AND WE WENT TO COURT THE APPEAL WAS IN OUR FAVOUR. THE BRITISH EMBASSY CALLED MY WIFE TO SEND HER PASSPORT TO THE EMBASSY BY DHL. SHE SEND HER PASSPORT TO THEY AFTER 3 WORKING DAYS THEY CALLED HER TO COME TO VISA CENTRE THAT HER PASSPORT IS READY FOR COLLECT.

MY QUESTION IS THAT DOES THIS MEANS THAT THE VISA HAS BEEN ISSUE IN HER PASSPORT?

Helo everyone. I just wanna give update about my wife family visit visa that was refuse. We appeal the decision and the appeal was allowed. My wife was called to send her passport through dhl to british embassy abuja. And she send her passport to them. After three working days the british embassy called her to come to collect her passport is ready for collection. Does the means her visa has be issue? Pls advice

Thank you very much for your advise but I would have appreciate more if you know the question I asked and answer me and give your advise not skiping the question out. Simple question does any one the time for the passport will be ready for collection if embasy called you to bring your passport.

the determination the judge gave the home office 5days to appeal the decision even the 7days has passed and i call the court to find out the home office has make appeal they said no. However, at the end of the determination the judge stated that she made no further redirection and the full fee u should be refund back to me for winning the appeal if they refuse to appeal decision. But as it stand the home office has not appeal. Like i siad the judge stated she made no further redirection what does this means.

Tourist visa cnnot be appeal i agree with you on that, but a family visit visa can be appeal on ground of human right base on article 8 right to family life and private life when you husband is british or family like husband,wife,son who are british. like i said i have sppken to the court and they said my wife appeal is a gaurantee to visa and i do not need to resubmit any document revaluation because i am british and our son is british also and because the appeal was allowed under article 8 of the immugration rulr which righ to private and family life. Pls note these article only apply to british citizen who wife or husband was refuse a visa .

I have spoken to the court the morning base on your statement. I spoken to the court where my wife appeal has been allowed u was told that winning an appeal or if your appeal has been allowed is a gaurantee that my wife will be issue the visa and the british embasy has no power to up hold the court decision if they fail to appeal .

i want to correct that statement of winning appeal is not a guarantee of issuing a visa. if winning an appeal in court is not a gaurantee there would have been no need of appealing eco wrong decision in court. the Eco or ECM does not have the power to hold court decision if they refuse to appeal the judge decision for allowing your allow. if they did not appeal to the upper tie tribunal they have no choice to issue the visa even the home secretary has power to up hold court decision. especially when they visa is family visiting visa wife visiting her husband and son who are british or husband visiting his wife the eco or ecm does not have such to up hold the visa if they fail to appeal the court decision and they cannot ask for wife or husband to summit document for revaluation when the visa is family visiting visa. eco can ask for revalaution document if the visiting visa is for tourist purpose but not as family visa that is been sponsor by her british husband or wife. to make my finally correction of your statement for the avoidance of doubt i have called the court where my wife appeal was allowed to ask if the winning of appeal is gaurantee of visa. i have been told by the court that if the judge allowed your appeal is a gaurantee of visa will be issue to my wife if they fail to appeal the decision. i have also spoken to the home office they also said that winning an appeal is a gaurantee that visa will be issue to my wife if they did not appeal the decision but in case the home office has refuse to appeal the judge decision and they will called my wife to come and collect her visa and that i should allow 12week from the date of the appeal being allow.
this means that winning appeal is a gaurantee of visa if the home office refuse to appeal the judge decision.

my wife was refuse a uk visiting visa last year the eco stated that he/she was not satisfy that my wife was a genuine student of delta state university. however, i took the matter to tribunal court. we won the appeal in favour. i have received the determination from the court the judge has allow the appeal. the promulgate date of the appeal is 1 Agust. now my question since we have had our appeal allow by the court who long will it take to issue the visa to my wife or how long will it take for the british embassy to issue the visa or called her to come to collect her visa. pls advise.

If you aply for family visa and it was stated that your appeal is limited to section 84(1) this mean you can appeal the decision on the bases of human right ground. All family visit visa are given the right to appeal on human right ground . This mean you appeal on human right ground. My wife apply for family visit visa but she was refuse and it stated that your right of appeal is limited to section 84(1)c and we appeal the decision on human right ground and being to court for the hearing and we are waiting for the judge decision which know that we won the case because the judge was in our favour. You can appeal but it may take long to attend the court hearing.

Can i stand as my wife sponsor with my bank statment and payslip even if she work in the family company and get paid monthly income N156,000 into her account as director?

(2) do we need to use the company letter heading paper to write a letter to the british embassy that she working in the family company and she will be visiting her husband and her son who are british?

(3) if we need to use the company lettet heading to write to the british embasy about her travelling and hollidays does she need to sign her signature on the company letter heading paper or need to her signature becsuse my wife is the director?

Helo every thank you for your help. I base in uk and we own family company in nigeria me and my wife are the director of the company. My wife base in nigeria managing and working in the family company and is currently on a salary of N156,000 every months which is paid directly from the company into her account. My question is does she need to submit her bank statement and payslip only? Or she also need to submit the company bank statement and the company registrstion frim CAC. Or just her bank statment and payslip? Without company docunents. Thank you

No my wife does not have another child with another man is just me and my wife and my three children. Like i said is just me and my first son which is currently at thesame address with me in uk and my wife is going to aply for our twins baby which is just 6months. Would the accomodation be count as overcrownding if the mother of my twins aply for the visa. And do i need to suport the application with bank statement know that the twins are autmatic british citizen because i am british myself.

