Travel / Arik Portal Down? by Trends: 8:44am On Mar 07, 2012
I have been trying to book an Arik Air flight from Lagos to Kaduna for the morning of  Friday, 9th March, 2012 and the only airline whose schedule I am aware fits that is Arik Air. Unfortunately, the Arik Air portal has been down for about 24 hours now.

I was at the Arik Air terminal yesterday to attempt a booking but was told that they could not help the situation either.

Does anyone know any other airline that can get me into Kaduna in the morning of that day and also a flight that leaves the airport that evening for Lagos. The only other airline that I know flies there is IRS Airlines but their schedule does not fit mine.

Your kind insight would be appreciated.

Intellectual Property matters are generally within the jurisdiction of the Federal High Court. This court has various forms of enforcement with each to be determined by the nature of infringement concerned.

There are several intellectual property lawyers in Nigeria, in fact, a number practicing lawyers could even be described as intellectual property "specialists" for want of a better term. Indeed, a number of Nigerian universities -if not all- have intellectual property law in their law faculty curriculum at the undergraduate level. At a wider level, the government has created the Patents and Trademarks Office and as well as the Nigerian Copyright Commission, with each as you can decipher from their names governing the respective areas of intellectual property concerned.

Yes to both questions.

Answer to Number 1. For example, Coca Cola has a "global" patent likewise Pepsi, Adidas, Nokia, Zain, Microsoft (Windows), Pfizer, etc.

Answer to Number 2 is a question: If Patents did not work in Nigeria, how would the above named companies and several others that we cannot name- for lack of space- protect themselves and their products?

Without knowing a bit of what you have in mind, I would be flying blind and all that I could send to your email will be very generic details that would be of little help. Do not provide too many details when writing me, just basic stuff that would guide me in knowing whether it is copyright, patents or trademarks protection that you need.

A few things that you could let me know are: Which industry- in general- do you wish to impact? Is the idea completely new or an improvement on an existing product? Does it have a design process? Is it a drawing, painting,logo, literary material, musical etc? Is it an artwork or scientific product? And so on and so forth.

From these very few questions alone, I am sure that you can understand how difficult it is to just send materials by email if one does not have the very basic details.

Wish I could help the way you want but even a professional will need to be clear whether what you really need is a mere non-disclosure agreement, copyright, trademark or actually patent as you state, amongst others. In Nigeria, the copyrights regulator is distinct from that of trademarks and patents, so it would be tough work if one starts to write out a step by step procedure out for you.

1. My view is that you are basically their customer and not necessarily an engineer, so it is only reasonable that they will require just the basics of what your market requires while they configure according to your specs.

2. You protect your idea via two means:
a. Patenting of the technology and the design process- if it is of such a nature that all or parts the technology are not yet patented in Nigeria.

b. You protect the brand name via trademark registration.

3. Are you referring to the manufacturer respecting patent rights? The fact is that since you are the one who will be responsible for importation into Nigeria, you will have to be careful not to infringe other people's patent rights just as they should not infringe upon yours. Nigerian courts will generally recognise patent rights, if that answers your question.

I will reach you directly but just for the information of others, a patent is basically one form of intellectual property (others being trademark, copyright amongst others). By definition, a patent is essentially a grant made by a government agency that allows the creator of an invention the sole ownership rights to make, use, and sell that invention for a set period of time. In many cases 20 years or thereabout.

An inventor may however authorise others to utilise the patent in a manner and capacity similar to that which he possesses.In effect, no one else is authorised to use the said invention without the permission of the patent owner, otherwise the patent owner has every legitimate right to sue the infringing party in a court of law and to compel him to give account to the patent owner for every item sold!

As pointed out already, patent is just one aspect of intellectual property so the way and manner of protection will depend upon the specifics of the idea as other forms of protection like trademark or copyright may be more effective than patent in some instances.

Just want to advise all out there of the need to protect your ideas, trade names,business applications, website content, industrial processes etc, however simple you might think the idea is, before submitting them as proposals to corporate sponsors, banks, individuals and others by taking advantage of trademark and patent laws in Nigeria.

I know of an ongoing law suit involving some brilliant young whizz-kids who have stopped four (4) very powerful financial institutions from using an idea that these whizz-kids submitted in a proposal to these institutions when they were seeking partnership. How did they succeed?They did so simply because they protected the idea via patent before submitting the proposals.  The institutions that they submitted to were not aware of the patent before they "stole" the idea and "launched" the product on television as though it were their own idea!

Those guys are now in court with these corporate institutions for sums ranging up to N100m and they are likely to win!

Always protect your ideas!

Generally, it would depend on whether you wish to either register a business enterprise or to incorporate a company limited by shares or if you have something entirely different in your mind. The starting point however is for you to apply for an appropriate company name. In that regard, you are advised to have at least two alternate names on which a name search will be conducted. It is often more expedient to apply for several names at once because of the need to save time, especially in the event that both names originally applied for have either been taken by others or cannot be accepted by the CAC. Once any of the preferred names is approved then you will be required to fill statutory forms, submit Memorandum and Articles of Association and so forth amongst other things.

In any event, you are advised to consult a lawyer who is familiar with the process at the Corporate Affairs Commission.
