He has a right to ask for his inheritance. What if the mother remarries? She takes the money to another man, and the sister too. It's just not right. It's possible the OP is still quite young. I want to assume you are not from these continent, however if you must know in africa esp.. Nigeria inheritance are for children
The wife/mother is duely compensated but naa the children get the property and will manage the property
In the event of no will, the 1st child is entitled to largest share, even the law recognises the 1st born

Compensated how? The house always belongs to the mother. She will live there till the day she dies. Other properties can be shared. Lastly the court will rule in her favour if there is no will.

Quick one! Did your dad die intestate? If no, did your family get Letters of Administration from the court?
In the order of succession where there is no will, your mother comes first before you and your siblings. So as family head, she has the right to sell the property. She however owes a duty to carry you along in both the sale and the proceeds of sale.

Well the house devolves first to her (your mom because she’s a spouse of the deceased and has more rights) I don’t suppose if they got a letter of administration before the said sale, still your name might not be there seeing that you have other siblings.

There’s nothing you can do really, as she has a legal right to the property.

I know people are talking trash but truth is that as a child of your father, you are entitled to share in the family wealth. Your mother cannot include your sibling & leave you out. Best thing is to get a property lawyer & file a claim. The court would likely mandate that they give you a share of the proceeds from the sale of the house, only if they don’t bribe the system now that they have money.

You better focus on building your own house. My Dad once told me that we should do joint investment...nope. The family wont realize it is joint once he is gone. Focus on your own life...You can do better than your father. I always told mine that. He is proud I have exceeded him.

Sorry for the embarrassment but from the look of things, you, your mum and your siblings are not in a good relationship

Is either you are not organize or you are a future problem child

I think you have to make peace with your family, starting with your mum before she can integrate you back into the family

With what is going on, there is no synergy between you and your family

Very soon, they will sell you without receipt

Go and make peace with your family and stop all these drama

It's your mother and father's home. After his death it's your mother's unless it was specifically trusted to you and you can prove it. You can not prove it that's why you are asking here. You didn't put the money up for that home nor did you maintain it. Only thing you did there was piss the beds. Get your money up and but your own property!

Stop insinuating that the OP is a prodigal son. Women are always scheming and very manipulative.
Something similar happened to me as the only son to my late father. My father died intestate so after his death I made a move to retrieve the credentials to his assets but unfortunately for me my mother (now late) conspired with my sisters to get hold of the credentials and keep it in their possession even before I thought about getting hold of the credentials. They were that wickedly sharp.

My sisters fueling the crisis tarnished my image to anyone who cared to listen but as God may have it as a perfect planner and grand schemer he made my late mum hand over all the credentials to my late father's property to me before she died. My sisters are still mad at me till date for having those credentials in my possession.

Life is a battlefield. Not even your own blood can be trusted to always have your back. My advice to the OP is to thread with wisdom from God. If it is the will of God for him, he will recover all what he lost as his inheritance from his scheming mother and sister.

So they made the move faster than you, correct? Then you coerced the mom to hand over to you. Did you split that with your sisters. If not maybe they were trying to avoid this exact scenario.

It's a father's responsibility to raise his kids well, and if possible, leave a strong legacy for them.

However, the legacy or inheritance part is not carved in stone!

Let me be a bit clearer...!

No father owes his kids a damn inheritance!!! Yes, you read that right!

What a father owes his kids is a proper and right upbringing.

Inheritance is more or less a bonus!

A serious child cannot and shouldn't focus and keep waiting for his or her share of the father's estate.

That's why no law is broken if the father wills everything to anyone he likes prior to his demise.


In my opinion I approve this statement. As a man you owe your children good upbringing and good education. Anything else you give your children na jara.

I don't know where OP is from, but I know that in Benin culture when the father passes on, the first son inherits the properties in the absence of a will.