Pls i need your advice. I am a british and my son is a british we both live at thesame address. My just had a twins babies and i been to nigeria to aply for the babies british passport which is currently still process by Her majest passport office in uk. Now my wife is coming to visit me and her son. And she need to come with the twins and i subjected that she aply for the twins uk visa since it is taking time for the passport to by out. My question is me and my currently live in two bedroom apartment and the tenancy agreement
State the maximum number of people is three and when my wife join we will be three however and i want to use the tenancy agreement to aply for the twins who are just 6 months visa since the passport is still being process . Since the twins are just 6months old would be account as overcrown to refuse they visa or would they not be count as overcrownd since they are just 6months old they will be sharing thesame room with me and the mother since they just a babies? Pls i need ur advice and i have also decide that i will also sumit the evidence of me aplying for their british passport with the application. Thank waiting for your reply.

When a solicitor plead your case for you in the it only take 1-6 months it does not go from court to court and it does not go from year to year where in uk. I will tell you of someone i know. My dad friend aply for uk visit visa for her son and daughter. ECO refuse her son and duaghter visa becos they stated on the refusal letter thst they done believe that the boy and her gire are my dad friend children and their mother went for dna test to proof they are her children but the british did not want to issue the visa becos they believe they will not return to nig. My dad friend took they to court the shocking thing is that on the day of the court the embassy run off i mean they did turn up on court. So the judge order the embassy to issue the visa immediate effect. All these when just between 1-6 months. I took they to court in novermber but the court has order they to review the decision and issue the visa or they will have to come court to answer quarel i know the embasyy will prefer to issue visa than coming to court. Embasy will only appear in court only when they know the have 80-100per of winning otherwise they will not come becos it will court they alot to hire solicitor for themselve. They will never come when they know the reason for the refusal is nossess and silly reason.

I would like to update the good people about my wife uk refusal. My wife had been to uk to visit me and my son who are both british. When my wife apply for her first uk visa she brought a letter from her uni delta state university and the visa was issue to her and we stated on the application she will be staying for 4weeks but she later stayed for 5month beco they had long holiday after completing her industry trainning program.however when we apply for a renewal she was refuse the ECO stated that she stayed for 5months instead of 4weeks stated on aplication and she did not summit letter from her uni in support. The reason why we did not bring A letter from her uni is beco she had already summit a letter from her uni in the first application. However, i reaply for the second time addressing those issue. I stated clearly to address the reason why she stay up to 5months and i also told the ECO that it does not matter how long my wife stay for but matter is that she did not overstay her visit by 1 or 28 day period and there was no restriction to the 4weeks but the visa clearly state she can stay for 185 days on her visit and this time we brought a letter from the university to support she is a student but the ECO refuse my wife again stating they were try to verify the letter from her uni they were unable so on the balance of probability they are not satify of her currently circustance in nigeria. I got very hungry knowing that my wife satify all the paragraphy 41 and section (1) of uk immigration rule. Decide to send an email to the british embasy in abuja i told the ECO that she/he should know that there is a national strike in unversity in nig and she should know this even the unborn baby know there is a strike in nig then would they clay that they were try to verify the letter. I tolk the case to court, i called the court yesterday and i was told that the court has sent a letter to british embassy in abuja give they from now to 24 feb 2014 for they to review the decision and issue the visa otherwise they will have to come to court to answer court qaurell becos the reason for the reason refuse is nosses or stupid reason. I whats to say is that i can understand i those unqaulify people should be working in in british embasy called themselve ECO to handle people visa aplication and refuse people visa for stupid reason. I will advice anyone who feel they have been deniel unfairly to take the british embassy to court in uk not in nigeria. I will update the house again they have issue the visa or they choose to go to court with me to answer quarel.

Sorry, my wife is in nigeria and she will be aplying from lagos embassy italy. Pls advice if she will need to provide that requirement as her personnal document. Like i said i have do some research on the internet there is no such requirement on Eu national family member accept my personnel document as her husband who is the sponsor to provide evidence that show i am residing in italy and exercising my Eu treaty right by been self employe in the state.

Good morning everyone, pls advice me. I have just receive text from a friend contain italy visiting requirement. But what i do not understand is that on the text my friend said my wife will need to provide(1) 6months bank statement (2) payslips (3) health insurance (4) employment letter (5) visa fee. Becos i am a british citizen and my son british and i am living and working in italy exercising my EU treaty right becos i understand very well that if an EU national live and work in an Eu country there is free movement for the family member of EU national who is exercising the treaty right. But it since to me my friend does not have understanding of EU national requirement. To what i know is that if i aply for italy vissa for my wife she will be issue with EEA family permit visa becos i reside and work there. Helo my people pls does anyone have an ideal about italy visa process. I am british citizen and my son is british citizen, i iam living in italy and exercise my EU treaty right by been self employer. The reason why i move to italy is becos of the 18600pounds. Pls i would like to know as a british (EU national) if am required to legalise our marriage certificate and i also understand that people do pay N110,000 to italy embassy for a lawyer to verify the marriage. I understand as an Eu national exercising thier EU treaty right there is a free movement for EU family member like spouse. Pls does anyone know if i will be paying That amount to italy embassy? becos i have check the EU treaty right for free movement there is no such requirement.
