samdams: The rule says at least 28 days before your app but you can submit anywhere from 3 mos to 6 mos imo. lucksee: I think there is no fax facility in lodging an appeal to an embassy, you can do that with the AIT only. You have to mail it to the embassy i.e. filled up Form AIT-2 along with your grounds and all relevant documents. Paying GBP2k is a rip off imo, just do it yourself. Address point per point the ECO's reasons in his notice of refusal and provide sufficient evidence to counter the eco's allegations. New evidence are also welcome. |

@ sam I think you can go ahead with your app, it's the eco's duty to verify re your accom @ lucksee If you want the eco to see your evidences first, then I suggest you lodge your appeal with the embassy instead of AIT in UK. If you can provide a strong grounds of appeal there is a chance that the orig. decision be overturned. Good luck! |

me051: Did your mum submit an employment certification from her company? Since you lodged your appeal at the embassy, you have to wait for their reply. They can overturn the original decision or forward your appeal to the AIT in UK. You will be informed in due time like 6-8 weeks I think. |

erico2k2: I think you should consult an immigration lawyer in the UK. Maybe you need representation in the hearing, it is important to know the grounds the Sec of State used against the judge's decision. Good luck! |

paramajit: Maybe your school is awaiting for their license approval, meanwhile submit copies of your passport & credentials bec. they will be needing it for the new visa letter. Just keep in touch with the school as to when are they going to get their accreditation. Meanwhile be patient and wait for a positive result. @ erico The State has applied for a review of the allowed appeal which means that they can do so on the grounds of error of law, you have to wait for the response of the AIT whether they will accept the State's application for review. |

samdams: You can re apply at the same time lodge an appeal from your second application. Just address what has been raised in your refusal ie prove your relationship by providing concrete evidence such as your birth cert & your sister plus their marriage contract. You have also to present a certification of employment from work. I think you have a chance at appeal. The new tier 4 is also quite tricky, it has new requirement from the visa letter, the old content of the visa letter does not cut it anymore. The school has to provide specific reasons in the visa letter why you were accepted. So look for that detail in your new visa letter. Regarding 10 points for funding, I think the funds should be in your own personal account at least 28 days before application. Pls take note also of the required fundings, if you will stay within London area more funds are needed. |

Once you got it, you can email the embassy to inform that you got a positive result from your appeal. And wait for their reply and call, either way. About 1 month after the promulgation of your appeal. |

grillade4u: I thought you lodged your appeal direct to the AIT but it's obvious your lawyer did it with the post. Get in touch with your lawyer as to what docs did he submit. Did he submit the Notice of Appeal form and your Grounds of Appeal? You should be able to SET OUT your grounds clearly and be able to reason out and provide evidence as much as possible. I'm afraid your lawyer may have just written a letter of reconsideration otherwise why would you be notified for a FULL appeal? Pls confirm this with your lawyer. |

To Shanga, this might be helpful Entry Clearance Guidance - General Instructions 27.6 - Processing appeal documents Original documents submitted by the appellant must be preserved in the condition in which they were received. If they are received in mutilated condition put them in envelopes. Do not punch holes in them or staple them. Original documents that you are satisfied with, should be returned to the appellant after being photocopied with the Post stamp clearly shown on the photocopy. You can cite this to the AIT in your request. |

no need to contact the law firm. since you are the appellant you are allowed to make follow up/inquiry. just quote your post ref from notice of decision, your bday, country of origin that's it and then wait for about 4 weeks. bec. it usually take some time for your appeal to be uploaded in their database. best of luck! |

dearstan: it is very difficult to defend such cases, you should hire a brilliant immigration lawyer for this. falsification of docs is a grievous offense one that the embassy takes seriously. your cousin must convince the judge as to the circumstances which lead to your cousin's innocence on the false submission of that pertinent doc. |

