Oshiomhole warns against commercialisation of party’s primaries

Benin City- Governor Adams Oshiomhole of Edo State  yesterday in Benin warned against the commercialization of party primaries by the leadership of his party, the Action Congress (AC), lamenting that this has been the vogue of party leaders in the past which should be consigned to the dustbin.

According to the governor who spoke while receiving two members of the House of Representatives Messers Samson Osagie and Patrick Obahiagbon who defected from the Peoples Democratic Party to the Action Congress, aspirants to the various elective positions should keep their gun powers dry until the leadership of the party comes with a calendar on how the party primaries would be conducted.

“It is not yet time for electioneering. I will continue to appeal to our people to wait for the party to roll out the guidelines. There is no point starting a race before they ringed the bell because you may exhaust your fuel before the race begins, If you exhausts your fuel before the race begins, you will find out that you have not done yourself much good”. “I think at this hour we are still building the party, we are strengthening the party and we are re-focusing the party so that we can win every election. When the party leadership decides on the calendar, of course, the stage will be opened”. “Our commitment to One Man, One Vote means that power is in the hands of party members. But we expect them to use them judiciously. No monetization of primaries because that is not what One Man, One Vote represents. For our candidates as well as party leaders, you should resist the temptation of monetizing or commercializing the primaries.

When considering an award of exemplary damages in respect of the oppressive, arbitrary or unconstitutional conduct of government officials where the conduct complained of was considered by the court to be outrageous, it was not necessary to show further that the outrageous conduct disclosed malice, fraud, insolence, cruelty or the like.
The Court of Appeal so stated in (1) allowing the appeal of the defendant, the Secretary of State for the Home Department, from the decision of John Leighton Williams QC [2009] EWHC 1886(QB) that the unlawful detention of the claimant, Abdillaahi Muuse, had arisen from misfeasance in public office by officials of the Home Department and (2) dismissing the Secretary of State’s appeal from the judge’s award of exemplary damages in addition to basic compensatory and aggravated damages in respect of the officials’ “reckless indifference to the probability of causing injury to” the claimant. The claimant was a Dutch national born in Somalia who had been unlawfully detained for 128 days on the orders of immigration officials pending deportation to Somalia in circumstances where there was no right to deport.
THOMAS LJ said that, in order to establish misfeasance in public office, the claimant had to establish that those acting for the defendant Secretary of State had detained him (i) in the knowledge of, or with reckless indifference to, the illegality of their actions; (ii) in the knowledge of, or with reckless indifference to, the probability of causing injury to him. It was common ground that the judge had made the second of those necessary findings. However the defendant contended that the judge had failed to make the first finding . He submitted that in order to establish the tort of misfeasance in public office the judge had to find that the officials acting on the defendant’s behalf had been recklessly indifferent to the legality of their actions. This had to be a finding of subjective, not objective, indifference.
In His Lordship’s view it was clear that the judge had not expressly made that finding although plainly there had been evidence on which he could have reached that conclusion. There could be no doubt that, if such a finding was to be made, the judge should have made it expressly. His Lordship regretted that, as it was not a finding that could be inferred as inevitable from the primary findings made by the judge, he could not conclude that the judge must have made such a finding by necessary implication.
The judge had set out the factors which in his view justified a “significant punitive award”. The defendant accepted that there did not need to be a finding of misfeasance in public office before an award of exemplary damages could be made, as it was common ground that it was “oppressive, arbitrary or unconstitutional action by the servants of the government” which were the conditions for such an award: see Rookes v Barnard [1964] AC 1129, 1226 per Lord Devlin. The defendant contended that no award should have been made, as an award in respect of such conduct should only be made where the conduct was “outrageous, disclosing malice, fraud, insolence and the like”: see McGregor on Damages 18th ed (2009), para 11–019. His Lordship referred to Holden v Chief Constable of Lancashire [1987] QB 380, 387–388, per Purchas LJ, AB v South West Water Services Ltd [1993] QB 507, 529 per Sir Thomas Bingham MR and Kuddus v Chief Constable of Leicestershire [2002] AC 122, para 89, per Lord Hutton. The guidance given by Sir Thomas Bingham MR and Lord Hutton was sufficient. There was no need for this to be qualified by further looking for malice, fraud, insolence, cruelty or similar specific conduct. There was no authority that supported Dr McGregor’s view to this effect. There were a number of factors that showed that the unlawful imprisonment of the claimant in this case was not merely unconstitutional but an arbitrary exercise of executive power which was outrageous. It called for an award of exemplary damages by way of punishment, and to deter and to vindicate the strength of the law.
SIR SCOTT BAKER delivered a concurring judgment.
SIR ANDREW MORRITT C, agreeing, said that the circumstances indicated demanded an urgent investigation and action by the Secretary of State.

