Yes work in UK

No. £36,000 was the amount earned via salaried employment in last 12 months, other than the last six weeks whilst not working there. It I had worked the last six weeks that amount would have been £40,000.

Good afternoon
I have been very impressed by some of the contributions made to some of the questions here on this forum so I am hoping that you could help me with my question.

Our first FLR (M) is due to be submitted at the end of new week.

However I have a question with what meets the specified amount.

We need to achieve the £18,600 requirement but unfortunately I lost my job about six weeks ago.
Up to that point I was earning £40,000 per annum and would normally applied using Category A.
However, since I am no longer employed I will have to apply using Category B.


If you look at section 5.2 of the document below it refers to salaried employment at the point of the application which in my case is zero.

However I have achieved 5/6 of the last six months (£16,666) and 6/6 of the previous six months (£20,000) which basically means I have earned £36,666 in the last twelve months.

The example (c) in section 5.2 applies to somebody who is self employed but meets the requirements.

I am at the moment interviewing for jobs at a similar salary but it may be that an offer of employment has not been before the submission deadline.

My wife works full time and earns around £12,000 per annum (hourly paid).
Should this be added to the application under Category B too?

From the information that I have supplied via the link and my situation do you think that the requirements for Category B will be made as there is nothing to cover my circumstances for short term unemployment for relatively high earning salaried employees when making an application?

My wife's application was also granted yesterday after a 2nd fresh application. Thanks for all the advice I have been reading on here since the start of January.

Thanks for the information with regards to where the visas go for processing. That explains why it takes two weeks for the payment to be processing based on the time the diplomatic post takes to get to Sheffield and then the four weeks for it to return back after getting processed. I always thought that new applications sit on some bodies desk for six weeks!

Please note that there is a new procedure for submitting settlement visa apications from 1st May.

It means that the documents now need to be sent to the UK rather than submitting at drop off centre.

I do not think your application is deemed complete untill it is duly paid for and all supporting documents forwarded to the visa office. Therefore you may have to pay the new fee, else your apllication may not be treated.

The point here is: you can use the old forms till April 27th, but the new fee took effect from April 6th. Consequently, if you did not pay the application fee before April 6th, I'm sorry you may have to pay the new fee if you want your application to be treated.

So does that mean if you have printed the pre 6th April form it is only valid until 26th even though the application was submitted online before 6th April. I thought you have 60 days to submit the documents once the application is submitted online or are we saying that this rule does not apply whilst these changes are taking place. It is not clear on the UKBA website.

Could anybody explain the new rules with regards to application forms? It states that old level forms can be used up to 27th April. If you have applied on line before 5th April but not physically submitted your documentation at the drop off centre does this still apply or it is just for uncompleted online applications? Also the price shown was that of the pre 5th April. Does it mean that I pay the old price or the new price even though it was submitted on line but not physically paid for at the drop off centre yet?

Thank you again for the information. Just a couple more questions now. What documents do ECO's like to see to cover "intend to live together permantly together in the UK?" And secondly if you do appeal and then change your mind, how long do they take to acknowledge this and do you loose you payment if you do?

If you provide all the relevant documents to tackle the ECO's points that would be great. Appeal take 6 to 9 months, earliest is 5 month. Reapplying is faster. Cheers.


Thanks Lamosy. I suppose it is just a case of weighing up the difference between the additional cost of reapplying to that of the extra time. The points the ECO pointed out refusal letter are easy enough to obtain information on even though i had the original documents approved by an immigration barrister - but that is another story! Have you heard of any quicker cases? Also have you heard of cases where people were sure that they had supplied everything they could and still needed to go to appeal hearing?

Just a general question. From the point of submitting an appeal for UK spouse visa, when just additional documents are required to satisy the case as outlined by the ECO's refusal and being overturned by the ECM, typically what range of times are people experiencing here for the whole process?

Yes emails, Skype, Nimbuzz and facebook. The immigration arrived the documents for the telephone even with no final destination number on it the bill. They mentioned nothing to me to add all the other things. Needless the say I screen dumped every bit of chat history now and will file them with the appeal. The visa was not just rejected on that. The other reasons were that ownership of the house in the UK was not submitted even though utility and council tax bills were and also there was not letter from employer in UK verifying payslips and the same with bank statements even though again the immigration barrister had approved these documents. Now asking for UK calls record from pay as you go mobile in UK. Hopefully the appeal will get through now once these are resubmitted and will only need to go to ECM level to reverse decision.

Thanks for your response as it is a Spouse visa.
I have one more question with regards to using international calls.
On telephone bills it only shows the number of the number used to dial the cheap international call but no full destination number of the call. The company offering the cheap international will not disclose these numbers to me as I have contract with them and am not too hopeful that the service provider will do the same. How do go about obtaining the final destination numbers to prove that you have been making regular contact as this was the reason why the visa was rejected?
