It seems you have hard time reading , didn't you see that doctor was never subpoena and the evidence was never presented in court

You need to calm down and stop allowing your emotion to dictate your behaviour .....it is getting erratic.

Maybe if you had taken enough time to read between the lines ,you wouldn't be arguing out of facts and evidences.

I’ve been in here since page 1 and I saw somebody ask you if your doctor was subpoenaed to court and spoke on your behalf and u told them yes.
I think the JD lady asked u that question to hook u up in a lie and it did work.

Nah we were talking about Dr. Acton

Dr. Acton was the DNA expert that I hired

The particular doctor I am talking about in this evidence is a medical doctor , ..... That was my alibi

If you check those newly.... shared document you will see the clinic name and phone number

When you travelled on tourism, when does it become a crime to do a little business when the opportunity presented itself

I bet you are aware that most Nigerian travel on tourist visa but ended engaging in other business ......

If you have ever applied for visa , you would understand that tourist visa is the easiest to be granted.

We need to address issues pertaining to the verdict and him being on a visit visa or what not was not part of it. Please let's not derail. We've derailed enough. Thanks

I do appreciate and accept the compliment, especially coming from you because you have a documented history of giving concise information, whether you were warm and fuzzy in the delivery or not.

There is a saying here in the US: if you are not here to contribute to the solution then you are here to contribute to the problem.

I kept that saying in mind as I navigated through the thread and dodged all of the insults hurled at me. And this thread is consistent of a pattern that I noticed on anonymous online forums long ago: the loudest, meanest, and most aggressive ones are also the most clueless and least helpful ones. The insults are a way of joining the discussion and “being seen” without having to think about something positive or helpful to contribute.

The irony? Posters who could not derive the truth or purpose from an 8 page document with clear answers to several questions within the first two and last two sentences are the same ones calling for me to be burned at the stake for not posting a 1200+ page transcript.
Imagine that. undecided

Ms. 1stGenAmerican ,

I want to ask you a question and I will like honest answer only please......

Does your husband stay on the phone call for 6minutes while making love to you?

Honest answer only........

I DARE YOU TO PRODUCE ANY EVIDENCE (videos, photos, testimonies, depositions whatever it may be..........) THAT CONTRADICT ALL EVIDENCES YOU HAVE SEEN ON THIS THREAD INCLUDING THIS PHONE CALL RECORD EVIDENCE..........

Being on the phone argument is weak, you could call my t-mobile line and get my voicemail, mute and the records will still show you were on the phone with me for even 10 mins.

There should be some stronger evidence than this phone record stuff.

If you are innocent of this crime, you will be vindicated.

I can imagine what you are going through....

Man I’m not stupid and I said it. U can go back and erase it but I pray somebody quoted it.

You don't have to feel sorry my friend....

If the evidences were never produced in court how could you bring in a doctor to testify to it?

Why don't you just go back and re-read whatever you saw, copy and paste it here.....?

My appeal is proceeding with or without you and the appellate court of Georgia does not really need your opinion to make decision.

So what is the purpose of lies......

Everything I have said on this forum ,I bd it up with facts...... The only problem you have is you don't like to read

The prosecution will have to prove the call was not successful ,however when you looked at the document of the record it was clearly written CALL SUCCESSFUL , what was only need was for therepresentative of AICA to acknowledge and testify to the call.

That never happened due to my attorney inefficiency but the facts remains though

If you check the timeline

The crime was already ongoing before the phone call started , so whether the call went to voice mail or not wouldn't matter .
The victim would see and know anyway

Dude u tell lies to everybody and u think u know everything. When people try to give u advise, u tell them better. If u knew better u wouldn’t be sitting in no white man’s prison for longer than Jesus and all his disciples lived added together.
We don’t believe ur lies and the court didn’t either. The court will never believe ur lies and all u doing is coming here to test out the lies on us like we are guinea pigs and lab rats.
U plan on walking in court with a box full of lies and u think those courts in America stupid. Like that JD lady said, they locked you up for all those hundreds of years because u tried to treat oyinbo like they were stupid but they showed u who was the real stupid one.