Not worth staying in hotels in small towns like Isele-ukwu. Many offer crappy services. Its even a hassle to find decent ones in Agbor.

There is a hotel in Agbor that is far better than the ones in Benin City.

Court orders reopening of Assembly, restrains Garuba

THE crisis that has engulfed Edo State `House of Assembly since Monday continued yesterday with the election of Bright Omokhodion, representing Esan West Constituency as the new Speaker and Paul Ohombamu (Egor Constituency) as Deputy Speaker.

The Action Congress (AC) - the party which governs the state - through a correspondence read by the new Speaker, also nominated Philip Shaibu, Etsako West II, as Majority Leader and Patrick Osayeme, Oredo II as Minority Whip.

But the Zakawanu Garuba, the erstwhile Speaker, in a swift reaction told The Guardian that he remained the legitimate occupant of the office, saying he was not properly removed. He said his "purported removal through a purported impeachment letter" claimed to have been signed by 16 members was not true contrary to Section 92 (2) of the 1999 Constitution, which he said stipulates that the Speaker and the Deputy Speaker can only be removed through a resolution of the House with at least two-thirds majority. He said there was no evidence that they actually had 16 signatories as required.

"They are the ones that went to court to say that we have been removed and we are saying that we were not removed as enshrined in Section 90 (2) of the 1999 Constitution. Whatever they are doing is a nullity because it is yet to be decided whether they met the requirement, 13 is not 16. It is only when an office is vacant that you can fill it. They cannot take action on issues that are matters of litigation, which the court is to decide on", he said.

However, an Edo State High Court sitting in Benin City has restrained Garuba and Levis Aigbogun from parading themselves as Speaker and Deputy Speaker.

Justice Esther A. Edigin, of Court 4, also restrained the State Police Commissioner from sealing off the Assembly.

In suit No. B/114/05/2010, the plaintiffs, Peter Aliu, Speaker Pro-tempore and the House of Assembly, had asked the court, through their counsel, K.E Mozia and Enahoro Aghomo, to restrain the defendants until hearing and determination of motion on notice for interlocutory injunction.

The court also restrained the 3rd defendant, the Commissioner of Police, either by himself, or through police officers or policemen of Edo State or any other police command from sealing off, further sealing or further preventing or continuing to prevent the 1st plaintiff, legislative and administrative staff of 2nd plaintiff, from having unlimited access to the premises of the Assembly pending the hearing and determination of the application praying for similar interlocutory reliefs.

Meanwhile, two other members of the House from the Peoples Democratic Party (PDP), Adesotu Christopher and Ereghan Edosele, have denied signing the document used to remove Garuba on Monday. They said in separate statements made available to journalists that the remained committed to the PDP and the authority of the House of Assembly "under the able leadership of Zakawanu Garuba as Speaker."

But it was not all that easy for the 13 AC lawmakers to meet at the hallowed chambers as their initial move into the assembly complex was resisted and they were not allowed entry by heavily armed policemen who have taken over the place since on Monday. Despite being armed with the court injunction, the lawmakers were turned back by the police who claimed they had not been directed by their superiors to allow them in. The teeming supporters of the AC who thronged the assembly complex became agitated over the refusal of the police to open the gates, but they were repeatedly prevailed upon to remain calm.

There was however a mild drama when gunshots were fired about 200 metres from the assembly complex, believed to be by unidentified thugs. The AC supporters later chased them away.

The lawmakers later met with the Commissioner of Police Kachi Udeoji and at about 1. 50 pm, the police opened the assembly complex's gates for sitting to commence.

The Pro-tempore Speaker, Aliu, representing Etsako East Constituency was led into the chamber at 2.10 pm by the Sergeant-at-arms and accompanied by his colleagues, with Johnson Oghuma wearing a heavy bandage on his head and crutches, apparently as a result of the Monday fracas.

