What obi can challenge is the credentials APC candidates submitted to inec.
as a candidate obi or his party has the locus standing to challenge the qualification of Tinubu at an election petition tribunal and the issue of nomination falls under qualification, its a settled law

No party has the right to determine how another party selects its candidates.

I bet you didn't read the statement from the Judge but now giving a different interpretation that suits your narrative.

Shettima’s name was not on the list for candidates for Senate, during the election and he did not receive any votes for his constituency. So after being picked as Tinubu’s deputy, he must have stepped down. Case closed. He also has a right to put up nomination prior to knowledge about Tinubu’s interest in him.

It is left with the court to determine at what stage it is legal for him to be substituted. The point being made is nomination, not elected on two fronts or appearances on ballot on two fronts.

Lawan who didn’t contest a seat was declared the winner knowing very well he submitted nomination form for presidential election.

Read the electoral Act, non qualification of a candidate is one of the ground for challenging an election.
you need to understand in every election there is pre-election and post election.
Opposition can't challenge APC primary process.
Nomination of shettima is conducted by Apc and supervised by inec. Only apc can challenge the outcome and process.

There is no double nomination. Only thing he was nominated for, was Senate. VP position is not a nomination but a selection. After Nomination for senate, he stepped down because he was picked by the Presidential nominee Tinubu. Someone else contested for senate in his place and won.

Let me put this in layman’s terms for you. The nominations for house of assembly are before the nomination for Governor. You put your name down, contested and the party nominated you! Governor now ran for his own nomination and won. Then the Governor was to pick a running mate and he selected you. Is that a double nomination?

Also, you did not go ahead an contest in your election since the Governor had picked you. You resigned. Take note that nominees contest for their posts within their parties and are accepted depending on party rules.

It is clear you don’t know the difference between pre and post election matters. I have done several election Petitions. Let me school you. The issue of qualification is an internal affair of APC and cannot be challenged by a non member. This applies to pre election matters. See Dangana v Usman, Hashidu v Goje etc. It can only be challenged after the main election, because it is in the electoral act. “That the candidate is at the time of contesting the election not qualified to contest the election…” Shettima nomination has been invalidated by operation of law because of double nomination.

Election petition tribunal is based on
1. Qualification/Eligibility
2. Adherence to Electoral laws
3. Got Lawful votes to be declared winner.

This issue of shettima/tinubu is based on No1.

I will give you an example.

During 2019 election, buhari was also taken to court by pdp for non qualifying due to certificate, it was thrown out.

When petition tribunal started, the tribunal listened the petition of pdp regarding buhari certificate.

Nobody said it won't be listened to. It would, but it will still be thrown out for time wasted and d might also fine d lawyer like dis one. Dat d tribunal listened to Atikus petition, did he win it. NO. Same tyn will happen with reference to dis

Intelligently going through the comments and reading from intelligent minds in the comments I think we can safely conclude that tinubu is officially the president. From what I gleaned from the brilliant legal minds in the comments

1- the non-eligibility of a candidate based on felony such as a drug crime stops being relevant against the candidate 10 years after the crime is recorded and judged. In tinubus case this supposed drug crime is over 40 years old now. That's four times the required time. So based on this that accusation would be tossed

2- is the issue of the 25 percent FCT. Which the FCT is seen as a 37th state and not a compulsory entity to win. They say someone has challenged buhari in this case before and lost so a precedent has been set for this case. TOSSED OUT

3- the issue of pre-selection bantering within a party before the election based on pre conceived legal grievances becomes irrelevant once the election is done and dusted and the only person who can then challenge the winner after this fact is someone within the winners party and anyone outside of the winners party has no jurisdiction to challenge it and based on this we TOSS IT OUT

IN CONCLUSION IT NOW APPEARS THE OPPOSITION HAS NO CASE SO I SAY, elofokanbale

Delivering the lead judgment, Justice Abundaga, who agreed with the submissions of lawyers to the respondents, including Thomas Ojo of Lateef Fagbemi and Co, described the PDP as a busy body, who dabbled into issues that were internal affairs of the APC.
The judge erred in law because it is a constitutional issue and not party constitution issue. The electoral Act stipulates that a candidate cannot be nominated on a two posts on the same election circle. It's never a PDP constitution that say so. It is the right of everyone contesting for election to question the validity or constitutional right of any candidate that falls within the electoral Act or Nigerian constitution.

I'm interested in what the judgement will be for the FCT case.

It wasn't as straight as you think( I may be wrong).

Why is it mandatory for us to have English Language during our SSCE? Is it that English language has two heads than other subjects? even if you have 8A and fail English, no school will admit you.



Since FCT is not a state, you don't expect the constitution to say you should get 25% in 37 states. So it stated 36 states and the FCT. Technically you need 2/3rd of 37.

Bookmark this. This argument will be the easiest to knock off at the appeal.

Came down.... just relax, Peter Obi lawyers were referring to some section in the electoral act and another in the constitution. I have just forgeten the sections. They will present their petitions with their arguments

Read the whole thing very well, no court can't grant the request PDP and LP want. The case is internal issue. It has been said so many times in diff. Court. Na APC issue. Only a Candidate from APC can challenge them in court based on that fact

This is one of the grounds of Peter Obi’s watery petition. Every other issue will be quashed as well. Asiwaju Bola Tinubu’s four year presidency is a done deal.
