ur argument makes no sense, I admit that this is not a criminal cases but, You forget to mention that civil case can lead him to loosing his seat, listen this is pre-election matter and such cases are civil in nature but, if found guilty that will automatically invalidate his mandate and force him out of office.... Their are many cases of pre-election matters that have removed many Governors with immunity from office and the president is no different.

It's either you didn't read my initial post entirely, or you lack basic comprehension skills. You can go back and read it again and then realise this your rant was useless.

The ACJ Act of 2015 can't be used here, because it's not a criminal matter. This certificate issue is purely civil. I'll explain.

Firstly, only government can prosecute a criminal matter in court. Where they don't want to, and a private individual wants to, the individual has to gain the consent of the Attorney-General, to be able to do so. The reason why instituting a criminal action against Buhari at this time won't hold is because the constitution protects the president from criminal prosecution. If the plaintiff in this suit can prove that Buhari doesn't have a WASC, then after Buhari may have been removed, criminal action may be instituted.

One of the best ways to differentiate between civil and criminal matters is in the relief being sought. While in criminal matters, the judgment is either imprisonment or payment of a fine, in civil matters, it's more about compensation, or a return to status quo(which is the case in this certificate matter).

Buhari's immunity is restriction from criminal prosecution. This is a purely civil matter so a case can be made against him.

Lol, these civilians you called played important patriotic roles at one point or the other. They took some wrong decisions at the time, no doubt, but they were still good men.

As for the '5 majors', even though their intentions were good, the fact that they didn't succeed would mean what they did will always have a criminal undertone, depending on which side of the fence you are. To some they're heroes, to others, villains.

P.S: they were more than 5 though.

Buhari's WASC is the subject of discussion.

Then you're quoting the wrong person cause I wasn't the one who introduced constitutional requirements to the discussion.

Besides, constitutional requirements is the umbrella under which Buhari's certificate saga rests.

Buhari's affidavit submitted to INEC was about his original WASC with the Secretary of the Military Board.

It was not about the WASC/school leaving certificate's equivalent.

That was what solicited the response from the military. They did not find Buhari's WASC in their records. They went ahead to produce the only document that faintly relates with Buhari's WASC in his record. It turned out to be a recommendation letter from his former principal 'pledging' that Buhari would pass English, Math and three other subjects.

In the midst of all these, Buhari caused the principal of what remains of his former secondary school to 'somehow produce' a result which was widely circulated.

He went that extra-mile to prove he wrote WAEC exams in 1961 and not WASC equivalent as you are trying to shift attention.

Your 'WASC' equivalent story is therefore not tenable, brother.

Why did he not swear that he has WASC equivalent(s).

Buhari had since taken office as the president of Nigeria with all the powers of the Commander-in-chief of the armed forces.

All he needs to do at this point is ask his lawyers to present his WASC in court and let the case end.

If you followed the conversation between me and the guy I quoted, you would realise that what we were talking about was majorly constitutional requirements to contest for presidency. Whether it is FSLC or WASC...shikena.

Abeg look well next time.

Well, there's a presumption that every Nigerian has his/her SSCE which is the default qualification at secondary level, till that is rebutted with a presentation of its equivalent. Till Buhari provides this 'equivalent', your lame attempt at a defence is hogwash.

you can also get a guardian article of around February 2015 on the issue. it was extensively discussed, except you are just so deep into apc/pdp issue, then you shouldn't have to limit things to what you heard from a source.

You're trying to be smart by half. What is the equivalent of a senior school leaving certificate?

it's high time we started teaching our constitution in pry and sec schools.

The minimum qualification to be President isn't a primary school leaving certificate. It's a secondary school leaving certificate. Don't mislead people here, in an effort to exonerate Buhari.