By 2.13 pm, members said the opening prayers led by Jude Ise-Idehen and immediately after that, the Clerk read the Order Paper where the election of a Speaker and deputy were announced. Etiosa Ogbewi, representing Orhiomwon II nominated Omokhodion for the office of Speaker and was seconded by Shaibu. There was no second motion and at exactly 2.25 pm, he subscribed to the oath of office as Speaker and Aliu immediately vacated the seat for him.

Thereafter the new Speaker, whose attempts to announce his defection from the PDP to the AC was not recognized, causing the fracas on Monday, called for nominations for the office of Deputy Speaker. Jude Ise-Idehen nominated Ohombamu, seconded by Kabiru Adjoto of Akoko-Edo Constituency I.

The House thereafter went into session, where a committee was set up to investigate- Frank Okiye and Blessing Agbebaku - members that were suspended who were accused of bringing dangerous weapons into the Assembly chambers on Monday.

The House thereafter said it was suspending its House rules and announced some decisions. First, the House of Assembly Service Commission was dissolved, and also confirmed the nominees sent to the House since last year for membership of the State Universal Basic Education Board (SUBEB). The issue had been the subject of litigation by former members of the board who headed for the court to challenge their dissolution by Governor Adams Oshiomhole.

The House also confirmed the report of the Commission of Enquiry set up by the governor to investigate suspended chairman of Oredo local government council and confirmed the suspension of the chairmen of Akoko-Edo and Orhiomwon councils.

The House also confirmed the dissolution of the board of the Edo State Oil and Gas Commission.

Members of the Commission only two weeks ago secured a ruling from a High Court that declared the dissolution improper, since the members were yet to serve their statutory term in office.

Shortly after sitting was adjourned at about 4.00 pm yesterday, thousands of AC supporters broke into jubilation around the city, despite a downpour.

BENIN CITY-HELL was let loose at the hallowed chambers of the Edo State House of Assembly Monday, when members of the Peoples Democratic Party (PDP) and the Action Congress (AC) members in the House, threw caution to the winds in a free for all fight.

The Action Congress lawmakers resumed sitting after the fracas, impeached the Speaker, Zakawanu Garuba and swore in Mr Peter Aliu, representing Etsako East as the Acting Speaker.
Three AC lawmakers Shuaibu Philip, Johnson Oghuma, Kabiru Adjoto sustained serious injuries in the fracas. One of the lawmakers used axe to cut Oghuma’s head while they were struggling to get possession of the mace.

However, Zakawanu who addressed newsmen after the AC lawmakers concluded proceedings, described the impeachment as laughable, saying that he still remains the Speaker of the House. The PDP in the state through its chairman, described the action as “a failed coup”, saying that “they need 16 members to impeach the Speaker but they were not able to get it and they decided to cause trouble in the state”.

The state Government through the Special Adviser to the Governor on Political Matters, Mr Charles Idahosa, absolved the state government from the fracas, saying that “it is an internal affairs of the lawmakers to change their leadership any time they want. Thank God the Governor is not even in town when this thing happened but you will see them running their mouth that it was the Governor who instigated it”.

Trouble started when Speaker Zakawanu said that all that was read by the Clerk of the House, Bar. Egbe Evbuomwan was a true reflection of what transpired in their last proceedings and that they should proceed to the next item on the list.

But Bright Omokhodion, a PDP lawmaker and other AC members disagreed, and told the Speaker that what was read was not the true reflection of what happened.

There was pandemonium at this level, the AC lawmakers went for the mace, and in order to stop them, a lawmaker brought out an axe and another one brought out a tear gas canister and the lawmaker with axe rushed Oghuma and cut his head with the axe. Oghuma is the AC lawmaker that recently won the House of Assembly re-run election in Etsako Central Local Government Council of the state.

There was blood stain every where as the lawmakers engaged in a free for all fight. After the drama, the PDP members left the House of Assembly premises. But the AC lawmakers and a PDP lawmaker, Bright Omokhidion who immediately defected to the AC, continued proceedings.Omokhodion’s defection now gave AC 13 member majority while PDP now has 11.

However, the lawmakers who sustained serious injuries were rushed to the Central Hospital for treatment.
They joined their colleagues after receiving treatment at the hospital. Oghuma came back with a nurse standing behind him while proceedings were on. Shortly after the Clerk of the House, Barr. Evbuomwan swore in Peter Aliu as the

Acting Speaker, Mr Omokhodion informed the House of an impeachment notice on Speaker Zakawanu Garuba and his deputy Levis Aigbogun, quoting section 92 sub section 2© of the 1999 constitution, “ and rule 66 of the Edo state House of Assembly”.

