Good morning guys If I go to the US on a visiting visa and during the period of visit, the school I applied to opens for the term, can I start schooling there without returning for a school visa Is there a problem with this? |

I want to know if we are to go to the embassy with our bank statements. Most of the transcript I have seen here didn't show that they submitted it and it wasn't written on the website as part of documents needed to be taken to the embassy. Secondly, if we are to go with it must it be the one we submitted to the school for the I20 because in a situation where you sell a property to boost your account balance. |

freshStarz: Hey ๐ค ** Yes there would be a bigger problem except you are ready to spend good $s for USA VISA attorney. 1 You can only undertake a recreational (non-credit) study as part of your Tourist/ Visit B1/B2 VISA while in the USA. The only way out is when you have obtained a change of status from USCIS (which is going to be an uphill battle) or through the Visa Waiver Program (VWP). 2. Although, most schools will not inquire about the immigration status of a student presently in the USA, be you legal or illegal resident but when you get into a jam with the law, injured during sports or altercations with other students, then that is when your status becomes a problem because once its discovered that the student is violating his or her visa, then the game is up you 're going back home. 3. Dont even try to change status to F1 upon arriving the USA except if you have indicated during your B1/B2 VISA application that you are a prospective student who is going on campus tours and trying to decide which University to attend. * 4. Otherwise , the USCIS would be very skeptical about your change of status to student (F-1) and put you under a microscope to figure out if you're just trying to dodge applying for F-1 visa from your home country. 5. If this (no.4 above) happens , your success with USCIS is 5% over 100% and you would have had a better chance applying for F1-VISA by facing a consular officer in your home country than facing a CIS Case Officer. 6. I will score your success rate to be 55% over 100 if you engage the service of a visa attorney and by this, you can apply to change status from within the USA . However, if you apply within 90 days of entry, you will still be presumed to have entered America for a different purpose intention to study than the visa category you used for entry (B1-B2). MisMik: Hey ๐ค 1. Yes you must go to the embassy with your bank statement because that is your only physical prove of funds. 2. Don't follow those transcripts you have read, few of those transcripts are fake transcripts. No ! You are wrong , go back to the USA embassy and you will see Proof of Funds" that can be bank statement , scholarship award letter , affidafit of support or Employment Bond Agreement. 3. It is better to go to the USA embassy with the original copies of the bank statement you submitted to your Host-Institution prior to the issuance of your Form-120 . Reason is that USA EMBASSIES and USA SEVP APPROVED SCHOOLS communicate amongs themselves via Form-120s. 4. You may however go to the embassy with another bank statement in the case of changes of circumstances , and yes you can sell a property in order to boost your financial ability but have it in mind that the USA embassy will verify everything. 5. Be extremely careful and always come back to this forum for guidance. Do not fall prey to predators and if you want to sell your property do it and receive the money into your direct account. I know you have done a little bit of research on this so i willanswer your questions. They don'task for bank statements at the embassy. Nobody is going to ask you for financial documents or anything. The only information the VO needs is what you have on your I20 and what you fill in your DS-160. Hence,your visa approval is based on how you can convince the VO through your words ,composure and confidence. If you have deficits ,the Vo is going to ask you how you will pay ,so it all depends on how you can prove to the vo that you are capable of funding your tuition. Also, whatever you want to fill in your DS-160, make sure it's your truth,so that when the VO ask you,you will be able to answer confidently. You can apply for a change of non-immigration status while in the US by submitting form I-539 to the USCIS. It costs $470 to file paper and $420 to file online. Note that you won't be able to start your degree program until your application is approved by the USCIS. I believe there's an option of premium processing (by submitting form I-907) for form I-539. Note that premium processing costs additional $1,965. One of them went online and quoted UC Berkeley 's policy on change of status and yet UC Berkeley repeated the opinion i gave you. The other linked he provided was about premium fees which is out of discussion. 2. That is how @fearlessfang and the rest of the cabals have ruined the VISA chances of many applicants and pushed many people to the pits. 3. Apply for your F-1 VISA from Nigeria , don't be afraid. You have a B-1 /B-2 visa already and all you need do is try to qualify for the F1 VISA. USCIS denial of such request after spending almost $3000 has turned lot of people to illegals in the USA. Do not present the bank statement except you are being specifically asked to provide one by the visa officer interviewing you. Doing so shows desperation. 2. Infact, do not present documents except you are being asked to provide one. Focus on answering the questions youโre being asked convincingly in a concise way. Donโt talk too much. Rarely will the Visa Officer ask you for documents. Not like they donโt ask for documents, they just rarely do. Visa interview can las from 1-10mins and itโs over. Most of the times it doesnโt run more than 3-5 mins. You see how limited time you have to prove youโre a genuine student? Shelving out documents in the midst of questioning will land you a straight denial. PLEASE STAY AWAY FROM OYOTUNJI, HE IS A CRIMINAL AGENT. DONT PRIVATE MESSAGE ANYONE ON HERE. freshStarz:There is nothing complex about change of status except you are new to visa terrain and US admission process. Once you understand the school system and how it operates youโll be very fine. 1. Understand that most school do admission for Fall, Summer, and Spring for most F-1 Student. Also, know the timeline for change of status process. It is very good for you to familiarize yourself with the process. Now, let me reassure you, it is very easy. It is as easy as applying for EAD under economic hardship after one year of study and still get the application fee waived. Note: You have to understand well how the school system operate. Immigration application will always be complex to first time applicant, so the word complex captures those specific people. There are people here who file their adjustment of status to green card by themselves without any help- I mean the NIW visa program. Is NIW a complex application? Absolutely yes. But you have to understand how it works and the requirements. My advice for you is to go to the U.S. apply for school based on the one that would give you a good TL for you to apply for your change of status application. Check the school and how fast they issue admission decision. Make sure your coordinator are aware that you are in the U.S. and require a change of status.
