A federal high court has already given an order telling pdp to go ahead with the congress.since both courts are of coordinate jurisdiction, they nullify each other which means status quo remains meaning there's no judgment.so the Congress goes on

The judgements don't nullify each other. The aggrieved party has to approach the Court of Appeal to determine who has jurisdiction over the matter since there are 2 courts of separate jurisdictions who have ruled over the matter.

After the Appeal Court's decision, the aggrieved party can further proceed to the Supreme Court.

Status quo remains which means, since the congress has not already been held, all parties have to wait for the court of Appeal to determine whether it should hold or not.

But the same Rivers state High court presided over by Justice O. Gbasam upheld the suspension of Secondus as National Chairman in 2021 after his ward usurped a power they do not posses by suspending him

We play too much in this country. If a Rivers state High court could upheld the suspension of Secondus, why can't the same court restrain PDP from going ahead with the it's congress in Rivers state

https://www.google.com/amp/s/www.vanguardngr.com/2021/09/court-upholds-suspension-of-secondus-as-pdp-chair/amp/

In the same vein, it was a similar State High court in Benue that also upheld and affirmed the suspension and removal of Ayu as PDP national chairman on the basis of the kangaroo suspension from his LGA. https://www.premiumtimesng.com/news/top-news/602154-court-sacks-suspended-pdp-chair-iyorchia-ayu-as-party-member.html

If the State High court can assume such jurisdiction, the same court also have same jurisdiction to stop the Congress. Mind you the State High court and Federal High court are of coordinate jurisdiction, just that there are certain issues both courts cannot entertain based on constitutionality.

Sir, unless there is a counter Court process since the abuse has started already, the PDP will not hold a Congress in Rivers.

Answer the questions asked above since State High Courts do not have jurisdiction for Congresses.

Ask why the Supreme Court ruled that Rivers will not have a Candidate for all positions in 2019? It started like this.

A State High Court gave an order, yet APC proceeded with the Congresses, it went along to the SC. That's what will likely happen since the rumour is that the Gov is readying LP.

That is it PDP would be destroyed in Rivers State and the governor moves to another party towards elections circle let Wike test is popularity

So this is how Fubara wants PDP to hand him the party structure?
Fubara wants them to obey state high court but he will not obey supreme court order.
Why did he not appeal the federal high court ruling?

There is no aggrieved party here

There is at least one aggrieved party here:

The people who were authorized to hold a congress have suddenly been stopped by a State High Court.

They now have two valid orders from 2 courts and none is above the order in terms of hierarchy, the courts just have separate jurisdictions.

It is only a higher court, in this case the Court of Appeal, who can determine which order they should obey. They are not allowed to take laws into their hands.

What's the NJC doing about Judges that issue & counter-issue orders thereby making an already confusing situation even more confusing?

Status quo remains which means, since the congress has not already been held, all parties have to wait for the court of Appeal to determine whether it should hold or not.

The courts does not work that way. If it does, anyone that loses a matter at any court can approach another court to give him a favourable ruling on the same subject instead of appealing.

The Sim group committed a grave error in this matter. They obtained an exparte order from a state high court on the 16th of July restraining PDP from conducting the Congress. The order expired after 7 days and was not renewed for reasons best known to them.

The Wike group then immediately got their own order from a federal High Court to conduct the Congress. What the Sim group did today by going to another state high court to get another exparte order is an effort on futility because the order of the federal high Court is still subsisting.

Have you asked yourself why they didn't approach the first judge that gave the restraining order on the 16th? I have heard that the order was supposed to have even renewed for another seven days but for internal sabotage.

I think the Congress will still go ahead. Afterwards, the only option would be for the Sim group to approach the Appeal court. For the result, your guess is as good as mine.

I don't know why Fubara is just behaving childishly.

The state High court has no jurisdiction to entertain such but only the federal high court.

The Federal High Court already giving PDP go ahead to conduct its Congress in Rivers state.

What is the meaning of this injunction when the Rivers ODP will surely go ahead with the Congress.

Fubara has lost his sense jare