“This petition contains numerous allegations bothering on abuse of office, misconduct, tyrannical tendencies on the part of the leadership of the House and it is signed by 16 members of the House”. He consequently presented the report to the Acting Speaker.

The members suspended Frank Okiye, Blessing Aigbaku, and Zakawanu Garuba. Blessing and Okiye was accused of being suspended for bring in arms into the House. A three men committee was set up to investigate the allegations against the suspended members and report back to the House next Monday.

Reacting Zakawanu said that “ it was not surprising that hoodlums came inside here to take control of the House. No body saw any impeachment notice. I am still incharge you can see that I am still in my office. We must bring order to this state”. However the Clerk of the House, came later to say that he swore in Aliu under duress when he spoke to newsmen.

The speaker of the Edo State House of Assembly, Zakawanu Garuba and his deputy, Levis Aigbogun (both of the Peoples Democratic Party) were impeached from office by 16 members during a raucous and violent assembly meeting yesterday in Benin City.

The house later replaced the men with Action Congress lawmaker, Peter Usman Aliu who will act as speaker protem pore until elections are held into the office.

Moving the motion for the impeachment of the house leaders, the minority leader of the house, Paul Ohonbamu said the action was sequel to some allegations of fraud and financial impropriety, among others, levelled against the duo.

The sacked officials were also, along with majority leader of the house, Frank Okiye (Esan North East constituency 1 and Blessing Agbebakun, representing Owan West constituency) suspended indefinitely from the assembly for bringing arms into the chambers of the assembly.

Three camps emerge as PDP infiltrates Senate

Aondoakaa (SAN) Senators are divided over the President’s fate.

Members reconvene today to debate the report on a meeting between the Attorney-General of the Federation, Mr. Michael Aondoakaa (SAN) and some lawyer-senators over President Umaru Yar’Adua’s refusal to handover power to Vice President Goodluck Jonathan.

The debate will focus on whether Vice-President Goodluck Jonathan should be sworn in or not as acting president.

Investigations by The Nation revealed that the report has recommended that the judgment of the Chief Judge of the Federal High Court, Justice Dan Abutu, should subsist for the Vice-President to exercise presidential powers.

Besides, the report advised the Senate to come up with a resolution advising the Federal Executive Council to allow the VP exercise presidential powers.

Although only Senator Audu Idris Umar from Gombe has a copy of the report, it was gathered that those seeking Jonathan’s inauguration have got a hint of the recommendation and the split at the AGF-lawyer-senators’ meeting.

The 109-member Senate has broken into three camps, with principal officers pitching tent in different groups.

The groups are those for Yar’Adua; pro-Jonathan; and the undecided.

While the Yar’Adua Group is standing by the judgment of the Federal High Court, the pro-Jonathan senators, who began an emergency meeting last night in Abuja, have vowed not to accept the report.

A confidant and friend of the President, Senator Ibrahim Ida from Katsina State, is leading the lobbying to save Yar’Adua’s job.

Apart from personal discussions with each Senator, Ibrahim is said to have been meeting all caucuses in the Senate.

A highly-placed source said: "We are set for a serious battle in the Senate over the report. All the groups have been meeting to re-strategise on the way forward.

"The President of the Senate, Chief David Mark, seems to appreciate the division and he has been using his foot-soldiers in the Senate to calm frayed nerves.

"I think to avoid a rowdy plenary; the Senate might still opt for an executive session to consider the report.

"But the fact is that the tension is high now over the report. Most senators returned to Abuja on Monday instead of Tuesday for horse-trading."

Findings by our correspondent revealed the identities of those in the three camps.

Those standing by Yar’Adua include some ex-governors in the Senate such as Ahmed Makarfi (Kaduna), George Akume (Benue), Ahmad Sani Yerima (Zamfara) Kabir Gaya (Kano), Maina Maaji Lawan (Borno) and Joseph Akaagerger (Katsina).

Others in the group are: Senate Leader, Teslim Folarin, Deputy Majority, Mohammed Maina, Hajiya Gbemisola Saraki, Mohammed Ahmed, Simeon Ajibola, Umaru Dahiru, Ayo Arise, Nicholas Ugbane, Yisa Braimoh, Odion Ugbesia, Garba Yakubu Lado, Tanko Ayuba, Tafida Argungu, Ibrahim Mohammed Ida, Suleiman Adokwe, Adamu Garba Talba, Hassan Gusau, Sahabi Alhaji Yau, Dahiru Gasol and Ahmad Ibrahim Lawan.

