Hi everybody, pls i need your advice on my situation, i appealed against my refusal in sept, 2007 and i got the decision of my appeal today. I submitted the appeal in British High Commision in Abuja. my appeal was refused and it was due to the fact that the supporting documents i submitted with my appeal was not included when it was sent to AIT. According to the reasons for refusal, i quote "12. the documents i have consist of the notice of appeal and grounds of appeal(the latter being extensive). the grounds of appeal and section 8 refers to a large number of documents being forwarded with the appeal including bank statements and evidence of the appealants financial circumstances in Nigeria. However what i found is a copy of an application form dated 31 July, 2007, the reason and notice for refusal but not the documents referred to in the notice of appeal. 13. On that basis therefore it seems that the appealant failed to include all the documents referred to in the ground of appeal whicch, at face value, are persuasive. 14. i do not rule out the possibility that the appeal was lodged with the respondent because the tribunal had referred to the appeal filed on 30th of August, 2007 and may therefore have been forwarded by the respondent without the accompanying documents. (which is what happened!!!!) 25. taken at its face value, the grounds of appeal are very persuasive and refer to extensive documentation. However the difficulty is that the respondent's refusal has challenged the appealant to provide evidence of her financial circumstances in Nigeria and those of her sponsor. Regrettably for unexplained reasons all the documentation except the application form has not been copied with the appeal papers and therefore i do not have the advantahe of those documents in support of the appealants assertion. 26.The burden of proof remains on the appealant. At face value i can only therefore regard the appealant as having failed to forward documents with the notice f appeal and therefore establish the grounds of appeal claimed. Clearly it is most unsatisfactory since, on the face of ot, had those documents been included and copied to the respondent, the appealants explanation might have persuaded the respondent to favourably review the application. As it is i have to refuse the appeal. " Those documents claimed that i did not submit, were submitted with the appeal. as a matter of fact i submitted the original of all of the documents and photocopies as well, My question is this, am i supposed to apply for reconsideration i.e to AIT iir write a letter to BHC, Abuja. Meanwhile, the form for reconnsideration says that the grounds to contend has to be an error of law. I showed this to a lawyer tiday who said its not an error of law, pls kindlyyy advice on what to do, thanks. God bless. |

Well, finally the housemates already know the moles are fake. Ofunneka saw inscription on the boxes(C and K-Code and Kwaku) and she whispered to Tati. Tati then went outside to the garden with Richard and told him, but she told him to keep quiet. they didnt train the moles @all. they are contradicting each other big time! |

I cant wait for Maureen to leave. i was very shocked, she got all excited after KB announced the nomination and she has been screaming since then. And you know its better we send her home, she needs to see a shrink fast. its ok wen u talk to urself ( i dont!!) for awhile bt when u go on and on abt it, its the beggining of something else (i dont know what). I hope she leaves on Sunday. Ofunneka has been playing the game really well and i hope she wins, She has made us proud no doubt. |
