The first /primary administrator of a man's estate after his demise is is next of kin, usually his wife, your mother. She can do whatever she wants with the proceeds and it says alot about you and the state of the family if she could do this and not give any of the proceeds to you. You can't undo what's done. Go and build your own and show her that she is not your God.

After your Dad, it's your Mom in order of seniority...
There is really nothing like my father's house... It's your parents (both father and mother's) house... If your father is late, then they become your mom's properties (ALL) Everything belongs to your mom...
She can decide to do anything with them...

Oga go and rest... Your father's properties aren't yours...

Na u sabi. Before a mom will sell her husband house and not carry the son along...

By the way, who is supposed to be NOK for a man b4? Is it not his wife b4? Where was the young man when the parents were building the house? Probably strapped on his mother's back! Same mother he is now trying to drag house with. Why do you people hate truth like this?

The story is incomplete. Advice the young man to go settle/sort his issues with his mom.

My story is not incomplete.May you not suffer loss.
By the grace of God i have a job i can take of my family without getting proceeds from the house that was sold.
It's just painful that what is jointly owned was sold in secret after a disagreement that it should not be sold.

If your father has no will I think your mother is next in line to inherit his property. But there is a fundamental problem in your family that need to solved first. There is no well functioning family the mum will not give a hint to all the family members before selling off the major property in the family. Better tell us your family story first

I want to assume you are not from these continent, however if you must know in africa esp.. Nigeria inheritance are for children
The wife/mother is duely compensated but naa the children get the property and will manage the property
In the event of no will, the 1st child is entitled to largest share, even the law recognises the 1st born
That is a lie, no law recognises the first son to have a lion share of the property, the law can only share the the property equally among the rightful heirs except if there is a Will.

I don't know if you are male or female.
If you are female then you must be the most wicked mother on earth if you can't protect your children when your husband is dead.
That the next thing on your mind is to go and sell property that belongs to him in secret without consulting other members of the family.
Everything that my mom and sister did was based on greed.

what as yoruba gat to do with these, every culture in nigeria has a provision for the decease children nd in most cases the male child is favored
ok ! try me with the part of the culture that doesnt favour me cheesy

I understand we live in a civilized world, most of you are just quoting what is made up in your head not on the paper i.e customary law

lets be pragmatic, we all know davido father is rich n educated but Wale is 1st son owns the lion shares in his company, even when he bought davido a record label who did he make the chairman
My late papa no get property, for those that want to judge But my children i will ensure things are shared in proportion to seniority ... i strongly believe equality does not exist in God dictionary and i don't see oyinbo ways as superior

Davido father is alive, a father decides how he shares his property any way he likes, he can even decide not to give any of his children nothing even the first son, I don't think there is any law in any country that will force him on how to share his wealth except the child is still underage . We are talking where the father is dead and no Will and it is left for the law Court to decide who inherit what

i have made it clear Nok can be just anybody but in the advent of no will is my stand point is the 1st male child stands to be the major beneficiary, even the court will have no choice than to validate him based on customary law .. judges don't rule by opinion or feelings it what the book says

The highest court can do is, compel a sharing formula but the eldest male son still get the most of the properties & would manage it,

Becos it is property sharing everybody want equality right ... lets assume it is a problem or debt, papa is gone grin who is expected to front, will the mother & sister exempt the male son just like they did

People still fight over their father's properties. I never made that mistake from early in life, I told myself that I was going to build wealth and amass my properties myself.

My motto is " Whatever I do not acquire myself , does not belong to me"

Very sensible

@OP Kindly borrow sense from this because selling off small small properties do not really enrich the sellers

I dont give a damn what goes on with my dads house .

Because the throne/Title does not belong to the man, it's a privileged position he occupied. In some villages, they rotate the kingship from clan to clan, in some villages it's meant for only the first son, heir to the throne.... In some villages, if the king's dies, the queen takes over etc... But personal properties and belonging ...

The father and mother own everything including the children... The children belongs to the parents... If the father dies at a very early age, who takes care of the kids, the mother... See I can't argue this with you abeg...

You don't know the context in which the mother sold the property as the person did not explain or state it ..

If the woman has a reckless 22year old boy selling everything in sight she also has a 20yr old daughter standing by the mother and they have 3 or 4 siblings under 14yrs to sponsor... What do you advice the innocent woman to do... Allow the useless son sell the property and squander it on 14yr old girls abi...

Thank God he said the woman sold it and did not spend the money, she kept it... Meaning that woman has sense...

By the way the mother owns the boy she is the owner of her children and all her husband's properties... Not one prodigal son selling of things to squander...

Why haven't you used this your beloved customary law to run your country's government? Why can't you use it to hold anyone to book? Could it be that if it exists it is inferior to higher courts?

Why do you only believe in it when it is time to rip off a woman who is the rightful owner of the deceased man's home by law? Why haven't you used this wonderful court to determine the winner of gubernatorial elections?

My mother and elder sister sold our late father's house secretly without our consent around february this year but we just found out only recently. It's a 4 bedroom bungalow. The buyer has completed renovation.Have we lost out? They didn't share the money they are holding on to it.Is there anything that can be done at this point in time?