The pro-Jonathan group includes: Deputy Senate President Ike Ekweremadu, Bala Muhammed, Smart Adeyemi, Ehigie Uzamere, Abubakar Gada, Heineken Lokpobiri, Bassey Ewa-Hensaw, Isiaka Adeleke, Satty Davies Gogwim, Olorunninbe Mamora, Munir Muse, Ganiyu Solomon, Omar Hambagda, Grace Bent, Victor Ndoma-Egba, Eyinnaya Abaribe, James Manager, Sidi Ali, Suleiman Nazif, Mohammed Mohammed, Adamu Mohammed Sidi Ali, S.N. Anyanwu and Chris Anyanwu.

Others are Nuhu Aliyu, Chris Ola, Danlami Ikenya, Bode Olajumoke, ex-Governor Bukar Abba Ibrahim (Yobe), Andrew Babalola, Aloysius Akpan Etok, Effiong Bob, Anthony Agbo, Uche Chukwumerije, Annie Okonkwo, Joy Emodi, Ikechukwu Obiorah, Paulker Emmanuel and Nima Bangha-Amanze among others.

The undecided Senators are Iyiola Omisore, Zainab Kure, Dahiru Awaisu Kuta, John Shagaya, Lekan Mustapha, Otaru Ohize, Anthony Mazo, Mujitaba Mallam, Patricia Akwashiki, Abubakar Sodangi, Sola Akindele, Jibril Aminu (rated as passive to the issue), Kaka Malam Yale and Gyang Dantong.

A source in the pro-Jonathan camp, who spoke in confidence, said: "The report of the AGF-lawyer-senators’ meeting is already known to us, despite the fact that it is being hidden. We are going to insist that the report cannot stop us from pushing for the inauguration of the Vice-President as acting President.

"If you ask the Senate to stand by the judgment of the Federal High Court, the Vice-President is still a VP no matter the presidential powers vested on him.

"We are saying that we need an acting president, not a vice-president. For what reasons would anyone say that a VP cannot act as president.

"More senators have resolved to insist on the inauguration of the VP as acting president. Even people that we thought will not join the pro-Jonathan group have signed up for the inauguration of the Vice-President.

"We are going to meet on Monday night to fine-tune our strategy for Tuesday’s meeting."

Responding to a question, the source added: "For what purpose; we won’t chicken out. Our case for Jonathan is based on personal conviction that this nation must move forward."

As at press time, it was gathered that the Peoples Democratic Party (PDP) has infiltrated the Senate.

The PDP is said to be using a second term ticket as weapon of blackmail against its members in the Senate.

Another Senator said: "I am aware that the PDP has reached out to some senators from its fold with a threat that they may lose a second term ticket if they do not support Yar’Adua.

"Some of these PDP senators are afraid because the Supreme Court had given a judgment which says a party has the responsibility to choose its candidate for any poll."

Its no crime being ambitious! but you need efforts to make it come to light.
The mistake Nigerians are always making is selecting one for an elective position in the country without cross checking credentials.
The poster with all his tall ambition have never in life render any self less service to the people other than the mandatory NYSC.He has never got involved in student politics or affiliation with any departmental politics etc.
Conducting your business in China is not enough to have a solution to problems in Nigeria.House of Rep is about policy making on legislative affairs and possible oversight function.
From political experience Poster should go through Executive political position where he can take executive decisions that affects the lives of his people.(Local government chairmanship,supervisory position at the council,State commissioner etc).
You need to actually understand government policy for you be a successful politician.In your item 5,Fertilizers are always subsidized to farmers and allocated to various states of the federation for distribution and sales to farmers.But how its been manage by various states is a different executive issue.

Oshiomhole The political grip of the Chairman of Nigeria Ports Authority, Chief Tony Anenih on Edo State politics has again been severred with yesterday’s defeat of his party, the Peoples Democratic Party, PDP at the Etsako Central Constituency re-run election . The party of the Edo State Governor, Adams Oshiomhole’s Action Congress, AC won the election.

Observers say the election stands in recent history as the first peaceful election to be conducted where no single gun shot was fired either from the police or from hired thugs.