Awoll, if i were in your shoes, i will not mention to the judge that i have started nysc in nigeria at this point in time, anyway you have not yet finished your nysc yet. I think you do need an evidence for your intention to return such as school certification that you still have to undergo your nysc. Awoll, the important thing is that you explained in details about NYSC and its importance in your life plans. But then you already started your NYSC instead of after your UK trip, right? In that case, just finish the module and do not get your certification yet. So its as if like you didn't finish your NYSC yet and came back for your certification after your UK trip. Since, the judge do not know whether you started NYSC yet, he will not question your sis regarding that. Did you state extensively in your witness statement about your plans after your UK trip? I think that's very relevant in your case. Do you think the judge will take your case favorably if you inform him that the very reason for your coming back to Nigeria will be known to him? |

Your sis should be able to submit bank statement as supporting evidence. Regarding your going back to Nigeria, if you have explained in details your intention to go back then there is no need for the judge to question your sis regarding this matter. |

shanga: Thanks Shanga ! Hello Everyone! Good news, my sis from UK called today to inform that she got her copy of my determination and that the AIT Immig Judge has allowed my e appeal. Thank God and Glory & Praise to Him ! I will now wait for my own copy (maybe it will arrive on Monday) and will email the Embassy to update them. Just would like to say thanks a bunch to everyone here for the support and guidance most especially to Mr. Pataki, Akolawe, & others whose inputs were most helpful. @ Awoll As long as you have explained thoroughly your intention to return to your country after your studies, there is no cause for worry. You should have explained very well your plans after your studies in your grounds and refer to it as well in your witness statement. Your sis do not have to explain to the judge. Good luck ! @ Grillade If you have already submitted your Notice of Appeal, you can also make a follow up to the AIT via the customer care, you can see the email add I had given to Shanga. The AIT will notify you once they have registered your appeal in the data base, about 1 month. Then wait for your hearing notice, about 12 weeks or so. |

shanga, you can email the AIT at Customer.Service@tribunals.gsi.gov.uk and inquire about the possibility of additional submission of orig. docs and request them to mail back after. It is critical that these originals should reach the hands of the AIT as it is the immig judge that's going to decide your case. AIT customer service is quite effecient in that they endeavor to reply/attend to inquiries at hand asap. |

@ shanga Since your student visa application was made before the Tier 4 effective date which is 31 Mar 2009, your appeal proceeds. Student visa apps from 31 Mar 2009 going forward, will no longer be allowed to appeal but will have administrative review instead as per the new Tier 4 rules. I am now waiting for my appeal determination, my case was heard on 27 Mar 2009. My sister was the one who attended the hearing as my rep and she said that the hearing lasted 10 minutes and there was no rep from home office presenting officer unit either. Hope you submitted the original docs as your case involves the eco not satisfied with the certified copies. I think the AIT will just make photo copies of the orig docs and you can request that your originals be mailed back to you. Pls contact/email the AIT customer service for this. God bless! |

I think he violated " Audi alteram partem" for deciding that I cannot enter the UK without first hearing from my side via scheduled interview and "Nemo judex in causa sua" for the ECO's bias views. Would also like to enter as grounds how my basic human rights ie access to quality of education was affected as a result of the ECO's decision. Mr Pataki what do you think? Vor? Akole? Funky? @Mypeace Just contact the embassy concerned in your country. If the staff is frequently travelling maybe you can get visit visa, if UK is the destination, the British Embassy or British High Comm as the case maybe. In this case, you do NOT deal directly with the embassy but UK VAC or UK Visa Application Center a.k.a. VFS. Tip: You can google VFS in your country's webpage. You can have all the info needed. Hey guys, just finalizing my letter of appeal, Do you think I will include in my grounds for appeal the fact that I didn't have an interview with the eco and that the eco violated one of the principle of natural justice which is on hearing out the aggrieved party? Shall I also mention that my sponsor was not contact in case the eco doubts about my sponsor's willingness to take out a loan? Pls advise, thanks & God bless |

