So this is why Tinubu told Fubara that the rule of law must be upheld and court judgements must be obeyed,he knew this was coming.

If you take a closer look at this whole thing, Fubara seems to be on the losing end.

Fubara has been getting favorable judgements from the state court, which is expected. Wike and his gangs have been getting favorable judgments from the federal high court, which is also expected due to his connection.

In the long run, the federal court judgement is what counts. This is because if the case gets to the Supreme Court and this Wike guy is confirmed as the speaker, then Fubara is gone.

Wike’s men will move like a lightning bolt to impeach Fubara. Once he gets impeached by the pro-wike men, the show is over. Nothing the state courts can do about that.

The Nigeria police is federal. They will move swiftly to enforce the judgement. No amount of protest or violence can return him back as governor.

We all should learn to chose our fights wisely.
Fubara mistakes was to listen to emotional peoples. You don't have the control of the house of assembly and you are fighting.

PRESS RELEASE

Today, the 10th day of October 2024, the Court of Appeal, Abuja Division dismissed Appeal No. CA/ABJ/133/CS/2024 filed by His Excellency, the Governor of Rivers State against the judgment of the Federal High Court, Abuja Division in suit No. FHC/ABJ/133/CS/2023 delivered on the 22nd day of January, 2024.

It is important to state the facts and history of the case and the appeal thereof.
On the 30th day of October, 2023, after the failed attempt to impeach His Excellency, the Governor of Rivers State, the Rivers State House of Assembly became polarized into two factions. The faction led by Martin Amaewhule proceeded to the Federal High Court, Abuja Division and filed Suit No. FHC/ABJ/1613/CS/2023, on the 29th day of November, 2023.

Subsequently, on the 11th day of December, 2023, Martin Amaewhule and others defected from the Peoples Democratic Party that sponsored their election in the 2023 Legislative Assembly Election, to the All Progressives Congress.

By operation of Law, particularly Section 109(i) (g) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), Martin Amaewhule and 26 others automatically lost their seats as members of the Rivers State House of Assembly on the 11th day of December, 2023, as Section 109(1)(g) is self executory as no court order is required thereof.
His Excellency, the Governor of Rivers State on the 13th day of December, 2023, presented the 2024 Appropriation Bill to the Rivers State House of Assembly, led by Rt. Hon. Edison Ehie, who was recognized as the Speaker of the Rivers State House of Assembly at the time. The Appropriation Bill was later passed into Law and became the Appropriation Law of 2024.

An Appropriation Law is a state law within the purview of the High Court of Rivers State.

Following the crisis in the Rivers State House of Assembly and the intervention by the President of the Federal Republic of Nigeria, that the parties withdraw their cases in Court, to allow peace reign, His Excellency the Governor of Rivers State obeyed the President’s directive and withdrew his cases and the processes he filed in Suit No FHC/ABJ/1613/CS/2023. Martin Amaewhule and others disobeyed the President and did not withdraw Suit No. FHC/ABJ/1613/CS/2023 and proceeded to obtain judgment against His Excellency, the Governor of Rivers State.

After the judgment of the Court of Appeal today, there is a gale of misrepresentation and misinterpretation that Martin Amaewhule & 26 others remain members of the Rivers State House of Assembly with Martin Amaewhule as the speaker thereof. This is patently false.

The defection of Martin Amaewhule and 26 others was not an issue for determination in the Federal High Court, Abuja and the Court of Appeal. What was in issue was the 2023 Appropriation Law and the National Assembly taking over the Legislative functions of the Rivers State House of Assembly.

Dissatisfied with the judgment of the Court of Appeal, Abuja Division, His Excellency, the Governor has directed his lawyers to file an appeal against the judgment of the Court of Appeal to the Supreme Court and also file an application for stay of execution of the judgment of the Court of Appeal. That maintains the status quo.

Accordingly, His Excellency, the Governor of Rivers State urges the good people of Rivers State to ignore the purveyors of fake news bent on misleading the good people of Rivers State.

Please who will impeach him? Does impeachment start and end at the hallowed chamber of the state house assembly. The state chief judge is waiting for them. Abi no be him go constitute panel for the impeachment?

you dont get it, This particular case when it is decided by the supreme court and Fubara lost which is sure because he withdrew all his counter Affidavit that would have convince the Judges, after losing at the supreme court, that case you are talking about will be a dead rubber, because supreme court would have decided the speakership of Amaewhule and further declare the 26 lawmakers who are part of the originating summons from the lower court as authentic members of RSHOA....what you people lack is that there are more than one ways to reach the market. issue of defection has been sidelined in the High courts and can never come up again since appeal court which is higher has taken over....from Now on, Amaewhule as the Authentic speaker will start deliberating onthe impeachment proceedings

This is going to be a long movie/show. I fear for Fubara. If this case should go to the Supreme Court, I fear Wike will use his influence and if the Supreme Court should also affirm the appeal court ruling, Fubara might not even finish this term, talk more of re-election.

I understand that he became the governor with the help of Wike, but that doesn’t mean he has to bow or get instructions from him on how to rule the state.

Wike has done his time. No one disturbed or fought him during his administration. Fubara should be given a free hand to operate.

But again, Fubara brought this on himself. I’m not privy to the agreement between him and Wike. If he entered any agreement with Wike, I believe he was fully aware of it before he agreed. He should honor the contract they both agreed. The fight between them started too early.

I don’t pity Fubara. He knew what Wike was capable of before agreeing to whatever deal they had. If he knew the conditions attached to Wike’s support is something that doesn’t make sense, why agree to it in the first place, only for you to turn back in the middle of the deal.

I only pity the people of Rivers state that are being denied good governance.

When two elephants fight, the grass bears the brunt.

A word of advise for everyone - don’t enter into an agreement or contract you know you won’t honor.
This is where I expected Fubara to have used his wisdom by following Wike this term and then turn on him after winning the second term.

Wike actually thought Fubara would be easy to handle, considering his looks, but he proved him wrong.

Thanks my brother , this is more grounds to speedup is impeachment process because Rivers State are yet to present 2024 budget and can't jumped to present 2025. Law is Law and doesn't know emotions interpretation and watch how Victor Jombo will run for his dear life to avoid jail term