The defeat suffered by PDP was also the last hold of former deputy governor of the state, Chief Mike Ogiadomhe on Etsako Central Local Government Area of the state as he was defeated in his ward.

After collating the results, the AC won in eight wards while the PDP won in two wards.

The AC won in ward 1, 2, 3, 6, 7, 8, 9 and 10 where it had 624, 915, 498, 1024, 743, 2076, 566 and 497 votes respectively while the PDP had 443, 466, 326, 291, 75, 402, 242 and 268 votes respectively. The Edo State Commissioner for Information, Mr Abdul Oroh told The Nation on phone that the election was very peaceful. He said the AC govenrment was committed to the philosophy of ‘one man one vote’ as agains the bizzare tradition of rigging and declaration of phontom results.’Nigeria will change for the better if we allow the people to chose their leaders in a free and fair election’ he said.

The two wards won by PDP were ward 4 and 5 where it scored 762 and 336 respectively as against the AC which had 677 and 265 votes.

Declaring the AC candidate winner, the Electoral Officer stated: "This is an election keenly contested by three candidates. 29,971 were the total number of registered voters in Etsako central local government. The AC scored 7,884, ANPP scored 1 votes, DPP 6 while the PDP scored 3,712 votes. The number of rejected votes were 2146 while 13,337 were the total votes cast in this election."

"In my capacity as the constituency returning officer in Etsako Central Local government, I, Glenn Ukomadu hereby certified I was the returning officer of the re-run election held in Etsako central constituency. The election was contested and the candidate had the following votes, Oghuma Johnson scored 7, 884, Chris Umogbai scored 3, 712 votes. Oghuma Johnson is hereby declared the winner of the election signed this day".

Three fake INEC officials, one of them a staff of Edo State Ministry of Agriculture in charge of Fadama project in Akoko-Edo were arrested in ward 8 with the sum of N500,000 found on them.

They gave their names as Anslem Longe, Akande Francis and Solomon Evbogbai.

Solomon Evbobgbai is a staff of National Youth Servie Corps. The AC candidate, Johnson Oghuma promised to work for the development of his constituency.

It is now official: the Nigerian Communication Commission (NCC) has given an ultimatum that all new Subscriber Identity Module (SIM) card holders in Nigeria must be registered before activation as from March 1, 2010. This is aimed at tracking the identities of subscribers, following frequent complaints of the use of mobile phones for crimes such as threat, blackmail and fraud. It will also make kidnapping very difficult as demand for ransom is usually made via unregistered SIM cards.

The commission, in a statement signed by the Head of Media and Public Relations, Mr. Rueben Muoka, disclosed that arrangements had been concluded for the commencement of registration of all SIM card holders in Nigeria and directed all telecoms companies to put necessary arrangements in place for the smooth take-off of the exercise. The commission explained that to obtain new SIMs, valid identification documents such as e-Passports, corporate/company or work place identity cards that have pension identification/tax numbers etc, student ID cards from recognised institutions, driver’s licences issued by the Federal Road Safety Commission (FRSC) and e-Tax cards would be required before registration of new SIMs is enabled. The registration process, according to the commission, would include the capture of the photograph and biometrics of the subscriber, while proxy registration would be restricted to the direct families of persons seeking registration.

The commission disclosed that the timetable for the process of the registration of existing SIM card holders would be announced later. It said necessary processes and procedures were being put in place to guarantee a smooth registration exercise. The Head of Consumer Affairs of the NCC, Lolia Emakpore, had recently disclosed that Nigeria would start requiring prepaid SIM cards to have their ownership details registered with the network operators next year. She had stated then that the registration process would start in March 2010 and would last six months, thus giving users enough time to fill out the paperwork. She had reiterated that after the period ends, non-registered SIM cards would be shut out of the mobile networks. Emakpore had stressed that “the SIM card registration is in line with complaints that the commission had gotten that mobile phones are used to aid crimes and government has instructed the commission to adopt a mode to help stop crime.

Nigeria does not have an effective database and that is why we think six months is enough to cover the six geo-political zones in the country and even get to the local government areas.” The NCC is expected to collaborate with the Nigerian security and intelligence agencies and major telecoms operators to ensure that all existing and prospective prepaid mobile phone services are registered in the country. The exercise is expected to ensure security in the sector and curtail rising incidences of criminal activities enabled by the mobile phone and ameliorate the antics of fraudsters, kidnappers and undesirable elements in the country who take advantage of the current ease of procuring SIMs to perpetrate crimes. The entry of mobile telephony in 2001 has led to an era devoid of the mandatory accreditation of every telephone line in use, leaving an identity gap. Nigeria currently has over 70 million active subscribers.

