tethered (or locally 'networked' in a sense)but do not need ISP or GSM/CDMA provider network (signals)but, of course, they both need (installed) share flash!

Dating And Meet-up Zone / Afrointroductions Discriminatory? by sibcid: 12:13pm On Jun 16, 2013
A friend approached me to help him upgrade his membership of this beautifully designed dating site through a gift card which we easily got from graphcard.com. Immediately the transaction was concluded his profile was terminated. I became interested in knowing what was happening and upgraded myself and was promptly terminated. I queried the termination with their help desk and was told it was legitimate to pay through gift cards, so I tried again and got terminated again. I wrote again and this time scanned copies of the gift card and national ID were requested. I have sent them but they seem to have stopped responding to my correspondence altogether. Does anyone have an experience with this site? Are they racist...say, providing a forum for non-African men in the main to acquire African girls?
Politics / Re: Gov Uduhagan To Take Ogboru To The Tribunals : by sibcid: 1:21am On May 08, 2011
@PapaBrowne. Pardon me Sir, but you're quite wrong to claim that Urhobos alone dislike the Uduaghan regime and that all other tribes ganged up and will continue to gang u against the Urhobos. First, check the election figures (results) and you will find that 30% of the votes from Delta Central (Urhobo LGAs) went to Uduaghan (Itsekiri). Paulinus Akpeki who is serving here as spokesman for Uduaghan is an Urhobo man. It is not right to say Urhobo as an ethnic group is against Uduaghan. On the contrary, it is Itsekiris who appear to be against Ogboru because he is Urhobo. Ogboru got only 15% of the votes in the three Warri LGAs (Itsekiri area). This is despite the fact that many Urhobos, Ijaws and visitors live in this area. The Itsekiri votes for Ogboru might even be a mere 7.5% of the votes or less. Yet you see the Urhobo 30% for Uduaghan as evidence of tribalism! Secondly, the notion of a gang-up against Urhobo by other ethnic groups is mere bad-taste wishful thinking. Ogboru got about 45% of votes cast in Delta North (Ukuani, Ndokwa, Ika, Aniocha, Oshimili) more than that percentage in Patani LGA (Ijaw) and won Isoko South LGA. Your 'gang-up' theory is a figment of the imagination. Check your figures to appreciate your pitiable isolation in Delta State: if the three Warris were removed from the present Delta State results (that is, if results from every ethnic group was consdered apart from the inflated Itsekiri results) Ogboru would lead with over 100,000 votes. Just check the figures and realise that the whole of Delta State is behind Ogboru.

Politics / Re: Delta State Rigged Election, your Views. by sibcid: 2:48pm On May 04, 2011
@Careytommy,

You dont implicate yourself in an Election Tribunal. No evidence you adduce can be used against you. You are as immune as a serving Governor. Remorseful Youth Corp members would therefore be more than ready to talk, especially since it was not all of them that accepted the juicy inducements. Some were humiliated and stripped almost naked. If I am not from your State there is a limit to how much you can hope to harm me. You cant bury the truth forever. You cant shut a door against smoke. The rigging was very shameful: a disgrace to Nigeria.