My sister in UK has a full time job and owns a house, she is just awaiting for my visa approval before proceeding with the loan to be sure. However, I already told her to proceed with the loan so that I can submit the document needed in my appeal. Also, I am getting another sponsor to be on the safe side. My course MBA in Financial Services is a new course being offered at the Univ of Greenwich and this kind of specialization is not available here in the Philippines. Maybe the ECO thinks that all MBAs are the same (I can't blame him though for being such ignorant in this matter!!!) Thanks and God bless All |

I guess an appeal is the way to go. I am talking to an immig consultant about my appeal, and suggests that it be lodged here at the embassy. @ Mr Pataki Mabuhay! thanks for the swift reply Magandang Umaga means good morning in Tagalog At first, I really wanna appeal my case but it's kinda long, I don't think I can wait 6mos to 1 yr. But I am also worried that I'll be refused again and waste another GBP99 for the embassy fee What I plan is to appeal first then while waiting re-apply and add a co-sponsor, what do you think? Do I have a leverage if I do that? Can you also suggest some grounds of appeal for me pls, I have actually done a draft of it. What's best and fast, to lodge it in the embassy to be resolved soon by the ECO or at the AIT UK where it will take some time. I think the process goes like if one submits it to the AIT, the case will be referred back to the embassy in manila. So I am a bit confused on this. Pls advise. If I re-apply the fact that I am unemployed, will the ECO take it against me? Cuz I just recently quit my job in a bank, didn't expect that I will be refused a visa. How do I counter-act this? Actually my course is a new one at the Univ of Greenwich and I don't think it's available here in the Phils. What portion of the VAF3 do I state this? How do I prove to the ECO that I am a genuine student cuz in the refusal he demonstrated that he is doubting. In my previous app I stated that as soon as I finished my studies I'll be putting up my own business in my country. Hi All!! I am new here and I am from Manila, been browsing this thread for the past 2 days and I must say it's very educational and helpful. I applied for a UK Student Visa and got my refusal letter with a right to appeal just this week, British Embassy Manila ECO's reasons are: You state that you wish to study for an MBA in Financial Services at Greenwich University for a period of 1-yr. I note that you are currently unemployed. You have provided me with no credible explanation as to why you have chosen to study in the UK rather than in the Phils given the cost of your studies. Given your financial circumstances you have not made clear that such seemingly disproportionate expenditure has been fully taken into account and that it is either reasonable or credible. You have also failed to explain how this UK qualification will be of more benefit to you rather than the equivalent Filipino qualification. YOu have stated in your application that you chose the course because the UK course leads to an internationally recognised certificate. However, I am aware that TESDA (Technical Educ and Skills Dev Authority) who are a gov't body of the Philippines do offer similar MBA courses. These courses are also internationally recognised. I note that you have already taken a BS degree course in Bus Administration here in the Philippines. Therefore I fail to see why you would need to go to the UK to learn skills that you already have or can study here in the Philippines. There are numerable reputable educational establishments offering similar courses, which are reasonably priced. Bearing this in mind, you have not satisfactorily explained why you wish to take a 1-yr MBA in the UK. I would expect a genuine student to find out about locally available courses and make a cost/benefit assessment before deciding to study overseas. You failed to do this and you propose to spend a substantial proportion of money on studies in the UK. I am not satisfied that you have explained your actual motive for going to the UK. I note from your application that your sister will fund your entire trip and studies. You have also submitted a letter from your sister that says she will be taking out a loan to pay for these studies. I do not find it credible that she would do so given that your course is available here at a fraction of the cost. I also see that she has a dependant child. I am not satisfied that you intend to follow this course and I am not satisfied that you will be maintained in the UK for 1 yr without recourse to unauthorised employment and/or public funds. _________ My sister is a naturalised Brit and has a 2 yr old son and husband who has a job. I intend to appeal, what's my chance of success? And since the programme will start Sept 22 am planning to re-apply as well. Pls help me out guys, any advise and inputs greatly appreciated.