Activist lawyer, Femi Falana, has argued that the signing of the 2009 supplementary budget by President Yar’Adua on his hospital bed at the King Faisal Specialist and Research Centre in Jeddah Saudi Arabia is illegal and unconstitutional.

Falana , quoting section 58(4) of the Constitution which says “Where the bill is presented to the President for ascent, he shall within thirty days thereof signify that he assents or that he withhold assent,” said that the signing of the said budget cannot stand. He argued that it is  already 36 days since the budget was passed by the National Assembly without Yar’Adua signing it.

But the Deputy Senate President, Ike Ekweremadu, yesterday, announced that the President had signed the budget as stipulated by the constitution. He was not specific on the exact date the budget was signed by Yar’Adua.

Meanwhile, a Federal High Court sitting in Abuja, this morning, adjourned till 6 January 2010 the matter instituted by Femi Falana and Bamidele Aturu against President Umaru Yar’Adua over his ill-health.

Its a shame that after years of Nigeria existence,we have not got people that reason with their brains.How will a nation subject her citizens to provide all personal information to enable them participate in an open market in buying a SIM card when there is no Data protection laws to guide/safety for the market.
Point to note why they will fail-
1.How will identity theft be checked
2.How will fakes/Oluwole be checked
3.How will the telecom operators detect a fake proof of identity.

If they have not make arrangements for these puzzles,then i will suggest the proposal is still a WISH.

Appeal Court declares Edo Assembly seat vacant
After two years and eight months legal tussle, the Court of Appeal in Benin on Monday called for a fresh election into Etsako Central Constituency in the state house of assembly on the ground that there was no election in the area on April 14, 2007. In a 45 minutes judgment delivered by Justice Saka Ibiyeye, the court upheld the decision of the lower tribunal which ruled on April 14, 2008 that there should be a fresh election in the area since the Independent National Electoral Commission (INEC) had cancelled the election and fixed April 28, 2007 for a bye election only for the election umpire to reverse itself on April 21 by declaring the Peoples Democratic Party (PDP) candidate in the election, Chris Umogbai as winner. This declaration led the Action Congress (AC) and its candidate, Johnson Oghuma to challenge INEC at the lower tribunal which ordered for fresh elections but the decision of the lower tribunal was challenged by the PDP and Umogbai in the appellate court. Ibiyeye ordered INEC to withdraw the certificate of return issued Umogbai and ordered that he "vacate his seat in the state house of assembly and INEC is hereby ordered to conduct fresh election within 45 days." With this decision, PDP now have 12 members while AC retains its 11 seats

A court have declared the 2007 election into house of Assembly that bring Umogbai Christian (Etsako Central) into the State legislative arm as Null and Void.A new election should be conducted within 45 days.
Before this verdict the house of Assembly are made up of 24 legislators,13 members are PDP and 11 AC.

Nigeria is good enough because that is what we can call OUR COUNTRY.
But on the issue of governance there is more to be desired.And they way and manner we flip over Nigeria issues cannot yield a possible good outcome for generations to come.
There are fundamental issues to be discussed among Nigeria elites than the state health of the President which have not actually created any vacuum in governance.Government is a continuous process and his absence has not create and vacuum until certified to be incapacitated.
Have we Nigerian discuss Budget performance?Every year Billions of dollars are been budgeted for but the performance are usually below average.How can a nation grow when a ministry expend only 22% of the year's budget.What happen to the other money?Just in the Banks to make make interest ?
We should set sentiment aside and be constructive in our discussions.

Nairalanders we have to be intelletually minded when dealing with complex issues.Firstly there is always a logic to an idea,before any one moving back to Nigeria,logically he/she knows Nigeria is not the USA,UK etc.If that is settled,secondly you will want to see how you can live a life close to what is obtainable in the west and that is depedent on your financial position.Even right here in the west you pay for ALL the "luxuries",but the difference is the level of inflation which higher in Nigeria.
Hypothetically any one relocation from Nigeria to the west cannot survive with N10 in his pocket so it is when moving over to Nigeria.
