PEPC Judgement: Abuja Indigenes Head To Court, To Demand Elected Gov, 3 Senators by References1: 10:24am On Sep 11, 2023
The original inhabitants of the Federal Capital Territory (FCT) are preparing to take legal action to request that the federal government of Nigeria and the National Assembly allow them to elect their governor, three Senators, House of Representatives members, and State House of Assembly representatives.

This decision comes in response to the recent judgment by the Presidential Petition Tribunal Court, which asserted that Abuja holds no special status compared to other states.

Daniel Bwala, the former spokesman of Atiku Abubakar’s Presidential Campaign Organization, announced this move on his verified X account, formerly known as Twitter, citing the tribunal’s ruling that places Abuja on equal footing with other states.

He wrote: “Following the Presidential Election Petition Court’s judgment which states to the effect that Abuja is just like any other state; I am hearing that the natives of Abuja are approaching the court for an order mandating FGN to let them produce their Governor and 3 Senators amongst other peculiarities of a state. What is good for Guinea is also good for Uganda.”

Recall that the Presidential Election Petitions Tribunal ruled that the Federal Capital Territory (FCT) does not enjoy any special status compared to the other 36 states of the federation concerning the mandatory 25% vote requirement in the presidential election conducted on February 25.

The court’s ruling, issued on Wednesday, emphasizes that the FCT holds no superiority over any state in this regard.

The tribunal said the Labour Party’s “interpretation of 134(2)(b) of the constitution is completely fallacious, if not outrightly ridiculous.”

Section 134(1) and (2) of the 1999 Constitution of Nigeria (as amended) mandates that in a presidential election involving multiple candidates, the winning candidate must secure a majority of the total votes cast and obtain at least 25% of the vote in at least two-thirds of the 36 States and the Federal Capital Territory (FCT) to be declared the duly elected President of Nigeria.

Way to go. Since Abuja doesn't have any special status then they should have what other states have. Those injustices have set a bad precedent.

Quick to label Abuja a no man's land?

This life has no balance when politics, religion and culture are involved. Humanity is the loser at the end, especially the poor and the middle class.

Yes, Good step.

Since Abuja is just like any other state, they should be allowed to also produce Governors, and Senators.

This is what you get when people call black white. Abuja doesn't have special status, but they appoint fct minister instead of electing governors. They produce only one senator instead of 3,like any other state

Wicked law officials

When you tell a lie, you need another hundred lies to cover up. Suffice to say that when you subjugate justice and fairness, you create ripples of other problems that turn around and hurt very well.

So, according to the PEPC judgement, Abuja is like a State and by so, deserves to have a Governor and 3 Senators.

Sounds like propaganda until the case is actually instituted. FCT residents don't have two heads to be hold veto power over other citizens of Nigeria. Their case will be thrown out. All the justices of the appeal and supreme courts are indigenes of certain states and you can take it to the bank that none of them will ever accept the wrong interpretation that voters in their own states are inferior to FCT residents.

It is the constitution that gave Abuja special status and not any individual. You must obey the constitution for now. If this clause needs to be amended, then this can be looked into in the future. Let the rule of law prevail!

State creation is an act of the parliament I.e. the legislature. They should channel this request to the national assembly.

The supreme court like the appeal court, will uphold the constitution of equality of citizens before the law. That every vote is equal and not more important than another. The citizens are a different legal entity from the state. If FCT has a special status, fine but it does not overide equality of all citizens in every part of Nigeria as enshrined in the constitution.

lol since they don't have governor, 1 senator instead of 3 but no house rep while other states have their governors and their legislative they should not seek redress in court of law ? Bias has finished your brain!

The judgement on this particular 25% issue and the double nomination were the most laughable of all the judgements.

The corrupt judges said that its should be referred to as a state. Oya where is the governor and what is the capital of FCT? They also ruled that shettima double nomination WAS NOT INTENTIONAL. Can you imagine? shocked shocked

And APC supporters agreed to such a fraudulent ruling. If it's like that, all those in jail for one offence or the other should be released after all they didn't do it intentionally too grin grin grin grin

NIGERIA WILL NEVER BE GREAT angry

Tribalistic yorubas think they are doing igbos but what they don't know is that they are doing everyone including themselves. As it stands now the future of the unborn generation doesn't look good in that useless country when things like these keep happening. Japa if you can!

Obi and his dient people should know that 2023 election is not the first in this country and will not be the last. In every election, there will always be a winner and couple of losers.

PDP and LP lost woefully and looking for every opportunity to cause chaos in the country. If Tinubu can work hard and surpass people's expectations, LP and PDP would be weakened the more in 2027.

This is what judicial corruption causes. How can a judge say that Abuja is the federal capital Territory and no special status is attached to it.
What a paradoxical statement.