I still maintain that the argument is weak, call successful does not mean a conversation occurred, the people you are dealing with have seen it all.

If you end up on a person's voicemail, it will still say call completed, no one can prove a conversation truly occurred

Just out of curiosity, how long did you live in Japan for before visiting the US.

My understanding so far
1) Op filed a motion to dismiss the prosecutions DNA evidence/ testimony on the basis of how their findings were obtained.

2) The court ruled against that motion on the basis the prosecution demonstrated that the method has been used successfully in other cases and thereby should be considered verifiable truth.

3) The judge denied testimony from OP's DNA to refute the prosecution's DNA evidence, methods on the basis that the debate is a scientific one, and as such a lay person might not be able to follow such debates.

4) OP has said he was in a conversation ( phone) at the time the crime occurred.

5) His phone records show this, yet the defence failed to call in the witness ( his personal doctor) to testify to this fact.

6) Someone mentioned that finger prints would would have been lifted from the keypad which would have identified the op. However it is also plausible that since this a block of apartment where a keypad is required before entry and OP resided there, then naturally his print would be on there amongst others.

7) The victim specifically mentioned the perpetrators accent. Are there other residents within that building with distinct accents? Are there people of African descent in the building or is the OP the sole one?

I'm not for either side. But with what I have read so far, I am not sure " beyond all reasonable doubt " has been established here.

You must be ignorant of the court proceeding, you may need some lessons from the noise maker

How could a doctor/witness testified to an evidence that was never produced in court, what is wrong with your understanding bro?

I am telling you what you do not know ,instead of listening you called me a lair

In a criminal proceedings a witness can never testified to any any evidence that is not on record.

Hardly surprising, we Africans tend to live in clusters.

I'm curious, if there were males, were they ever considered suspects, or perhaps was any attempt made to identify ALL if any, black males who could have fit the description, or was the first person they came across apprehended I.e you.

How soon after the crime occurred were you arrested/ detained?

I was invited to the police station on a traffic stop only....and that happened just 2 hours after the crime was committed.
It was inside the police station a rape charge was leveled against me

There was no probable cause for my were on this charge at that time

I have been inside jail since then.....

All the documents I have shared here were produced by the police and prosecutor

These are the same edocuments I am using to prove my innocence

Very documents you have seen here came from the prosecutor, trial transcript and deposition

I have dared those who think I am guilty to produce any contradictory evidences that could disprove what I have shared....nothing ye

I've had a look and cannot find anywhere where you said your doctor( the one you were on the phone to) testified.

You have also been consistent with the timeliness you mentioned.( when you were arrested/when the crime occurred)

Two hours, isn't sufficient ( if one isn't caught in the act) or positively ID'd or if there is no confession to bring a charge against anyone. There maybe suspicion and as such you could have been detained but to level a charge?

No way that is enough time.

I'm not saying you are innocent or guilty, but so far, it doesn't seem that due process was followed. Due process takes time, something that seems to be absent here.

Seems to me that the decision was made by the police that you were guilty and that guided their subsequent actions as opposed to letting the evidence lead them to the suspect.( the end result could have still been the same.)

What if the person (his doctor) was allowed to testify that he was truly on call with him for the whole 6 minutes?

What I understand is that this JD woman has succeeded in making all of you believe this man is actually not innocent. Even with evidences he is providing. Meanwhile, I am waiting for her to answer the last two questions the op asked him with evidences to back it up.

To all the people that feel like I was lieing here
I have never said anything without backing it up with a facts / evidence
None of you could disprove me yet none of you wanted to believe me because you have allowed your emotions to crowd your sense of reasoning.

Why can't you just be objective in your analysis?

Everybody want jusdice to be served for this young lady but when you send the wrong person to the prison is that the type of justice you want?

If the prosecution believe that I committed this crime ,then why was the trial not fair?
Why did the prosecution withheld an evidence?
Why did the prosecution conspire with my attorney not to produced this phone call and GPS evidence?
Why did the prosecution protested and objected to in-court identification?
Why did the court prevented my DNA expert from witnessing to the jury?

Are those not what an fair trial is all about..............

I was suppose to be innocent until proven guilty however I was already guilty and now I'm proving my innocence
