Somehow, Nigerians are the problem of Nigeria. They vote someone like Tinubu or Atiku or Peter Obi to be president and blame those living and working abroad, they sell their votes and call those living abroad scam. It is such a pity, sometimes when I read how some of our brothers now reason, I'm scared of coming back home anytime soon. Because I worry they may eat me alive.

If the “beyond a reasonable doubt” standard was required to charge then we won’t need trials or plea deals because the accused would already be found guilty. If there’s probable cause to believe a crime occurred then prosecutors/grand jury can charge/indict.

I agree with your logic. But in climes like the UK and the US, the evidence amassed by the prosecution must be of such nature that will be able to meet the standard of proof in a criminal case. Otherwise, it will be regarded as a waste of tax payers money. That is why, most cases in the UK end at the investigation stage.
However, I agree that probable cause can be sufficient to charge a person but the prosecution must also be ready to meet the standard required by law.
With regard to not needing trials or taking pleas, it is a matter of constitutional right that a person be put to trial before a court of competent jurisdiction. So even if you see someone killing a person, record his video etc, he will still be tried despite all the evidence.

My dear, I am a doctor. Donating an organ to someone does not necessarily mean your life is ruined.

There are many people with one eye, one leg, one functional lung, one functional testicle (and still able to father children), one functional ovary (and still able to give birth) etc. living perfectly normal lives.

There are even people born with a solitary horse-shoe shaped kidney living perfectly normal lives. Their renal function tests may even be better than yours or mine (we that both have two...I am assuming you have two grin)

With any paired organ or tissue it is better to have both in case you develop a problem with one.

A one eyed man can still see, but if something should happen to that remaining eye that he has then he would then be totally blind.

You can donate a kidney and still live a normal life. The only caveat there is that if your solitary kidney should develop problems, then you have nothing to fall back on.

That is why people with ONLY ONE KIDNEY for whatever reason (after nephrectomy, after donation, degenerative disease of a single kidney etc) SHOULD ALWAYS BE ON FOLLOW UP WITH A NEPHROLOGIST.

They are not sick, but they are at a higher risk of renal failure compared with someone with 2 kidneys. Things usually go wrong when the donor is not regular with his appointments or if there is a problem with the solitary kidney it is discovers late.

People are naturally selfish so they will always be sceptical when it comes to organ donation.

Therefore, PLEASE, if you have a loved one who needs a kidney and tests show that your renal function is good/excellent don't be hesitant to lend a helping hand. You are saving someone's life.

You may be putting yourself at risk but these risks can be minimized if proper follow up is done after the donation. Mind you, the follow up is for the rest of your life.

PS: Donating an organ should be on ones volition. Not under duress, deception or coercion.

It is unethical (and in some countries illegal) to purchase one (that is where the crime of exploitation and organ harvesting comes in).

Thank you for this. It should also be known that you can voluntarily' donate your organs.

I’ve seen more than a few altered Nigerian passports. There is even a moniker on Nairaland who offers them.

The age of the child is not in contention for both offences of Modern Day Slavery and Harvesting of Human Organ. The age matters only for the purpose of safeguarding the victim in question.

In my rejoinder, I stated clearly that the most they could charge him for is ATTEMPT to financially induce.

Under the law, attempted crime and committing the actual crime are two different offences with different gravities.

The offence is an Inchoate offence in the first place. So whether or not they attempt or prepare, they have committed a criminal offence based on the available facts. And based on your assumption that selling your organ is not a criminal offence in Nigeria. You're yet to provide the Law that permits the sale of organs.

Probable Cause is not enough to charge a person to court (it may be enough to commence investigation) for a criminal case where the standard is proof beyond reasonable doubt.

If the boy was paid in Nigeria, then the UK has no jurisdiction to prosecute Elweremmadu.
Paying for organ donation is not illegal in Nigeria.
So the whole substratum of the case has been demolished. It is therefore non sequitur to talk about financial inducement.

Assuming without conceding that payment for organ donation is not illegal in Nigeria, it becomes illegal in the UK if that payment that was made induced the boy into accepting to carry out the procedure in the UK. In other words the offense of Modern Day Slavery would have been committed.

In your attempt to sound intelligent, you did not take time to read that what you quoted had to do with restrictions on persons NOT genetically related. In other words, transplants can either be between genetically related persons or NON-genetically related persons. You also have never heard of the term “waiting list”, so you don’t know someone can have a failed organ which no one in his living linage can be a match and he/she will be confined to a wait list. It did not occur to you that in the past 5 years, the senator would have searched within their close family/friends knit without success before extending the search. There are people who after being on wait list for so long end up getting organs from even another country or continent. The senator will only be guilty if he offered money for the kidney outside medical costs and opportunity loses to the donor.

I'm not sure you read the law well yourself because there's nowhere in the law that says someone can donate their organs if they're not genetically related

It might surprise you to know that kidney transplant procedures are being done in Nigeria.

It's their daughter so they don't want her to die in a Nigerian hospital they refused to equip.

This is the best analysis I can give about this case.

The Legal Thing was done before travel

Before they all travelled to the UK for the procedure, everything was fine. Visas were approved and all the normal procedure was done by the Ekweremadus. That is why no one was denied visa and no one was refused entry into the UK including the boy.

The problem surfaces

The problem started when the doctor that was to carry out the procedure asked the donor how old he (standard procedure) and the boy innocently told them his real age because he has no single knowledge of the entire visa process. His own was that "we wan carry you go UK."

The doctor had to suspend the procedure immediately and request that another donor be brought in as it would be unethical for him to continue with the procedure.

The Ekweremadus became desperate

The Ekweremadus now trying to beat time got another tip that there was a willing donor in Turkey who would volunteer (I mean be paid) to donate, they headed for Turkey but were accustomed at Heathrow after the Met Police had been tipped of a possible Organ Harvesting motive.

The Boy was also Smart.

After the boy was rejected, he was asked to go back to those who brought him, but instead of pampering him till he gets to Naija, they started maltreating him, na so bobo go police station go report himself o. Kasala come burst!
